An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462.357 and § 64 .210
of the Legislative Code, James E. Lennon duly petitioned to rezone
the South 78 feet of the following: the east 14.5 feet of Lot 2,
and all of Lots 13 and 14, B1ock 17 , P�IcMonigal and Varney' s Re-
arrangement, located at 71 W. Annapolis, from B-2 to B-3 for the
purpose of permitting continuance of an auto body shop, the petition
having been certified by the Department of Finance and Management
Services on March 23, 1983 as having been consented to by at least
67� of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the
owners of the property situated within l00 feet of the total contig-
uous descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Zoning Committee on April 21, 1983 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107. 03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission co�,sidered the rezoning
petition at its meeting held on April 22, 1983 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 37,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 71 W. Annapolis, being
more particularly described as the South 78
feet of the following: the east 14.5 feet of
Lot 2, and all of Lots 13 and 14, Block 17,
McMonigal and Varney' s Rearrangement, be and
is hereby rezoned from B-2 to B-3.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On April 21 , 1983, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The applicant testified, as did Gregory
Whebbe, the contract purchaser and operator of the body shop. A
representative from District 3 testified that the District Council supports
the rezoning as does the West Side Development Corporation. One other
person spoke and five letters were received in support. There was no
opposition at the meeting. At the close of the public h�aring, the
Committee voted 6-0 to approve the rezoning, because the site has been
an auto repair shop in the past and the neighbors support the rezoning.
On April 22, 1983, the Planning Commission upheld the Zoning Committee
recommendation on a vote of 16-0.
This rezoning is scheduled to be heard by the City Council on May 19, 1983.

JAMES E . LENNON (#9342) : Rezone from B-2 to B-3 to permit continuance of an
auto body shop at W. Annapolis.
The applicant was present. There was no opposition present at the hearing.
Ms. James showed slides of the site and revi�wed the staff report with a
recommendation for• denial . Four letters were received in support.
James Lennon reported that he was the current owner of the property and that
Greg Webbe, who has �een operating there as a body shop, is in the process
of purchasing it.
Greg Whebbe, 1078 Hall , testified that he was issued a license by the License
Division to operate an auto body shop on the premises . The building was
inspected and approved by the Fire Marshall . He has been at that location
since last September and intends to purchase the building and remain there.
He does not employsfs anyone and has not had any corr�laints from the residents
of the area.
Mr. Pangal asked Mr. Whebbe if he was aware of the fact that an auto body shop
was not permitted at that location.
Mr.Whebbe stated that he was not notified that an auto body shop was not
allowed. There was a body shop there previously but was not in operation
at the time he leased the building in Septerr�er of 1982.
Mr. Lennon reported that he had told the previous tenant that he could lease
the space for an auto body shop providing he obtained the necessary permit
from the city which he did. When Mr. Wpbbe began leasing the building,
he also obtained a permit from the City for an auto body shop and has been
operating there as a body shop.

Ron Bloch, 209 W. Page, presented a letter from Frank Rodriguez in support,
and stated the support of District 3 and the West Side Development Corporation.
Leo Tra�p, 32 E. Wyoming, spoke in suppoi,t stating that there is ample
parking on the site and would like to see the Committee promote businesses
in the City of St. Paul .
Nearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.

. G. FINDINGS:
l . Petitioner proposes rezoning this site to B-3 to permit continuance of an auto
body shop.
2. In 1978 and again in 1982, the Zoning Administrator informed the License Division
that body shops were not permitted at this location.
3. This location is an isolated commercial spot in a largely residential area, but
it is not identified in the Land Use Plan as a neighborhood commercial ceri.er.
In any event, the Land Use Plan discourages the expansion of these centers .
4. The Land Use Plan encourages the buffering or removal of uses that conflict with
surrounding residential uses . There is little or no buffering between this use
and its neighbors to the west and north.
5. The intent of the B-3 General Business District is to provide for more diversified
types of business than B-1 and B-2. Its intended location is along major.
traffic arteries or adjacent to B-2 districts .
6. T��e site is located on the corner of Annapolis and Stryker. The Street and
H�ghway Plan classifies Annapolis as a local street and Stryker as a collector.
Neither is a major traffic artery. (The West St. Paul Comprehensive Plan
identifies these same streets as minor collectors, which are somewhere between
St. Paul 's local and collector classifications. )
7. The only other 6-2 property in the area is the small rnixed commercial-residential
structure across Stryker. (The West St. Paul Comprehensive Plan recommends
residential use on the south side of Annapolis . )
8. Other uses permitted in the B-3 district are mortuaries, auto sales, and fast
food restaurants .

H. STAFF ANALYSIS: This location is primarily a low density residential area. Both
St. Pau s and West St. Paul 's Comprehensive Planscall for low density residential
uses at this location. Neighborhood-oriented retail uses are permitted under the
existing zoning. The new uses that would be permitted under the proposed B-3
zoning would do little to improve the residential character of the neighborhood,
and could harm it.
I . STAFF RECOMMENDATION: Based on findings 1 through 8 and the staff analysis, staff
recommends denial of the rezoning to B-3.

Dear Sirs:
I would like to recommend a request of my constituent, Greg Webbe,
regarding zoning from B2 to B3 to permit continuance of an Auto
Body Business at 71 West Annapolis Street.
Mr.Webbe is in the process of purchasing the property. He did
apply and was awarded a permit and he is now doing business at
that location and intends to remain in business permanently.
It is unfortunate that the error in zoning was not discovered
until after he was in operation, but this would be his livelihood
and the refusal of the re-zoning would deny him that opportunity.
I regret that my legislative duties prohibit me from being in
attendance, but I strongly urge your concurrence with this
recommendation.
