An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining to
zoning for the City of Saint Paul and the
zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462. 357 and � 64. 210
of the Legislative Code, David Kusek duly petitioned to rezone
Subject to streets, Lots 21 & 22, Block 5, Clark' s Addition, located
on the north side of U�est Seventh Street between Armstrong and View,
from B-2 to RM-2 to permit conversion of commercial space to resi-
dential use, the petition having been certified by the Department
of Finance and Management Services on March 30, 1983 as having been
consented to by at least 670 of the owners of the area of the proper-
ty to be rezoned, and further having been consented to by at least
two-thirds of the owners af the property situated within 100 feet
of the total contiguous descriptions of real estate held by the
same owner or any party purchasing any such contiguous property
within one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on April 21, 1983 con-
ducted a �ublic hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative Code
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its �neeting held on May 22, 1983 and recommen�ed that
the City Council approve the petition; and
ti�HEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official

On April 21 , 1983, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. A representative of the petitioner explained

On May 22, 1983, the Planning Commission upheld the Zoning Committee's
recommendation by a vote of 16-0.
This rezoning is scheduled to be heard by the City Council on May 12, 1983.

DAVID KUSEK (#9337) : Rezone from B-2 to RM-2 to permit conversion of

The applicant was represented. There was no opposition present at the hearing.
Ms. James showed slides of the site and reviewed the staff report with a
recommendation for approval . No correspondence was received on the matter.
Leonard Schwartz, 1440 Pleasant, representing the applicant, stated that he
had circulated the rezoning petition.
Hearing no further testimony, Mr. Bryan closed the public hearing portion of
the meeting.

F. . ZONING HISTORY: Prior to 1975 the site was zoned commercial . In 19�5 it was zoned
-2. In 966 a permit was granted for a 9-car parking lot for a 6-unit apartment
building. In 1980 a building permit was issued for a 4-car garage in the rear.
G. FINDINGS: �
1 . Petitioner proposes converting the existing commercial space to residential use. �
� It is the same size as the other apartments, and was designated as office space
so that the apartment building could be constructed in a commercial zone.
2. The Comprehensive Plan supports compatible mixing of residential and commercial
uses along commercial strips. The Housing Policy Plan supports expansion of
the rental housing supply.
3. Redevelopment plans for the West Seventh Area recommend rowhouses or multi-family
residential at this location.
4. �The intent of the RM-2 district is to "permit comprehensive de'velopment of a �
multiple-family project so as to establish a balance of population concentration
as related to major thoroughfares and transit, and related facilities.°
5. West Seventh Street is a minor arterial-B and a bus route. Convenience commercial
use is next door.
6. Minimum lot area in the RM-2 district is 10,000 sq. ft. in computing this area,
one-half of an adjoining alley can be used. For zoning purposes, petitioner's
lot area is 10,400 sq. ft. At RM-2 density, 17 rooms would be permitted.
Petitioner proposes 7 one-bedroom units for a total of 14 rooms .
7. Teq off-street parking spaces would be required for new construction. Petitioner
has 9 off-street spaces. �
H . STAFF RECOMMENDATION: Base.d on findings 1 through 6, staff recommends approval of
�the rezoning of 45 W. 7th to RM-2.
