RESOLVED, That upon the petition of the City of St. Paul,
the public property hereinafter described, be and the same
hereby is vacated and discontinued as public property:
"Except West 60 feet all of Lots six
(6) and seven (7) , West St. Paul, "
known as 69 West Congress Street;
subject expressly to the following conditions and reservations:
1. That the vacation be subject to all of the terms
and conditions of Chapter 130, codified March 1,
1981, of the St. Paul Legislative Code, as amended,
including the retention of all public utilities
easements.
2. That the property be transferred to the Hispanos En
Minnesota, now tenants of said property, with a deed
restriction that the property be used for purposes
consistent with lease agreement and H.U.D. regulations
for their low and moderate income clients until June
30, 1988.
3 . That the petitioner being the City of Saint Paul, shall
not be required to pay compensation.

Subject: Petition of the City of Saint Paul, for the vacation of
69 West Congress Street
Public Hearing - April 26, 1983
The City of Saint Paul, as petitioner and with the concurrence of U.S.
Department of Housing and Urban Development (H.U.D.), request that subject
property be vacated and transferred to the Housing and Redevelopment Author-
ity (H.R.A.) who will convey the property to Hispanos En Minnesota (H.E.M.).
The property is a two-story frame house consisting of eleven rooms and is
zoned R.T. 1 (Two-Family Residential District).
The City acquired 69 West Congress Street in 1978 with Community Development
Year II funds for use as an emergency housing facility. The City leased the
property to H.E.M. and they operated a comprehensive program of emergency
shelter and ancillary services for more than two yesrs with H.U.D.�s approval.
During the lease period, H.E.M. made extensive improvements to the property
and paid for all operation expenses. On several occasions H.E.M. has re-
quested- that the City donate the property to them. The Department of Plannfmg
and Economic Development (P.E.D. ) believes that the donation would be appro-
priate in light of the extensive improvements made by H.E.M. and the fact
that they operated a very expensive and important program for more than three
years.

The Department of Planning and Economic Development requested and received
approval from Mr. Thocnas T. Feeney, Area Manager, Department of Housing and
Urban Services to transfer the subject property located at 69 West Congress
Street to Hispanos En Minnesota with a deed restriction that they use the
facility for housing purposes for their low and moderate income clients until
,7une 30, 1988, which is ten years from the date the property was initially
acquired for housing by H.E.M.
In view of the foregoing, I recou�end that the vacation be approved, subject
to the following terms and conditions:
1. That the description of the property to be vacated
read as follows;
"Except West 60 feet all of Lots six (6) and seven
(7), Block 57, West St. Paul," known as 69 West
Congress Street.

Attached herewith please find the vacation resolution requested
in the above matter. You should note that the city will be
conveying the property directly to H.E.M. without HR.A being
an intermediary. Furthermore, you should note that the deed
restriction says that the property must be used consistent with
purpose stated in lease agreement and H.U.D. guidelines.
