RESOLVED, That upon the petition of the City of Saint
Paul, the public property hereinafter described, be and the
same hereby is vacated and discontinued as public property:
"Tracts C, D, E, F, G and the Westerly
250.6 feet of Tract H, of Registered
Land Survey No. 82" ;
subject expressly to the following conditions and reservations:
l. That the vacation be subject to all the terms and
conditions of Chapter 130, codified March 1, �1,
of the St. Paul Legislative Code, as amended.
2. That the City convey the said property back to the
original owner subject to payment of $500.00 to
cover the City Administrative Costs.
3. That the petitioner being the City of Saint Paul shall
not be required to pay compensation.
4. That upon acceptance and compliance with the terms of
this vacation the proper City officials be authorized
to convey said property to the original owners or
their designee by quit claim deed.

INTERDEPARTMENTAL MEMORANDUM

Subject: Petition of the City of Saint Paul for the vacation of a
certain parcel of land located in Registered Land Survey
No. 82 Public Hearing: June 7, 1983
John and Carolyn Cochrane donated the referenced property located on the
South side of Minnehaha Avenue between Pederson and Winthrop Streets to
the City in November, 1975, for park purposes only.
The Department of Community Services states that there has been no development
and that there is no intention to develop this area for park purposes in the
foreseeable future.
There is a reverter clause contained in the deed to the City stating that if
the referenced property is not used for park purposes it shall revert back
to its original owner. The reverter clause and the lack of the City's
interest in the property for park purposes creates a situation whereby
the property has no value to anyone (public or private) except for the
original owners. I will, therefore, recommend no market value compensation
to the City for this property. I will, however, recommend the standard minimum
$500 payment to cover the City's administrative costs to process this matter.
The Department of Public Works reviewed this proposed vacation and had no
objection to it.
The Department of Planning and Economic Development also reviewed this vacation
and found no objection to the vacation.
There were no objections or recommendations from any public or private agencies
involved. �
In view of the foregoing, I recommend that the vacation be approved subject to
the following terms and conditions:
1. That the description of the property to be vacated
read as follows:
"Tracts C, D, E, F, G and the Westerly 250.6 feet
of Tract H, of Registered Land Survey No. 82”.
2. That the vacation be subject to all the terms and
