WHEREAS, 3293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Gabe's by the Park, represented by Timothy Weiss,
President, who has been designated as the responsible person on
the application, has applied for a variance to allow live music
at 991 North Lexington Avenue, on March 17, 18 and 19, 2000 and
on October 27 and 28, 200�; and
WHEREAS, applicant is seeking a variance for the hours of
4:00 p.m. to midnight on March 17 and 1S, 2000, from 12:00 noon
until 6:00 p.m. on March 19, 2000 and from 4:00 p.m. to 12:00
midnight on October 27 and 28, 2000; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live musio; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Gabe's by the Park, subject to the following
conditions:
1) The variance shall be for the hours of 4:00
p.m. to midnight on March 17 and 18, 2000,
from noon until 6:00 p.m. on March, 19, 2000,
and from 4:00 p.m. until midnight on October
27 and 28, 2000.
2) All electronically powered equipment used in
conjunction with the event shall not exceed
95 dBA as measured from the wall located
opposite from the stage.

The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 4:00 p.m. and
midnight on March 17 and 18, 2000, between
noon and 6:0� p_m_ on March 19, 20Q0 and
between 4:00 p.m. and midnight on October 27
and 28, 2000 to ensure compliance with
Condition #2.
4) All electronically powered equipment, PA
systems, loudspeakers or similar devices
shall be turned off no later than midnight on
March 17 and 18, 2000, 6:00 p.m. on March 19,
2000 and no later than midnight on October 27
and 28, 2000.

FURTHER RESOLVED, that any violation of the conditions set
forth above on any of the clates may result in revocation of the
grant of a variance for any of the subsequent dates set forth
above, in addition to any criminal citation which might issue.

Attached is a sound level variance application from Tim Weiss, President, Gabe's By The Park. A variance
is requested for amplified music and sound equipment for three St. Patrick's Day Tent events from 4:00 p.m.
to 12:00 midnight on March 17 & 18, 2000 and &om 12:00 noon to 6:00 p.m., March 19, 2000; and for two
Halloween Tent events from 4:00 p.m. to 12:00 midnight on October 27 & 28, 2000. The music will be held
in a canvas tent on the premises.

Attached is a sound level variance application from Tim Weiss, President, Gabe's By The Park. A variance
is requested for amplified music and sound equipment for three St. Patrick's Day Tent events from 4:00 p.m.
to 12:00 midnight on March 17 & 18, 2000 and &om 12:00 noon to 6:00 p.m., March 19, 2000; and for two
Halloween Tent events from 4:00 p.m. to 12:00 midnight on October 27 & 28, 2000. The music will be held
in a canvas tent on the premises.
Also attached are a copy of the Public Hearing Notice which will be sent to property owners within 200 feet
of the establishxnent at 991 Lexington Parkway N., and a copy of the Resolution.
