SUBJECT: Request variance on Minnesota Uniform Fire Code , Sectian 10. 315 ,
per a ng to fire-extinguishing equipment for protection of kitchen
grease hoods and ducts , because of economic hardship.
APPEARANCE : James R. Wuollet
Jeanne Dornfield, Fire Prevention Bureau
PROCEEDINGS : Mr. Wuollet explained th at the doughnut fryer is used only
a couple of hours each day, and there is a manual fire extinguisher
nearby. Grease ducts are cleaned at regular intervals. The 24 sq. inch
fryer is near a corner and grease ducts run up a short distan ce and out
through a block wall of the single-story building. The cost for instal-
ling fire-extinguishing equipment abov�e the fryer would be about $1500.
He said the business has been suffering economically the past year and
the owners hoped to put off such an expense until a later date when
business improves.
Je anne Dornfield reported that employees of the bakery estimated that
the fryer was used about 2 1/2 hours per day, six days a week. Fire-
extinguishing equipment was required in this type of situation by three
differen� codes.
Greg Plante described in detail the setup of an approved system.
Messrs. Knutson and Gausman questioned Mr. Wuollet concerning the grease
hood and duct system over the doughnut fryer.

every 12 working days and that a log be kept on the dates of cleaning,
the vari ance to be effective until such time as the required equipment is
installed or the usage changed. Mr. Sawyer seconded. MOTION CARRIED.

PROCEEDINGS : Mr. Bry ant said he lived at 434 Lafond in Apt. #11. The
kitchen was an inside room and it was not possible to provide a window
to the outside. The stove was in the center of the room, with a charcoal
type venting de vice directly above.
Alice Bijjani stated that this type of ventilation was not satisfactory,
but there was an approved type of ductless hood available. She agreed
that the layout of the apartment was such that providing the required
light and ventilation would be extremely difficult.
BOARD ACTION : Chairman Glassman moved that a variance be granted on
Section 34. 14 to permit cbntinued use of Apt. #11 where the kitchen Iacks
sufficient light and ventilation, on condition that an approved ventless ,

of practical difficulty and expense.

PROCEEDINGS: Mr. Rieger displayed some pictures of the interiors of the
two apartments. He said that each basement apartment had a sing7e gentle-
man occupant of limited income , and both would find it difficult to find
another apartment at such low rent.
Alice Bijjani stated that the inspe ctor had noted the problem of pro-
viding light and ventilation in the kitchen, that requiring compliance
would impose an exceptionally large fin an cial burden , and that it

was not pr actical to order vacation of the units , which othe rwise conform,
in this situation. Ms. Bijjani pointed out on a rough sketch of the
area that access to the shared bathroom was direct from each apartment--
a much better situation th an one where access was gained from a common
hallway outside the apartments.
BOARD ACTION : Chairman Glassman moved that the variances be granted on
Se ction 34. 14, to permit continued use of Apt. #4 where kitchen lacks a
window for light and ventilation , on condition th at an approved ductless
f.an be installed. He also moved that a variance of Section 34. 1I be
granted to permit occupants of two basement dwelling units to continue
sharing use of one bathroom, on condition that occup an cy be restricted to
one person in each unit. Mrs. Bostrom seconded. MOTION CARRIED.
THE VOTE: Ayes - 5 Nays - 0 Abstentions - 0
A discussion of the lack of a handsink in the shared bathroom ensued.
Ms. Bijjani said this was especially important in a bathroom that was
shared. Mr. Rieger stated that his plumber had indicated there would be
some difficulty putting in a handsink, but there was available wall space.
Mrs. Rieger said this would be expensive and the tenants have very low
incomes. She didn' t like the idea of having to increase their rents. -
BOARD ACTION: Mr. Gausman moved that the appeal for a variance on Section
34. 11, pertaining to handsink requirement in bathroom f acilities , be
denied, with a time extension �to November l, 1983, for compliance.
Mrs. Bostrom seconded. MOTION CARRIED. �

SUBJECT: Request variance on Section 34. 14 , pertaining to light and
ventilation, which was overlooked at original inspection and not included
in appeal at April 1983 meeting. Appellant asks that matter be heard
vsithout him being present because of his work schedule. Housing code.

APPEARANCE : None
PROCEEDINGS : Because of an oversight by the housing code office , Ms.
Bij jani had suggested to the appellant that he need not appear and that
she would present the matter to the board. She said if the board was
not willing to make a decision , she would ask Dr. Parupsky to appear at
a later meeting. She pointed out on a rough sketch of the basement unit
that there was a deficiency of light and ventilation in both the kitchen
and the combination living/sleeping room. The kitchen deficiency was
slight. In the living/sleeping room, the deficiency was greater. She
said that Dr. Parupsky was looking more favorably on the matter of
continuing the use of the basement unit after the expiration date of
his present tenant' s lease December 31, 1983 , an option granted by the
board in April on condition th at he bring the escape window up ta code
requirements. If he did decide on this approach, he would be putting

The meeting was called to order at 1:35 p.m.
The minutes of the meeting of April 12 , 1983, were approved as distributed
to the members.
Alice Bijjani reported that she had suggested to the appellant in the first
case listed on the agenda, No. 74-82-H, 256 Marshall, Appellant Thomas R.
Best, that he need not appear at today' s meeting, since an inspection had
confirmed that good progress is being made on the rehabilitation of his
property. No further actian by the board would be necessary.

SUBJECT: Request variances ora Section 34. 09 , pertaining to deadbolt locks ,
Sec on 34. 14 , light and ventilation, and Section 35.03 , pertaining to
stairwell enclosures and smoke doors within stairwell enclosures , because
of financial hardship.
Prior Hearing 4/12/83 : Case was con tinued to May mee ting to allow time
to reinspect property and obtain further information.

PROCEEDINGS : Mrs. Petroski said that some of her questions had been
answered since the last meeting. Those concerned with the placement of
the smoke detectors and the` requirements on deadbolt locks have been cleared
up and are no longer subjects involved in her appeal.
Ms. Bijjani said the main concern that needed more investigation after the
hearing in April was the problem of the rear stairwell. This involved a
kitchen window which would be blocked if the stairwell would be enclosed,
creating a problem with insufficient light and ventilation in the kitchen.
The Fire Dept. has not been accepting wire glass in window5 as an alterna-
tive in such situations. Another problem was how to put a self-closer on
the trapdoor that led into the third floor. After discussion with her
supervisor and Chief Inspector Sam Blue , they concurred with her that the
best solution was to sheetrock over the underside of the trapdoor opening ,
thereby making the stairs two stories only and eliminating the need for
changing all the glass and other details in that stairwell. There are
already closers on the doors.
BOARD ACTION : Mr. Sawyer moved that a variance of Chapter 35 be granted,
permitting the trap door from the rear stairs to the third floor apartment
to be closed off with 5/8" sheetrock, eliminating the need for enclosure
of the re ar stairs. Mrs. Bostrom seconded. MOTION CARRIED.
THE VOTE : Ayes - 5 N ays - 0 Abstentions - 0
Mrs. Petroski said the remaining questions concerned the five oak doors
th at open on the stairwells and basement windows in the sleeping area of
that unit. She did not want to mar the appearance of the doors with sheet
metal paneling.

Ms. Bijjani explained that the doors were all 3/4" with ) /4' paneling,
except one that had a glass panel. She said the application of 1/4"
to 3/8" panels to the existing panels would bring about greater satety,
although there was some disagreement among housing code personnel as to
whether it should be regarded as acceptable. The glass-paneled door
could be altered, either with the substitution of wire glass or by cover-
ing the glass with plywaod, to meet fire rating requirements.
BOARD ACTION: Mrs. Bostrom moved that a variance of Section 35. 03 be
granted, permitting continued use of five apartment entrance doors which
open into the front stairwell, on conditian that additional plywoad panels ,
1/4" to 3/8" in thickness , be laminated to existing 1/4" paneling, and
that glass in one of the doors be replaced with wire glass or couered
over with plywood of approved thickness. Mr. Gausman seconded. MOTION
CARRIED.
THE VOTE: Ayes - 5 Nays - 0 Abstentions - 0
Chairman Glassman asked if the self-closing doors in the rear of the build-
ing had been taken care of, and Ms. Bijjani said the appellant had agreed
to meet the requirements .
Ms. Bijjani said the windows in the basement sleeping rooms were of insuf-
ficient height if the existing windows are retained. If casement windows
would be substituted for the double-hung, all requirements would be met
without disturbing the wall. �
BOARD ACTION: Chairman Glassman moved that a variance be granted on
Section 34. 14, p�rtaining to light and ventilation, on condition
that casement -type windows be installed to replace existing clouble-hung
- windows to provide an emergency escape route. Mr. Gausman seconded.
MOTION CARRIED.
THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0
N.rs. Petroski asked how soon all the work was supposed to be completed.
BOARD ACTION: Mr. Sawyer moved that the appellant be granted a time
extension of six months to complete the required work. Mrs . Bostrom
seconded. MOTION CARRIED.
