No . 201 , 1 FESTAURANTS, AND ON-SALE E?�CLUSIVE LIOUOR STORES . ] "On-sale" 2 licenses may be issued by municipalities for the sale of 3 intoxicating liauors in hotels, clubs, restaurants and 4 establishments for the sale of "on-sale" liquors exclusively 5 within the number authorized by this section. In addition to 6 the number of licenses authorized by this section, an "on-sale" 7 license may be issued, if approved by the commissioner of public 8 safety, to a bona fide club �kiek kas l�eeH y� ex=s�exee £er �5 9 �ea�s e� r�e�e or �e a congressionally chartered veteians ' 10 organization which has been in existence for €��e at least three -------------- 11 years . The club or veterans ' organization must be incorporated 12 in order to be eligible to apply for a license, and the license 13 isstzed must be for the sale of i:ztoxicating liquors to members 14 and bona fide guests only. The licen�e fee for an "on-sale" 15 license issued by a municipality pursuant to this subdivision 16 shall be in an amount determined by the governing body thereof 17 subject to the following limitations : up to $300 for a veterans 13 organization or fraternal club with a membership of 200 or less; 19 up to $S00 for a veterans organization or fraternal club witn a 20 membership of between 201 and 500; up to $650 for a veterans 21 organization or fraternal club with a membership of between SO1 22 and 1, 000; up to $800 for a veteraiZS organization or fraternal 23 club with a membership of bet;aeen 1, 001 and 2 , 000; up to $1 , 000 24 for a veterans organization or fraternal club with a membership 25 between 2 , 000 and 4, 000; up to $2 , 000 for a veterans Z6 organization or fraternal club witti a membership of between 27 4, 001 and 6, 000; and up to $3 , 000 for a veterans organization or 28 �raternal club with a membership of more than 6, 000. For 29 purposes of the maximum license fee which may be imposed by a 30 municipality pursuant to this subdivision, "fraternal club" 31 means a club which serves only members and their guests and 32 whzch uses any profits derived from these sales principally for 33 sponsoring activities beneficial to the community and not for 34 the benefit of any individual . Except in cities of the first, 35 second, and third class, a license may be issued jointly to 36 congressionally chartered veterans ' organizations that otherwise 2 � S . F. No . 201 - . ll����*�� _ . 1 qualify under this subdivision. 2 Sec . 3 . Minnesota Statutes 1982 , section 340 . 11 , 3 subdivision 15 , is amended to read: 4 Subd. 15 . [ LICENSES NOT REOUIRED, ] It is lawful for a 5 bretaer to sell intoxicating malt beverages to his employee or to 6 a former employee who is retired because of age or physical 7 disability. Such beverages shall be sold for consumption off 8 the premises only, and the amount sold to any one person in any 9 one week shall not exceed 768 fluid ounces . The requirements of 10 law relating to minimum prices for the sale of' i�toxicating malt 11 beverages sna11 not apply to sales made under tYiis subdivision, 12 nor shall any license be reqtiired for the making of such sa�es. 13 It is also lawful for a collector of commemorative bottles, as 14 these terms are defiized in section 340. 44, to sell commemorati��e 15 bottles to another collector without obtaining a license . It is 16 also lawful for an off-sale licensee or municipal liquor store -------------------------------------------------------------- 17 to provide samples of wine, liqueurs, and cordials w:Zich the ------------------------------------------------------------ 18 licensee or municipal liquor store currently has in stock and is ---------------------------------------------------------------- 19 offering for sale to the general public without obtaining an ------------------------------------------------------------- 20 additional license, provided the wine, liqueur, dnd cordial ----------------------------------------------------------- 21 samples are dispensed at no cnarg� and consurned on the Lic?n:�ed --------------------------------------------------------------- 22 premises during the permitted hours of off-sale in a quantity ------------------------------------------------------------- 23 less than SO millilite?-s of �,aii�e per variety par custcmer ar_d 25 ---------------------------------------------------------------- 24 milliliters of liqueur or cordial per variety ner customer. --------------------------------------�--------------------- 25 Sec . 4. F. No . 2O1 1 the same county, "off-sale" may be made only until eight o' clock 2 p.m. of any day except Friday and Saturday, on which days 3 "off-sale" may be made until ten o ' clock p .m. No "off-saie" 4 shall be made on D1ew Years Day, January l ; Independence Day, S Ju1y 4; Thanksgiving Day; or Christmas Day, December 25; but on 6 the evenings preceding such days, if the sale of liquor is not 7 otherwise prohibited on such evenings, "off-sales" may be made 8 until ten o ' clock p . m. , e�cept that no "off-sale" sha11 be made 9 on December 24 after eight o ' clock p . m. It sha11 be beyond the 10 power of any mtinicipality of this state to authorize or permit 11 th? sale of intoxicating iiquors Tr�hen such sale is prohi�ited by 12 this section, howevzr, any municipality may further limit the 13 hotzrs of sale of intoxicating liquors, provided that such 14 further restricted houis for "on-sale" shall apply to both 15 intoxicating liquors and non-intoxicating malt liquors . 16 Sec . 5 . Minnesota Statutes 1982 , section 340 . 15 ,. is 17 amended by adding a subdivision to read: 18 Subd. 3 . This section does not apply to advertising of ----------�-------------------------------------------- 19 liquor prices by an off-sale licensee in a newspaper of general --------------------------------------------------------------- 20 circulation published in a bordering state if t�1e newspaper is -------------------------------------------------------------- 21 the primary ne�;�spaper of general circtilation in the area in ----------------------------------------------------------- 22 which t�:e off-sale lic�nsee is located. --------------------------------------- 23 Sec . 6 . Minnesota Statutes 1982 , section 340 . 408, is 24 amended to read: 25 340 . 408 ( JOINT PURCHASES . ] 26 No variable volume price or discount sha11 be offered to a -------------------------------------�--------------------- 27 retailer for a quantity of distilled spirits or wine in excess -------------------------------------------------------------- 28 of 300 liter or smaller bottles . The joint purchase for resale -------------------------------- 29 to the general public of 300 or fewer qt�a�� liter or smaller 30 bottles of �H�ex�ea��H� ��qtie� distilled spirits or wine by more ------------------------- 31 than one person lawfully permitted to sell �H�ex�ea�}�� �}e�He� 32 distilled spirits or ���ine to the general public is lawful . I�10 ------------------------- 33 rule or regulation pursuant to this chapter shall prohibit a 34 lawful purchase pursuant to this section. 35 Sec . 7 . Minnesota Statutes 1982, section 340 . 983 , is 36 amended to read: 4 ��A� S . F. No . 201 ' t, ; ; �.�� 1 340 . 983 [ FILING OF WHOLESALE PRICE SCHEDULE . J 2 No brand owner or wholesaler of distilled ?�yc�xe� spirits or 3 wine shall sell, offer for sale, or solicit any order tor 4 distilled liquor or wine unless a schedule of wholesale prices, 5 which shall include varying volume prices, is filed with the 6 commissioner, on a form prescribed by him, and no sales shall be 7 made except in accordance with �t�ek these prices . st�e?� Forms 8 shall provide for the listing of the price, including any 9 varying v�lume prices, at which eactl brand distributed by the 10 filinc� wholesal�i or brand owiler is sold. The commissioner 11 shall maintain s�e� filings in such a manner as to make their 12 contents easily accessible to the public . The filin7s required 13 under this section shall be made not later than the first day of 14 each month, and the schedule of filed prices sha11 be effective 15 from that day until the first day of the next month, provided 16 that any filiilg may be amended withiii five days after its 17 filing. The commissioner sha11 provide copies of sxek filings 18 to any person requesting them, and may charge a reasonable fee 19 therefor. [ ST. PAUL; PARK CLUB HOUSES; LIOUOR. ) 25 Notwithstanding any contrary provision of 1aw, charter or ----------------------------------�---------------------- 26 ordinance, the city of St. Pau1 may by ordinance authorize any -------------------------------------------------------------- 27 holder of an "on-sale" liquor license issued by the city to _-�--------------------------------------------------------- 28 clispense intoxicating liqtior at any event of definite duration -------------------------------------------------------------- 29 on the public premises known as the Phalen Park club house . The ---------------------------------------------------------------- 30 event may not be profit making except as a fund raising event ------------------------------------------------------------- 31 for a nonprofit organization or a political committee as defined ---------------------------------------------------------------- , 32 in Minnesota Statutes, section 210P.. 01, subdivision 8 . The ----------------------------------------------------------- ' 33 licensee must be engaged to dispense liquor at the event by a ------------------------------------------------------------- 34 person or organization permitted to use the premises and may ------------------------------------------------------------ 35 dispense liquor only to persons attending the event. A ------------------------------------------------------- 36 licensee ' s authority shall expire upon termination of the ------------------------------------ --------------------- 5 - S . F . The authority to dispense liquor shall be granted in ------------------------------------------------------------ 2 accordance with the statutes applicable to the issuance of ---------------------------------------------------------- 3 "on-sale" liquor licenses in cities of the first class ------------------------------------------------------ 4 consistent with this act. The dispensing of liquor shall be ------------------------------------------------------------ S subject to all laws and ordinances governing the dispensing of -------------------------------------------------------------- 6 intoxicating liquor that are consistent with this act. A11 ----------------------------------------------------------- 7 dispensing of liquor shall be in accordailce with the conditions --------------------------------------------------------------- 8 prescribed by the city. The conditions may limit the dispensing ----------------------------------------------------------------- 9 of liquor to designated areas of the facility. The city may fix ---------------------------------------------------------------- 10 and assess a fee to be paid to the ci.ty by an "on-sale" licensee ---------------------------------------------------------------- 11 for each event for which the licensee is engaged to dispense ------------------------------------------------------------ 12 liquor. The authority granted by this subdivision shall not ------------------------------------------------------------ 13 count as an additional "on-sale" intox.ica�ing liquor license for ---------------------------------------------------------------- 14 purposes of determining the numbei of liquor licenses permitted --------------------------------------------------------------- 15 to be issued under the provisiens of P�tinnesota Statutes, section ---------------------------------------------------------------- 16 340. 11 . 17 Sec . 9 . [MIDINETONKA ON-SALE LIOUOR LICErISES, ) 28 The city of Minnetotzka may issue three on-sale licenses for ----------------------------------------------------------- 29 the sale of intoxicazing liquor, which licenses shall be in ----------------------------------------------------------- 30 addition to the number authorized by Minnesota Statutes, section ---------------------------------------------------------------- 31 340. 11, subdivision 5a. All other provisions of chapter 340 ------------------------------------------------------------ 32 shall anply to licenses issued pursuant to this section. . -------------------------------------------------------- 33 Sec . 11 . ( LONG PRAIRIE ON-SALE LICENSE. J 34 Notwithstanding the period of incorporation requirement of ---------------------------------------------------------- 35 section 340. 11, subdivision 11, or any law to the contrary, the --------------------------------------------------------------- 36 city of Long Prairie may issue one club on-sale intoxicating ------------------------------------------------------------ 6 ' � S .
