f WHEREAS, The City desires to widen and reconstruct Maryland Avenue (County State Aid Highway(CSAH) 31) between
2 Weide Street and Mendota Street using Municipal State Funds; and
3 WHEREAS, It is proposed to construct Maryland Avenue between Weide Street and Mendota Street with 10' wide traffic
4 lanes and 1' wide curb reaction distance; and

6 WHEREAS, Minnesota Rule 8520.9936 requires � 1' wide traffic lanes and 2' wide curb reaciion distance; and

$ WHEREAS; tfie proposed traSfic lane widths and curb reaction distance do not conform to Minnesota Rule 8820.9936 and
g a variance is needed in order to use Municipal State Aid Funds; and
1 � WHEREAS, the Commissioner of Transportation requires that the City of Saint Paul adopt a resolution indemnifying,
11 saving a�d holding harmless the State of Minnesota from any claims arising out of granting a variance; and

WHEREAS, The City has no other option available to it to receive the variance requested unless it complies with the
requirement of the Commissioner of the Department of Transportation; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul hereby authorizes the Director of Public Works to request a
variance from Minnesota Rule 8820.9936 to allow 10' wide traffic lanes and 1' wide curb reaction distance in lieu of the
required distance; and be it further
RESOLVED, That as the sole condition to receiving a variance from the provisions of State Aid Rules Section 8820.9936,
the Council of the City of Saint Paul does hereby agree to indemnify, save and hold harmless the State of Minnesota and
its agents and employees of and from any and all claims, demands, actions, or causes of action arising out of or by reason
of the reconstruction of County State Aid liighway 31 (Maryland Avenue) located between Weide Street and Mendota
Street, in any other manner than as in accordance with Minnesota Rules 8820.9936 and further agrees to defend at their
sole cost and expenses any action or proceeding commenced for the purpose ot asserting any claim of whatsoever
character arising as a result of the granting of this variance.
