costs for a fire protection system for 867 Pierce Butler Route; and
4 WHEREAS, said petition meets the requirements of Minnesota Statutes 429 and the City policy on
5 assessing costs for fire protection systems; and

7 WHEREAS, the Council has fully considered and reviewed the petition and policy; now, therefore, be it

9 RE50LVED, that the Council of the City of Saint Paul does hereby authorize the above described
10 improvement be made, and the proper City officials are hereby directed to proceed with the
11 improvement; and be it

13 FURTHER RESOLVED, that upon completion of said improvement, the proper City officials shall
14 calculate all expenses incurred therein and shall report the same to the City Council in accordance with
15 Chapter 429 of the Minnesota Statutes and the fire protection system policy; and be it

17 FLTRTHER RESOLVED, by the Council of the City of Saint Paul, upon recommendation of the Mayor

Dear Mr. White:
This letter will serve as a formal request to begin the assessment process to install a
sprinkler system at 867 Pierce Butler R., St. Paul, MN.
I understand that that the Frogtown Action Alliance is responsible for the installation of
the sprinkler system and will be responsible for presenting invoices and mechanics lien
waivers for payment of the same.
It is also my understanding that, in the event this project is abandoned by the Frogtown
Action Alliance that they reimburse all costs incurred by the city relating to this
assessment. In addition, the Frogtown Action Alliance hereby waives their rights to a
pubiic hearing and their rights to an appeal of this assessment.

The Frogtown Action Alliance has submitted plans to be approved by the Department of
Fire and Safety Services, and Housing and Building Code Enforcement. Attached is a
copy of a title insurance commitment, which shows that the Frogtown Action Alliance is
the record owner of the above property.
I am attaching a copy of the Mortgage Deed and the title company supplemental we
received at closing. Liberty bank as of this date has not received the formal title

with caty policy regazding firc protection system assessments.

construction of this improvemrnt is $47,825.21 to be fuily repaid at the current
years prevailing interest rate (simple interest) over 20 years, and that such
payments would be collected as an assessment against the subject property.

the Saint Paul City Charter, Minnesota Siatutcs Chapter 429, or auy other statutes,
constitutions, laws of judicial decisions of the State of Mimzcsota or the YJnited

Dear Mr. White:
This letter will serve as a formal request to begin the assessment process to install a
sprinkler system at 867 Pierce Butler R., St. Paul, MN.
I understand that that the Frogtown Action Alliance is responsible for the installation of
the sprinkler system and will be responsible for presenting invoices and mechanics lien
waivers for payment of the same.
It is also my understanding that, in the event this project is abandoned by the Frogtown
Action Alliance that they reimburse all costs incurred by the city relating to this
assessment. In addition, the Frogtown Action Alliance hereby waives their rights to a
pubiic hearing and their rights to an appeal of this assessment.

The Frogtown Action Alliance has submitted plans to be approved by the Department of
Fire and Safety Services, and Housing and Building Code Enforcement. Attached is a
copy of a title insurance commitment, which shows that the Frogtown Action Alliance is
the record owner of the above property.
I am attaching a copy of the Mortgage Deed and the title company supplemental we
received at closing. Liberty bank as of this date has not received the formal title
document but if you have any questions regarding ownership please call Jim Gessert,

1. The Fro� own Acrion Alliance is fee owncr (hereinafter referrcd to as "owner") of
property at 867 Pierce Butler Rt., St. Paul, Minnesota legally described on
attached bxhibit A(hereinafter referred to as the "Subject Property")
2_ Owner entcrs into this �areement and waiver on behalf of himself, his succcssors
and assiens.
3, Owner is developing the subject properiy for commercial use.
4. As a part of this project, owner has petitioned the City of Saint Paul to assess the
cost5 of constructing, reconstructing, alterin�, extending and promoting a fixe
protection system for the building located on the subject property in accordance
with caty policy regazding firc protection system assessments.
5. Ownen c�rcby Waives any and all rights he may have to a public hcaring
concenung the proposed improveinents and assessment.
6. Owncr has been informed that the estimated assessment amount Cor che
construction of this improvemrnt is $47,825.21 to be fuily repaid at the current
years prevailing interest rate (simple interest) over 20 years, and that such
payments would be collected as an assessment against the subject property.

lf the assessment amount actually levied against tYie subject property is equal to or
less than the estimated asscssment amount, owner hereby waives any right he may
have to contest the validity of or appeal from the speciai assessments plus intcrest
including any proccdw'al or substantive rights pursuant fo Chapter 13 and 14 of
the Saint Paul City Charter, Minnesota Siatutcs Chapter 429, or auy other statutes,
constitutions, laws of judicial decisions of the State of Mimzcsota or the YJnited
States.
If such improvements are approved and constructed, owner agrees on behalf of
himself, his successors or assigns thst such public improvements would be o£
special benefit to the subject property in at least the amount of the estimated
assessment plus interest charges set forth in pazagraph six.
Owner agrccs to be responsible for the payment of the difference bctween the
approved esumatcd construcuon costs and the actual construction costs, �n the
event of actual eonstruction cost, exceed the approved esumated cost.
