An Ordinance re-establishing Chapter
166 of the St. Paul Legislative Code per-
taining to a residential permit parking
program in two residential areas in the
City of Saint Paul
TFiE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIPJ:
Section l. Declaration of Purpose.
The Council of the City of Saint Paul finds that the residential
area adjacent to or near the University of Minnesota, Saint Paul Campus
does not have sufficient off-street parking to safely accommodate the
residential parking needs of the residents, and the parking needs of
non-residents using this institution. The Council further finds the
freque nt parking of vehicles in this residential area by these non-
residential users has created residential problems of a safety, en-
vironmental anc� aesthetic nature.
Therefore to encourage reliance on car pools and mass transit, which
is achieved by assuring convenient parking to residents who leavE their
cars at home during the day, to enhance the quality of life in residential
areas by reducing noise, traffic hazards and litter, to reduce air
pollution and other environmental factors of excessive automobile
commuting, and to preserve the safety of children and other pedestrians,
and the residential area from the above mentioned health and safety
hazards, the Council of the City of Saint Paul hereby establishes this
Residential Permit Parking Ordinance.
Section 2. Restricted residential permit parkina, areas authorized.
The following parking regulations shall be in effect in the
resic�ential area in and around the University of Minnesota, Saint Paul
Campus :

Section 3 . Parking permits; eligibility; issuance.

(1) � application for one or more parking permits authorized
under this ordinance shall be made on a form provided by
the director of the department of public works, herein-
after referred to as "director," which form may require
the applicant to furnish his or her name and address,
make, model, and license number of his or her vehicles, and
any additional information which will aid the director in
the enforcement of the provisions contained in this ordinance.

(2) A non-refundable�permit application fee of ��6- for each
residential parking permit shall be required to cover costs
incurred as a result of the implementation of the resi-
dential permit parking plan.

(3a An unlimited number of residential parking permits shall
be made available to the resident of said residence or
dwelling unit on the basis of one permit for each
vehicle owned by the resident. In no way shall the
number of permits exceed the number of vehicles owned
by the resident.
(4) Unlimited transferable visitor permits, at a non-refund-
� � o � abl co t of per permit, shall be made available to
each�res dence or dwelling unit, notwithstanding whether
or not the resident of the residence or dwelling unit
owns an automobile. Provided that no resident of a
residence or dwelling unit may use a visitor permit to
park a car owned or controlled by him or her in the
restricted area, it being the intent of this ordinance
that such visitor permits shall be made available and
used by people not residing in but visiting a resident
of the restricted area.

(5) Residents within the restricted area, at a cost of -5$ l. eo
s�s for each permit, may acquixe from the director
non-transferable and dated special event permits which
shall state the expiration date of said permits. The
director shall determine the number of special event
permits to be issued and the hours in effect, upon his
determination that the issuance of same would not unduly
impair traffic safety or create serious problems during
the use of such special permits .

(6) Churches within the restricted area, at a cost of =_�-_==L�
for each permit, may acquire from the director trans-
ferable special event permits provided that such permits
shall be used only in conjunction with events sponsored
by the applicant church. The director shall determine the
number of and effective period of the permits to be issued.
Such permits shall not be required, upon advance notice
to the police department, for extraordinary church events
such as funerals, memorial services, festivals or bazaars,
or weddings, where issuance of such permits would be im-
practical.
(,7) Residential parking permit stickers shall be placed in
the lower rear corner of the left side window closest to
the rear of the vehicle. Visitor and special event permit
tickets shall be placed over the post holding the rear view
mirror to the windshield or some other conspicuous spot on
the front of the vehicle where they are visible to the
enforcement personnel.

(8) No permit issued under this ordinance shall guarantee
or reserve to the holder a particular parking space
within the restricted area but shall provide general
parking in said area during the time specified by this
ordinance and so posted as required by Section 166. 07.
(9) In the event any of the permits issued under this ordinance
is lost, duplicates shall be obtained from the director
at a cost of $1. 00 per permit, provided that no such
duplicate shall be issued unless and until the applicant
has furnished to the director a written statement that
he or she has lost the original permit. No person shall
apply for a dup�1 cate permi t unl ess the ori gi nal permi t
has in fact been lost.
Section 4. Services, repair, and emergericy assistance.
Individuals who perform or vehicles used in the performance
of commercial services, repairs, or emergency assistance for
any resident living in the residential area are exempt from
restrictions imposed by this ordinance, provided that such
persons are then performing or the vehicles in fact are then
being used in such services or assistance, and provided,
further, the exemption granted hereunder shall terminate
immediately upon completion of the necessary services or
assistance.
Section 5. Street maintenance; snow emergency. No exemptions
or other permits granted herein sha11 abrogate the scope of
parking restrictions imposed as such restrictions relate to
street maintenance, parking in one location beyond 24 hours, or
emergencies provided in Chapter 161.
Section 6 . Handicapped parking. Nothing herein provided shall
abrogate the scope of parking privileges granted handicapped
persons as established pursuant to this code or statutes enacted
by this state.
Section 7 . Posting of signs . The director shall cause appropriate
signs to be posted in the restricted areas so as to inform an
ordinarily observant person of the existence of rules and regu-
lations imposed by this ordinance.
Section 8 . Penalty. It shall be unlawful for any person to
submit false information in any application for a parking
permit issued pursuant to this ordinance. Violation of any
application requirement shall be grounds for denial or revoca-
tion of the permit and shall be punishable as a misdemeanor.

It shall also be unlawful for any vehicle to be stopped,
parked or abandoned in violation of any provision of this
ordinance. Any such violation is hereby declared an
obstruction of public streets and shall be punishable as
a misdemeanor and rray subject the vehicle to be moved or
impounded at the cost and expense of the owner in accordance
with the terms of Chapter 162.
Section 9 . Effective date. The provisions of sections 1
through 8 shall take effect and be in force thirty (30) days
after its approval, passage and publication.
Section 10 , (reserved) .
Section 11. Declaration of purpose. The Council of the City of
Saint Paul finds that the residential area adjacent to or near
the William Mitchell College of Law does not have sufficient
off-street parking to safely accommodate the residential park-
ing needs. of the residents, and the parking needs of non-
residents using this institution. The Council further finds
the frequent parking of vehicles in this residential area by
these non-residential users has created residential problems of
a safety,environmental and aesthetic nature.
Therefore to encourage reliance on car pools and mass transit,
which is achieved by assuring convenient parking to residents
who leave their cars at home during the day, to enhance the
quality of life in residential areas by reducing noise, traffic
hazards and litter, to reduce air pollution and other environ-

Section 12. Restricted residential permit parking areas authorized.
The following parking regulations shall be in effect in the
residential area in and around the William Mitchell College of
Law.
William Mitchell College of Law
(1) Except by permit or unless otherwise posted, no parking
from 2: 00 p.m. to 8: 00 p.m, on the north side of Portland
Avenue between Victoria Street and Milton Street.
(2) Except by permit or unless otherwise posted, one hour park-
ing weekdays from 2: 00 p.m. to 8: 30 p.m. on the following
streets :

North side of Portland Avenue between Victoria Street
and Avon Street.
Both sides of Portland Avenue between Milton Street
and Chatsworth Street.
South side of Holly Avenue between Victoria Street and
Avon Street.
West side of Milton Avenue from Portland Avenue south
to the alley.
(3) If, during the effective period of this non-resident
parking ordinance, demand shifts to streets outside
of the established permit parking areas thereby creat-
ing additional and substantial health and safety
problems in said non-permit parking areas, the director
of public works, hereinafter referred to as "director,"
may establish one hour parking except by permit or
unless otherwise posted, from 2: 00 p.m, to 8: 30 p.m.
on the following streets, when non-resident parking
exceeds 51� of the available on-street parking curb
space:
Both sides of Ashland Avenue from Victoria Street to
Chatsworth Street.
Both sides of Milton Street from Portland Avenue to
Ashland Avenue.
Both sides of Portland Avenue from Chatsworth Street
to Oxford Street.
North side of Ashland Avenue from Victoria Street to
Avon Street.
Section 13. Parking permits; eligibility;issuance.

vided that no resident of a residence or dwellinc�

being the intent of this ordinance that such visitor
permits shall be made available and used by people
not residing in but visiting a resident of the re-
stricted area.

50 cents for each permit, may acquire from the director
non-transferable and dated special event permits which
shall state the expiration date of said permits. The
director shall determine the number of special event
permits to be issued and the hours in effect upon his
determination that the issuance of same would not duly
impair traffic safety or create serious problems dur-
ing the use of such special permits.

Dear Council Members:
I am returning without signature ordinance �17033 , Council
- File #280414, which was adopted by the Council on June 23 ,
1983 . The ordinance , which establishes a restricted resi-
dentail permit parking area in the vicinity of the St . Paul
Campus of the University of Minnesota, was adopted without
provision for annual renewal of residential parking permits .
From conversations with members of the City Development
Committee , I understand that that was an oversight and that
the Council intended to grant to the Department of Public
Works the authority to set expiration dates for such permits
and require their annual renewal. The purposes for these
provisions are two: First, to provide greater administrative
control over the permits themselves, and secondly to provide
for annual funding of the administration of the program.
I believe the residential permit parking program concept to
be a good one, and ask that you act expeditiously to make
this minor technical adjustment.

Avenue from Cleveland Avenue west to the alley.
Section 3. Parking permits; eligibility; issuance.
(1) An application for one or more parking permits authorized
under this ordinance shall be made on a form provided by
the director of the department of public works, herein-
after referred to as "director," which form may require
the applicant to furnish his or her name and address,
make, model, and license number of his or her vehicles, and
any additional information which will aid the director in
the enforcement of the provisions contained in this ordinance.

(2) A non-refundable permit application fee of �9 for each
residential parking permit shall be required to cover costs
incurred as a result of the implementation of the resi-
dential permit parking plan.

(3) An unlimited number, of residential parking permits shall
be made available to the resident of said residence or
dwelling unit on the basis of one permit for each
vehicle owned by the resident. In no way shall the
number of permits exceed the number of vehicles owned
by the resident.
(4) Unlimited transferable visitor permits, at a non-refund-
��p�d° able cost of $dc. per permit, shall be made available to
each residence or dwelling unit, notwithstanding whether
or not the resident of the residence or dwelling unit
owns an automobile. Provided that no resident of a
residence or dwelling unit may use a visitor permit to
park a car owned or controlled by him or her in the
restricted area, it being the intent of this ordinance
� that such visitor permits shall be made available and
used by people not residing in but visiting a resident
of the restricted area.
(5) Residents within the restricted area, at a cost of .�$ � � .00
cents for each permit, may acquire from the director
non-transferable and dated special event permits which
sha11 state the e�iration date of said permits. The
director shall determine the number of special event
permits to be issued and the hours in effect, upon his
determination that the issuance of same would not unduly
impair traffic safety or create serious problems during
the use of such special permits . _
(.6) Churches within the restricted area, at a cost of 50 cents
for each permit, may acquire from the director trans-
ferable special event permits provided that such permits
shall be used only in conjunction with events sponsored
by the applicant church. The director shall determine the
number of and effective period of the permits to be issued.
Such permits shall not be required, upon advance notice
� to the police department, for extraordinary church events
such as funerals, memorial services, festivals or bazaars,
or weddings, where issuance of such permits would be im-
practical.
(_7) Residential parking permit stickers shall be placed in
the lower rear corner of the left side window closest to
the rear of the vehicle. Visitor and special event permit
tickets shall be placed over the post holding the rear view
mirror to the windshield or some other conspicuous spot on
the front of the vehicle where they are visible to the
enforcement personnel.

(8) No permit issued under this ordinance shall guarantee
or reserve to the holder a particular parking space
within the restricted area but shall provide general
parking in said area during the time specified by this
ordinance and so posted as required by Section 166. 07.
(9) In the event any of the permits issued under this ordinance
is lost, duplicates shall be obtained from the director
at a cost of $1. 00 per permit, provided that no such
duplicate shall be issued unless and until the applicant
has furnished to the director a written statement that
he or she has lost the original permit. No person shall
apply for a duplf cate permi t unless the ori gi nal permi t
has in fact been lost.
Section 4 . Services, repair, and emergericy assistance.
. Individuals who perform or vehicles used in the performance
of commercial services, repairs, or emergency assistance for
any resident living in the residential area are exempt from
restrictions imposed by this ordinance, provided that such
persons are then performing or the vehicles in fact are then
being used in such services or assistance, and provided,
further, the exemption granted hereunder shall terminate
immediately upon completion of the necessary services or
assistance. '
Section 5. Street maintenance; snow emergency. No exemptions
or other permits granted herein shall abrogate the scope of
parking restrictions imposed as such restrictions relate to
street maintenance, parking in one location beyond 24 hours, or
emergencies provided in Chapter 161.
Section 6. Handicapped parking. Nothing herein provided shall
abrogate the scope of parking privileges granted handicapped
persons as established pursuant to this code or statutes enacted
by this state.
Section 7. Posting of signs . The director shall cause appropriate
signs to be posted in the restricted areas so as to inform an
ordinarily observant person of the existence of rules and regu-
lations imposed by this ordinance.
Section 8 . Penalty. It shall be unlawful for any person to
submit false information in any application for a parking
permit issued pursuant to this ordinance. Violation of any
application requirement shall be grounds for denial or revoca-
tion of the permit and shall be punishable as a misdemeanor.

It shall also be unlawful for any vehicle to be stopped,
parked or abandoned in violation of any provision of this
ordinance. Any such violation is hereby declared an
obstruction of public streets and shall be punishable as
a misdemeanor and nay subject the vehicle to be moved or
impounded at the cost and expense of the owner in accordance
with the terms of Chapter 162.
Section 9 . Effective date. The provisions of sections 1
through 8 shall take effect and be in force thirty (30) days
after its approval, passage and publication.
Section 10. (.reserved) .
Section 11. Declaration of purpose._ The Council of the City of
Saint Paul finds that the residential area adjacent to or near
the �lilliam Mitchell College of Law does not have sufficient
off-street parking to safely accommodate the residential park-
ing needs of the residents, and the parking needs of non-
residents using this institution. The Council further finds
the frequent parking of vehicles in this residential area by
these non-residential users has created residential problems of
a safety,environmental and aesthetic nature.
Therefore to encourage reliance on car pools and mass transit,
which is achieved by assuring convenient parking to residents
who leave their cars at home during the day, to enhance the
quality of life in residential areas by reducing noise, traffic
hazards and litter, to reduce air pollution and other environ-
mental factors of excessive automobile commuting, and to pre-
serve the safety of children and other pedestrians, and the
residential area from the above mentioned health and safety
hazards, the Council of the City of Saint Paul hereby establishes
this Residential Permit Parking Ordinance.
Section 12. Restricted residential permit parking areas authorized.
� The following parking regulations shall be in effect in the
residential area in and around the William Mitchell College of
Law.
William Mitchell College of Law
• (1) Except by permit or unless otherwise posted, no parking
from 2: 00 p.m. to 8: 00 p.m. on the north side of Portland
Avenue between Victoria Street and Milton Street.
(2) Except by permit or unless otherwise posted, one hour park-
ing weekdays from 2: 00 p.m. to 8: 30 p.m. on the following
streets:

North side of Portland Avenue between Victoria Street
and Avon Street.
Both sides of Portland Avenue between Milton Street
and Chatsworth Street.
South side of Holly Avenue between Victoria Street and
Avon Street.
West side of Milton Avenue from Portland Avenue south
to the alley.
(3) If, during the effective period of this non-resident
parking ordinance, demand shifts to streets outside
of the established permit parking areas thereby creat-
ing additional and substantial health and safety
problems in said non-permit parking areas, the director
of public works, hereinafter referred to as "director,"
may establish one hour parking except by permit or
unless otherwise posted, from 2: 00 p.m, to 8: 30 p.m.
on the following streets, when non-resident parking
exceeds 51� of the available on-street parking curb
space:
Both sides of Ashland Avenue from Victoria Street to
Chatsworth Street.
Both sides of Milton Street from Portland Avenue to
Ashland Avenue.
Both sides of Portland Avenue from Chatsworth Street
to Oxford Street.
North side of Ashland Avenue from Victoria Street to
Avon Street.

(4) A maximum of two transferable visitor permits at a

available to each residence or dwelling unit, not-
withstanding whether or not the resident of the
residence or dwelling unit owns an automobile. Pro-
vided that no resident of a residence or dwelling
unit may use a visitor permit to park a car owned or
controlled by him or her in the restricted area, it
being the intent of this ordinance that such visitor
permits shall be made available and used by people
not residing in but visiting a resident of the re-
stricted area.
(5) Residents within the restricted area, at a cost of
50 cents far each permit, may acquire from the director
non-transferable and dated special event permits which
shall state the expiration date of said permits. The
director shall determine the number of special event
permits to be issued and the hours in effect upon his
determination that the issuance of same would not duly
impair traffic safety or create serious problems dur-
ing the use of such special permits.
(6) Churches within the restricted area, at a cost of �8' � 1 •��'
cents for each permit, may acquire from the director
transferable special event permits provided that such
� permits shall be used only in conjunction with events
sponsored by the applicant church. The director shall
determine the number of and effective period of the
permits to be issued. Such permits shall not be re-
quired, upon advance notice to the police department,
for extraordinary church events such as funerals,
memorial services, festivals or bazaars, or weddings,
where issuance of such permits would be impractical.
(7) Residential parking permit stickers shall be placed in
the lower rear corner of the left side window closest
to the rear of the vehicle. Visitor and special event
