WHEREAS, Sherman Investment Corporation, has requested permission to construct
the sidewalk adjacent 975 Grand Avenue, in a manner in conflict with the City
of Saint Paul , Minnesota, Department of Public Works, Standard Detail Plates,
specifically by installing a Bomonite surfacing; now therefore be it
RESOLVED, that pursuant to the provisions of Chapter 121 and 123 of the Saint
Paul Legislative Code, the Director of Public Works is hereby authorized to
issue to Sherman Investment Corporation a permit to construct sidewalk within
Grand Avenue and Chatsworth Street rights-of-way, ad,jacent Lots 15 and 16,
except the North 40 feet thereof, Blk. 27 Surr�nit Park Addition, using a
Bomonite surfacing; and be it
FURTHER RESOLVED, that the above permission is granted and made expressly subject
to the following terms, provisions and conditions:
1 . That said permittee and/or its successors in interest shall , at its own
cost and expense, and in accordance with all applicable ordinances of
the City of Saint Paul construct, operate, and maintain said sidewalk
to include repair, replacement or reconstruction where necessary to
protect the public safety;
2. That said sidewalk construction and installation shatl be in strict
conformance with plans approved by the Department of Public Works;

3. That said permittee shall pay Public Works' costs of inspection of
said work and the cost of publication of this resolution;
4. That said sidewalk shall be removed by and at the sole cost of said
permittee and/or its successors in interest, wMenever the Council of
the City of Saint Paul shall by resolution determine such removal
necessary in the public interest and accordingly order its removal ;
5. That said permittee and/or its successors in interest expressly agrees
and undertakes to fully indemnify, hold harmless and defend the City
of Saint Paul , its agents, officers and employees from any and all
damages, claims, losses, judgments, suits or expenses arising out of
or connected with the construction, repair, reconstruction, maintenance
or operation of the Bomonite sidewalk;
6. That said permittee shall within thirty (30) days after the effective
date of this resolution file with the City Clerk its written acceptance
of the terms, provisions, and conditions of this resolution.

Resolution would permit Sherman Investment Corporation to construct Bombnite surfaced
sidewalks in the public right of way adjacent its new building on the northeast corner
of Grand Avenue and Chatsworth Street. Bomonite is a concret� product which in this
installation will look like brick.
