Return to 647 �ouncil Resolution WAB Qresented By Referred To Committee: Date Out of Committee By Date RESOLVED, That upon the petition of the City of Saint Paul, the public property hereinafter described, be and the same hereby is vacated and discontinued as public property: The north twenty-six (26) feet of Lots 17, 18 and 19, except the east ten (10) feet of the north twenty-six (26) feet of Lot 19, all in West Side Land and Cottage Co' s Subdivisiori of block 36 of Brown and Jackson' s Addition to West St. Paul; subject expressly to the following conditions and reservations: 1. That the vacation be subject to all the terms and conditions of Chapter 130, codified March l, 1981, of the St. Pa�l. Legislative Code, as amended, and shall include the City' s right to removal of all slope easements and lateral support easements in said vacation. " 2. That the petitioner being the City of Saint Pau 1, shall not be required to pay compensation or post a bond, in so far as the purpose of the vacation is to clear title to the affected lots. 3 . That upon acceptance and compliance with the terms of this vacation the proper City officials are hereby authorized to convey said property to abutting prop- erty owners by quit claim deed. William Donova.n Valua.tion and Assessment Engineer Date: March 31, 1983 Subject: Petition of the City of Saint Paul for the vacation of North 26 feet of Lots 17, 18 and 19, except the East 10 feet of North 26 feet of Lot 19, all in West Side Land and Cotta.ge Co's Subdivision of Block 36, of Brchrn and Jackson's Addition to West St. Paul (located in block bounded by Ba.ker Street, Brawn Avenue, Morton Street, and Woodbury Street) Public Heax ing - April 26, 1983 The purpose of this vacation is to clear the titles to the abutting proper- ties by removing an appa,rent oversi�ht created in 1959 when the City sold the Hendrick's School Site. This alley was ori�inally condemned by the City in 1881, apparently to provide access to the rear of the Hendrick's School. A need no longer exists for this alley given the redeveloped school pa.rcel and the existence of a 20 foot alley serving the block. There were no objections raised in m�y letter to the various city utilities dated March �+, 1983. In view of the foregoing, I recommend tha.t the va.cation be approved, subject to the follciwing terms and conditions: l.
