2 WHEREAS, the Saint Paul City Council, in Councii File 99-649, directed the Department
3 of Plauniug and Economic Development to undertake a study of the City's zoning regulations
4 relating to trucking uses. The Saint Paul Pianning Coxnmission was to study these matters and
5 submit a report and recommendations to the Council; and

WIIBREAS, during the pendency of the Planning Comxnission's study, the City Council,
in Council File No. 99-1063 imposed an interim ordinance prohibiting the establishment of any
so called trucking facilities until any recommendation to amend the City's regulation of such
facilities could be adopted; and
WHEREAS, it was the intent of the Council that the amended regulations, if any, were to
be adopted by March 1, 2000 and that the interim ardinance in Council File No. 99-1063
contained a March 1, 2000 expiration date; and
WIIEREAS, the Planing Coxnxnission completed its study and reported its
recommendations to the Council and the City Council, based upon the Plamiing Commission
recommendations and pursuant to the provisions of Saint Paul City Charter § 6.05, introduced in
Council File No. 00-130, an ordinance amending Saint Paul Legisla6ve Code §§ 60.212.L,
60.216.P, 60.220.T, 60.562, 60.612, 60.614, 60.624; and
VJHEREAS, pursuant to the provisions of Saint Paul City Charter § 6.05, Council File
No. 00-130 appears on the Mazch 1, 2000 agenda of the City Council for final adoption; and
WHEREAS, under the provisions of Saint Paul City Charter § 6.11 the regulations
amending the Legisiative Code provisions noted above wili not take effect until thirty (30) days
after the passage, approval and publication of Council File No. 00-130; and
WIIEREAS, the City Council continues to desire that the City's planning process be
protected until the City's new zoning regulations for trucking facilities, as contained in Council
File No. 00-130, sha11 become effective; NOW, THEREFORE, BE IT
RESOLVED, that the interim regulation of new trucking £acilities, as set forth in Council
File No. 99-1063, are hereby continued until such time as the new regulafions, adopted in
Council File No. 00-130, shall have become effective as set forth in Saint Paul City Charter §
6.11; AND, BE IT,

2 FURTI�R RESOLVED, that the Council of the City of Saint Paul, in order to protect the
3 integrity of the City's plamiing process and for the health, welfare and safety of the public, will
4 amend under separate ordinance, Council File No. 99-1063 for the limited purpose of continuing
5 the interim ordinance provisions contained therein by providing that such provisions shall expire
6 as of the date the new regulations adopted in Council File No. 00-130 become effective which is
7 thirry days after its passage, approval and pubiicarion.
