SUBJECT : Request variance of Section 35 . 03, pertaining to stainaell
. encTosures , to permit continued occupancy of buildin g, because appellant
contends it is "two-story wi.th garden level anits" and, in addition�, stair
enclosure would isolate two units on each of the floors above the garden
level . (Buildin gs are identical , so appeal is the. s ame in both cases . )
APPEARANCE : Michael A. Kam�meyer �
-.' PROCEEDINGS : �Mr. Kampmeyer spoke of his concern that' tiao small units on
eac loor would become isolated if stairivell enclosures were installed
in the manner required by the housing code . He mentioned that enclosures
would make it difficult for some tenants to hear the smoke alarm system
in the event of an emergency. Some of the affected tenants were worried
also about their safety from intruders or burglars because of isolation
from tfieir ne��hbors . Many residents were elderly persons who watch out
for one another and who socialize with their fellow residents , but parti-
tions would create a barrier. He cited the difficulty of regulating the
heat if each hallway were to be separated� into three sections . He pointed�
out that the basement windows were situated in such r�anner as to make them
easily accessible in an emergency.
Lisa Greene , a resident of one of the buildings , related her concexns over
stairiaell enclosures , reiterating several of the con cerns of Mr. Kampmeyer,
but adding that rents would have to be raised if the oi�ner i�ras forced to
this expense . � .
Alvera Gustafson , resident at 425 N. Roy , voiced similar objections . She
felt that units located within the stairwell-enclosed areas wouid be more
exposed to fire and smoke than at present.
Alice Bijjani said the buildings lJere well-maintained, but this fact did
not diminish the need for stairiJell enclosures . She conceded that it was
impossible to provide perfect fire p rotection in older buildings tiahere the
floor plan made it very difficulti in some cases . Ta provide better vzsi-
bility , she suggested the use of wire glass in the hallway nartitions .

the city' s life safety code . She thou�ht the board would nrobably not
have jurisdiction in cases involved with orders issued under the state code .
= Dick Cortright , who identified himself as a pronerty manager, stated that a
fire inspector had that morning issued orders for stair enclosures in a
building he managed. The fir.e inspector hacl advised him that if he �Jished
to appeal the order, bir. Cortright should "talk to the people in Citiy Hall" ,
zvhich he understood to mean the Board of Appeals . '

PROCF.EnINGS : Wil liam Folwick explained �hat each unit has two entrance
doors , each door having a deadbolt lock. The front door for each unit- has
a� deadbolt lock with key and the entire building is master-keyed. The
"back" door to each un.it has a deadbolt lock that can be locked only from
the inside . Back doors are never used for initial entry. He asked that
the existing system be allotiJed to remain , because chanbing it would be
a duplication and very expensive , as we11 .
I�is . Bi j j ani stated that the code specifies that deadbolt locks be openable
from the outside with a key and fror� the inside t�rithout a key. But she
felt that the circumstances in this case tvere in keeninb 1J1tI1 the spirit
of the la�� if not the letter. regarding the front doors . She asked if the
. residents kept the rear doors accessible .
1�7r. Foltiaick replied that occasionally a resident will place an appliance
or other obstruction there .
Ch airman Glassman pointed out that , even if this hap�ens ; there is still
a front door with a proper deadbolt lr�ck ti�hich he felt t�Tas sufficient.
BOARD ACTI0�1: Mrs . Bostrom moved that a variance on Section 34 . 09 be
grante � permitting the existing deadbolt locks to remain on the rear �
doors . Mrs . Collins seconded. MOTIOV CARRIED.

just be something to stumble over and the sZight deficiency of 12 inches
was not significant .

in boiler area, Section 34. 18 , pertaining to fusing in bra�ich circuits ,
Section 34 . �.2 , pertaining to bond across ivater meter and grounding of
light fixture in bathroom, and Section 34 . 13, uertaining to escape ��indo�s
in basement unit (appellant feels it meets code specifications) . Also ,
rec�uest variance on Item �12 in city's letter of 2/1/83, pertaining to
connector on gas shutoff valve.
APPEARA�CE : Dr. Datirid Parupsky
PROCEEDINGS : Dr. Parupsky said the city has told him that the �roperty
is being operated illegally as three units . He has considered discontin-
uing use of the basement as a separate unit, but the occupant has a lease
th rough the end of this year and �Jants to stay. If reQuired to do al�
the work ordere�i, it would be f'inancially unfeasible . The specific items
he is appealing concern : (1) Deadbolt locks--he feels they are unnec�u�ssary
but would put them in if he had to, (2) One hour fire sep aration in
- the boiler area--entails fire doors , electric smoke alarm, and extensive
s.heetrocking, none of which would be renuired if he discontinued use of .
the basement unit , as he understood it , (3) Basement escape window--he
feels the existing window is within code specifica�ions .
I��s . Bijjani said there is no standard firewall betiaeen the heating plant
and the basement unit . In addition , the heating plant itself needs to
_ be fire-separated. As for the escape tivindow, the opening appears to be
of adec{uate size , but the �vindowwell is too narrota and shoul.d be enlarged.
A swina-out windoiv should replace the existing toindol�. She said these
items would not need to be considered if use of the basement unit was
discontinued as living space.
Chairman Glassman advised Dr.. Parupsky to take time to consider w�iether
substantial in.itial expense would be worthiahile �in the long �un to allow
the continued renting of the basement unit .
BOARD ACTION : Mr. Knutson moved to grant a variance on Section 13.06 ,
pertaining to fire senaration of the b asement unit and the boiler area,
and Section 34. 13, pertaining to escape ivindow rec�uirements , to permit
continued occuDancy of the basement unit until the exniratiorz of the
current tenant's lease on December 31, 1983. A1rs . Collins seconded. �
MOTION CARRIED.

hir. Knutson called attention to the overfusing of the electrical system.
He advised Dr. Parunsky to have an electrician correct the nroblem an d
take care of the bond across the �Jater meter and grounding of the light
fixture . Dr. Parupsky agreed to the sug�estion. He also said he �lould
have the required deadbolt locks installed and replace the connectai- on
the gas shutoff �lalve with the required type .

beginning at a point on the east property line of Earl Street,
251 feet south of the centerline of York Street, thence westerly
on a line paxallel to the centerline of York Street to a point
52 feet west of the east property line of Eaxl Street; thence
61 feet southerly on a line parallel to Eaxl Street; thence
easterly 15.4 feet on a line paxal.lel to York Street; thence
�-�-9+5 feet southerly on a line paxa.11el to Earl Street; thence
