WHEREAS, the Departments of Public Works and Planning and Economic Development have
reviewed the attached lot split on Sims Avenue:
Lot 1 , Block 2, Verplanck's Subdivision and that part of Lot 2, said Block 2,
that lies East of a line drawn from a point on the North line of said Lot 2
that is 10.64 feet West of the Northeast corner of said Lot 2 to a point on
the South line of said Lot 2 that is 10.12 feet West of the Southeast corner
of said Lot 2 and there terminating; and
That part of Lot 2, Block 2, Verplanck 's Subdivision that lies West of a
line drawn from a point on the North line of said Lot 2 that is 10.64 feet
West of the Northeast corner of said Lot 2 to a point on the South line of
said Lot 2 that is 10.12 feet West of the Southeast corner of said Lot 2,
and there terminating, and also that part of Lot 3, said Block 2, that lies
Easterly of the Westerly 8 feet of said Lot 3; and
WHEREAS, the proposed lot split meets four of the requirements of Section 67.304
of the Zoning Code:
1 . The lots have frontage on an existing improved street and access to
� municipal services.

2. The lots to be divided are previously platted land.
3. The division of the lots shall not cause a remaining part of a lot to
become a separately described tract which does not meet the minimum
standards of the zoning district in which it is located or which does
not have street frontage and access to municipal services .
4. The division does not result in a split zoning classification on a
single lot; and

The Saint Paul City Council will conduct a public hearing to consider
the request of Hennen Development Company for lot splits on the south
side of Sims between Hazelwood and Germain on April 7, 1983, at
10:00 a.m. in the City Council Chambers, 3rd floor, City Hall .

Re: Lot Split and Variance for Sims Avenue
Dear Ms. James:
Ericlosed please fir�d the lot survey for the subject lot split. Rather
than supplying drawings, I have su�lied you an actual survey that
` outlines property dimensions, direction, names and locations of
adjacent streets, and the locations of existing buildings within 100
feet. I hope this will suffice, if not, please give me a call.
It should be noted that the current R-4 Residential Zoning requires a
miniturnun square footage of 5,000 per lot. Unfortunately, bath of
these two lots, as currently praposed, contains approximately 4,569
square feet. Therefore, Hennen Development, Inc. is requesting a
variance on this requirement along with the lot split request.
I would li ke to point aut that on numerous occasions, Hennen
Develapment, Iric. has solicitated various offers to purchase the
Westerly 10 feet of Iat 3 fran the seller. It appears that the seller
is unwilling to a�cept any reasonable offer. Conseq�ently, we are
, forced to request a variance in this regard. It is evident fran this
that aur request is nat based on an econanic gain but rather an
� unwillingness of the abutting hcareowner to sell sane of his property.
In n� opinion this variance request will not jeapardize the intent of
the mininaam sguare foot requirement.
Incidentally, we intend tA use aur standard house plan design which
facilitates 40 foot lot widths. The hane is narrow in front (24
feet), thus allaaing adequate room for ca�rpliance with the side yard
se�bac;i� r�qu�rc�r�nts. Se� enclosed house plan.
