WHEREAS, the City Council has been given the responsibility and authority
(under Section 4.07 of the Charter) to conduct investigations into the
conduct of any department, office, or agency; and
Wf�1tEAS, the Council is responsible for final adoption of any rules
pertaining to the Civil Service system (Section 12.06 of the Charter) ; and
WI-�REAS, the Council must approve the appointment of the Director of
Personnel, who is charged with the administration of the personnel system
(Section 12.04.1 of the Charter) ; and
Wf-�RF.AS, the legislative power of the City of Saint Paul is vested in
the Council as an appropriate "check and balance" for the powers of the
executive branch; and
WE�REAS, the acfininistration has conducted an investigation into the
validity and integrity of a specific Civil Service exam; and
WI�REA.S, in the course of that investigation several inappropriate practices
and procedures were discovered within the Personnel Department which cast
doubt on the integrity of the testing system and further information has
become available concerning hiring practices; now, therefore, be it
RESOLVED, that the City Council will irmnediately initiate an investigation
into the affairs, conduct and procedures of the city's Personnel Department
pertaining to the filling of vacancies; and be it further
RESOLVED, that the City Council will retain an independent investigator
to examine the hiring practices and procedures of the city's Personnel
Department to include test security and any violations of Civil Service
rules; and be it further

, the City Cowlcil has been given the responsibility and
authority (tm.d Section 4.07 of the Charter) to conduct investigations into
the conduct of department, office or agency; and
WHEREAS, the Council is responsible for final adoption of any rules
pertaining to the Civ Service system (Section 12.06 of the Charter) ; and
�F.AS, the Coun il must approve the appointment of the Director of
Personnel, who is charged 'th the administration of the personnel system
(Section 12.04.1 of the Char er) ; and
WHEREAS, the legislativ power of the City of Saint Paul is vested in
the Council as an appropriate "c ck and balance" for the powers of the
executive branch; and
WHEREAS, the administration h conducted an investigation into the
validity and integrity of a specific Ci '1 Service exam; and
WEiEREAS, that investigation could t invalidate that specific test,
however, in the course of that investigatio several inappropriate practices
and procedures were discovered within the Per nnel Department, which cast
doubt on the integrity of the testing system;
Now, therefore, be it
RESOLVED, that the City Council will i.mmedia ly initiate an investigation
into the affairs, conduct and procedures of the city' Personnel Department; and
be it
FURTHER RESOLVED, that the City Attorney prepare in-depth report of
the information revealed in the achninistration's initial i estigation, as it
pertains to the Personnel Department; and be it

SUBJECT: Personnel Department Procedures Investigation
The Council of the City of Saint Paul has determined that an investigation
into the procedures of the Personnel Department is warranted and will
proceed under Section 4.07 of the City Charter.
Please furnish the secretary of the Council with the following information: �
1. The names, job classifications and dates of employment of all
Personnel Office employees between January 1, 1970, and the present.
2. The names of personnel directly responsible for the testing process
during the period January 1, 1970, to the present, including test
fonnulators, typists, achninistrators, etc.
3. The names of all personnel responsible for recruitment and training.
4. The names, addresses and places of employment of all people that have
been furnished with copies of Civil Service examinations since
January 1970, including attorneys and clients.
5. The names of all employees having possession of keys to the Personnel
Office.
6. All re_ports, docwnents and papers pertaining to the procedures, rac� tices
and conduct o t� i�sonnel Department, including those compile�in the
Achninistration's recent investigation.

WHEREAS, preliminary reports distributed by the Mayor's Office indicate
probable cause to conduct an audit of testing procedures surrounding recent
Civil Service examinations; and
WHEREAS, questions regarding the Civil Service examination procedures have
been submitted to the Mayor by the City Council ; and
WHEREAS, some questions submitted to the Mayor are of a delicate nature
requiring impartial , professional research; and
WHEREAS, the Mayor has already appointed a Persannel Issues Task Force
to study Civil Service procedures; and
WHEREAS, allegations of improper testing procedures surrounding Civil
Service examinations exist as a matter separate from those issues being
investigated by the Mayor's Personnel Issues Task Force; and
4;HEREAS, it would be in the best interest of the City of Saint Paul and
its residents to have an investigation into allegations surrounding recent
examinations; and
WHEREAS, such an investigation should be kept independent of the City's
governing body so as to avoid political pressures; and
