WHEREAS, Pursuant to Minnesota Statutes, � 462.357 and � 64.210 of the Legislative Code, G. Heileman Brewing Co. , Inc. duly petitioned to rezone Lots 18 through 25, Block l, Stinson and Ramsey' s Subdivision located on the west side of Erie between Jefferson and James from RT-1 to I-2 for the purpose of constructing a holding tank adjacent to the existing brewery, the petition having been certified by the Department of Finance and Management Services on February 3, 1983 as having been consented to by at least 67� of the owners of the area of the property to be rezoned, and further, having been consented to by at least two-third of the owners of the property situated within 100 feet of the total contiguous descriptions of real estate held by the same owner of any party purchasing any such contiguous property within one year preceding the date of the petition; and . Dear Sir: On February 17, 1983, the Zoning Committee of the Planninq Commission held a public hearing on this rezoning. The rezoninq proposal contains two parcels. Parcel A consists of 4 lots fronting on Toronto and Webster between W. 7th and Jefferson. It is just south of an existing Heileman warehouse. Parcel B is on the west side of Erie Street between Jefferson and James. The staff presented a report recommendinq approval of the rezoning of Parcel B to I-2. Staff recommended that Parcel A be rezoned to I-1 rather than I-2. At the hearing, no one appeared in opposition to the rezoning on Erie Street. Some opposition and concern was expressed regarding the warehouse expansion on Toronto and Webster, as reflected in the enclosed minutes. At the close of the public hearing, the Committee voted 6 to 0 to recommend approval of the rezoninq to I-2 of Parcel B and approval of the rezoning of Parcel A to I-l . Petitioner received a building permit for the addition on Erie Street on November 17 , 1982. 3. The intent of the I-2 Industrial District is to provide land for "manufacturing, assembling and fabrication activities , includinq large scale or specialized industrial operations whose external effects will be felt in surrounding districts". 4. Breweries are first perrnitted in the I-2 district. Other permitted uses are: sea�age treat��ent plants , asphalt or aspFialt products , explosives , fertilizers , natural or synthetic rubber, ar�d sawmills . 5. The intent of the I-1 district is to provide lar.d for "wnol�sale ana warehouse activities and industrial operations w��ose external ph,ysica� effects in no manner affect the surroundiny districts in a detrimental way". _2_ 6. Both parcels have residentially-zoned land both adjacent to and abutting across streets . 7. The District 9 General District Plan recommends : a) industrial uses should be restricted to existing zoned sites (p.5) ; b) residential areas should be pro�ected from encroachment by incompatible industrial uses and buffers developed where problems exist (p.5) ; and c) exterior improvements and general maintenance around brewery buildings(p.14) . 8. The West Seventh Redevelopment Plan calls for two-family and rowhouse redevelopment for parcel a , and heavy industrial for parcel b. 9. The Economic Development Str tegy component of the Comprehensive Plan recommends increasing the supply of available industrial land through review of the zoning ordinance and assisting 1•ocal firms in assembling properties adjacent to their existing facilities when this does not conflict with other planning considerations (p.13) . 10. The Land Use Plan component of the Comprehensive Plan recommends buffering incompatible land uses (Policies 1 .4-3 and 4.3-10) . 11 . The Land Use Plan also encourages labor intensive industries in St. Paul (Policy 4.3-5) .Labor extensive industrial activities are to be supported only when they are necessary adjuncts to intensive industries (Policy 4,3-6) . 12. The Industrial Policy Map in the Land Use Plan recommends labor intensive light industry for the area around the brewery (parcel b) , but no indus- trial uses around the proposed warehouse (parcel a) . H. STAFF ANALYSIS: Parcel a : Rezoning this parcel to I-2 seems clearly inappropriate. The site is too small for many industrial uses , and the I-2 district is intended for uses that have impacts on surrounding uses . Since warehouses are first per- mitted in the I-1 zoning district, rezoning the property to I-1 would be more appropriate. This rezoning would put parcel a in the same district as the property to the north and �increase redevelopment options for the petitioner. Petitioner has stated that I-1 rezoning would be acceptable. None of the plans for this area recommend industrial uses for this site. Therefore, this rezoning would seem to be inconsistent with the Comprehensive Plan. However, the Comprehensive Plan also recommends buffering industrial uses fro m residential uses , Presently, there is no buffering between the existing industrial use and neighboring residential properties. New devel - opment would require setbacks and site plan review, which would offer an op- portunity to establish fence and landscape buffers, Parcel b: Rezoning this property would appear to be consistent with the Comprehensive Plan . The proposed use will be partially underground and will not increase truck traffic on Erie Street. Again, because of the setback and site plan review standards in the zoning code, buffering techniques can be required to provide more separation of industrial and residential uses . I . STAFF RECOMMENDATION: Based on findings 1 , 3 , 4, 10, 11 and the staff analysis, staff recommends denial of the rezoning to I-2 of Lots 23, 24 , 37 and 38, Block 17, Stinson, Brown and Ramsey's Addition, and approval of a rezoning to I-1 . F4s. James showed slides of the site and reviewed the staff report with a recommendation for denial of the I-2 zoning on Parcel A and approval of the I-2 zoning on Parcel B. A letter was received with 29 signatures in opposition. Richard Arts , attorney representing the Heileman Brewing Company, stated that to his knowledge there was no opposition to the rezoning. The whole area is industrial and the rezoning would not substantially change the character of the neighborhood. The parcels in question are contiguous to the existing hrewry properties. Traffic would be dissipated by the creation of new ware- house facilities. There would be no emissions , no pollution, no noise; it would be strictly a warehouse facility at both locations. Mr. Bryan asked if the brewery was aoreeable to the I-1 rezoning instead of I-2 on tract B. Mr. Arts stated they would agree to the I-1 . Ms. James reported that the residents are concerned about blasting for the � foundation of the warehouses which would weaken the foundations of the houses in the neighborhood. Joe !dalia , General Manager of Schmidt Brewery,stated that there would be no blasting ��ne but there would be some noise when digging the trenches for the foundation. Jim Povolny, 601 Palace, expressed concern with the way the rezoning was explained to the residents. Tract B on Erie Street was talked about which is completely rernoved from their properties but never once was the Tract A project mentioned. He indicated that the Brewery has been an excellent neighbor and was not asking that the project be stopped but felt they misrepresented what they intend to do. We believe the addition of any commercial building would have a prohibited effect on the resale of our property and decrease the value of our homes. Due to the fact this area is underlain with shale rock with a top soil of approximately only one to two feet. If building were to take place the houses would be sub�ected to structural damages. Any development in this area that has required blasting has resulted in homes being damagecl.
