certifies and approves the action of the City of Saint Paul Board of
Appeals and Review pertaining to the following listed property and as
shown by the Excerpted Minutes of said Board of Appeals and Review,

PROCEEDINGS : Mr. Hartwig, otivner of basement Unit #S , pronosed to install
an interior stairway outside of the sleepin g rooms leading directly to
the outside in lieu of altering the existing windows in each bedroom
to comply with escape window reQuirements .
Alice Bijjani said �his type of access would not meet code , but was
better than one that required passing through the apartment in order to
reach it .
Mr. Hartwig noted that other violations cited by the inspector concerned
ceiling height and lack of light and ventilation in the kitchen and
living room. The ceiling height was 83z inches , one-half inch short
of code . There was no window in the kitchen , but .there were two 20 sq . ft.
openings , one to the dining room, the other to the living room. � There
was also a deficiency of window area in the living room.
Alice Bij j ani explained that the cade required window area equal to 8 0
of floor area for Zight and 40 of floor area openable window for venti-
lation. The existing window area in the apartment was 7$ of floor area.
BOARD ACTION: Chairman Glassman moved that variances of Section 34. 13
an 34. 14 , pertaining to light and ventilation , be granted, to permit
continued use of Apt . #5 where the kitchen lacked a window and where
there was a deficiency of light and ventilation in the kitchen an d the
living room. Mrs . Bostrom seconded. MOTION CARRIED.
THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0
BOARD ACTION: Mr. Knutson moved that a variance of Section 34 . 13, per-
taining to ceiling height, be granted, to permit continued use of Apt. #S
where ceiling height is 1/2 inch under minimum req_uirements . Mrs . Col-
lins seconded. MOTION CARRIED.
THE VOTE : Ayes - 5 Nays - 0 Abstentions - 0
In further discussion on the relative merits of providing an additional
stairway to the outside of the building in lieu of escape windows within
each sleeping room, Mr. Hartwig pointed out that the proposed stairway
would need to rise only five feet to an existing door that opened
directly outside . There had been such a stairway in the original con-
struction of the building, but at some time in the past when the property
was remodeled, it had been removed. Restoring them would not be a
difficult matter and would be far less expensive th an tearing out thick
cement walls to enlarge the bedroom windows .
BOARD ACTION : Mr. Knutson moved that a variance of Section 34. 13, per-
taining to escape windows in sleeping rooms of b asement occup ancies , be
granted, on condition that a stairway leading directly outside be con-
structed near the sleeping room area of Unit #5 . Mrs . Collins seconded.

PROCEEDINGS : Mrs . Johnson said Apts . #2 and #3 are never rented to
more t an a single person and there has ne�-er been a problem in sharing
use of one b athroom by the two tenants . Apt . #4 has been occupied by
Evelyn Lovaas for 30 years . It has its O�JIl half-bath , but Ms . Lovaas
can use a full bathroom on second floor or a shoiaer facility in the
basement . If the Johnsons had to install a tub or shower wi�thin her
ap artment , they would be compe�led to raise her monthly rent from the
$90 she now pays and this would create a financial hardship for her.
Mrs . Johnson read the contents of a letter ioritten by Ms . Lovaas , in
which she requested the board to permit continued occupancy under the
existing circumstances . She further wrote that she had a very limited
income and finding similar living quarters at this cost would be im-
possible , aside from her feeling about her apartment as a home after
living there for so many years .
Alice Bijjani felt it might be appropriate to permit the situation to
continue for as long as Ms . Lovaas lived there , but require compliance
_ after that time .
BOARD ACTION : Mr. Glassman moved that variances of Section 34. 11 be
grante , permitting the continued occupanc�- of Ants . #Z and �3 on a
permanent basis , on condition that no more than one person occupy� each
of the units , and that continued occupanc�- be permitted in Apt. .#4
where the bathroom lacks bathing facilities as long as tFie present
occupant resides there . Mr. Knutson seconded. D�OTION CARRTED.

than one foot beyond property line when opened, because of practical
considerations .

PROCEEDINGS : Mr. Glassman questioned whether the board had jurisdiction
in t is su ject. He noted that the apnellants also requested a variance
on a matter concerned with access specifications for handicapped persons ,
which was not within the board' s purview, but a problem that should lie
referred to the Mayor' s Advisory Committee on Handicapped People ,

Board Secretary Pat Moxness reported that she had met with Richard Amey
and Don Wagner from the Building Code Enforcement Division and they
jvere of the opinion that the projection of the door over the sidewalk
was a subject that should properly come before the board.
Mr. Moe explained that the owners pronosed to place doors on the corner
exit area of their building which would create a vestibule, making for
better energy conservation . ._ One door would face on Grand and would
swing inward. The other would face on Dale and would swing outward in
order to avoid conflict with the inner entrance door. Swinging outward
would necessarily mean that it would project more than one foot beyond
the p ronerty line , contrary to the building code.
After discussion and a study of a sketch of the proposed construction,
Mr. Knutson asked how far the door would swing out over the walk.
Mr. Moe said it would project outward three feet , and the sidewalk was
ZO feet to the curb . �
BOARD ACTION : Mrs . Bostrom moved that a variance on Section 45Q7, Minne-
sota .Uni orm Building Code , be granted, to permit projection of door
more than one foot beyond the property line . Mrs . Collins seconded.
MOTION CARRIED.
