Deaz Sir/Madam:
The Airector of the Office of License, Inspections and Environmental Protection has
recommended adverse action against the off-sale liquor license held by FTL Corporation, d/b/a
MGM Liquor Warehouse for the premises at 275 White Bear Avenue North in Saint Paul. The
basis for the adverse action is as follows:
On December 11,1999, the Saint Paul Police Department
conducted a liquor compliance check at MGM Liquors, located
at 275 White Bear Avenue North. T�vo individuals, ages 18
and 20, entered the premises and the 18 year old female took a
six-pack of Corona beer to the counter. The clerk asked her
when she was born and she stated "1978" but the second
individual stated in the clerk's hearing "l�o, you were born in
1981." The clerk then asked the second female how old she
was, and she responded "Twenty." The clerk then stated that
they were going to cause him to lose his job, and rang up the
sale, allowing the two underage females to leave with the beer.
At no time did the clerk ask to see identification, and �i�hen the
police went in to identify him, he admitted knofr�ing that the
young women were underage to purchase alcohol.
Since this is considered a first violation, the licensing office will recommend a S�00.00 fine,
pursuant to St. Paul Legislative Code §409.26.

At this time you have three options on how to proceed:

If you do not dispute the above facts and do not wish to have a public hearing, you �vill
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be �onsidered to be a waiver of the heazing to which you aze entitled. An
envelope has been provided if this is your choice.
2. Altematively, if you do not dispute the above facts, but wish to have a public heazin�
before the Saint Paui City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Monday, January 24, 2000. The
matter will then be scheduled before the City Council for a public hearin� to determine
what penalry, if any, to impose. You will have an opportunity to appeaz before the
Council and make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday,
January 24, 2000, how you wish to proceed.
If you have not contacted me by Monday, January 24, 2000, I will assume that you are not
contesting the facts and will schedule this matter for the St. Paul City Council and have it
piaced on the Consent Agenda during which no public discussion is allo�ved and the
recommended penalty will be imposed.

NARRATIVE
I, Sgt Ramstad, along with Sgt Burke, conducted liquor compiiance checks on
12/1'I/1999. We used Compliance Checker 45 who has a DOB of
7/19/1981 and Compliance Checker 31 who has a DOB of 2/3/1979. We
took their money and Identification so they were unable to show identification.
They were given department buy funds to make their purchases.
At about 1342 hours the Gheckers went into MGM Liquor Store at 275
White Bear Ave North. Checker 45 grabbed a 6pac of Corona and went to
the counter. The sales person asked her when she was born. She told him
1978. Checker 31 said "no you were bom in 1981 ". Checker 45 told the
sales person the she was born in 1981. The sales person asked how old
Checker 31 was. She responded 20. The sales person told them they are
going to cause him to loose his job. He rang up the sale and the Checkers left
with the beer.
We identified the sales person as Moss, Charles Wesiey 2/2/1971 763
Thomas, St Paul, MN 55104. Home Phone 651-776-5976, Work Phone
651-224-7142. He admitted he knew they were both under age when he
sold the beer to them. He could not explain why he sold the beer after he
determined that the checkers were not of legal age.
The manager Brower, Gregory Wiiliam was advised of the violation. He was
advised that there would be follow-up done by LIEP and that the case would
be filed with the City Attorney's Office.

Deaz Sir/Madam:
The Airector of the Office of License, Inspections and Environmental Protection has
recommended adverse action against the off-sale liquor license held by FTL Corporation, d/b/a
MGM Liquor Warehouse for the premises at 275 White Bear Avenue North in Saint Paul. The
basis for the adverse action is as follows:
On December 11,1999, the Saint Paul Police Department
conducted a liquor compliance check at MGM Liquors, located
at 275 White Bear Avenue North. T�vo individuals, ages 18
and 20, entered the premises and the 18 year old female took a
six-pack of Corona beer to the counter. The clerk asked her
when she was born and she stated "1978" but the second
individual stated in the clerk's hearing "l�o, you were born in
1981." The clerk then asked the second female how old she
was, and she responded "Twenty." The clerk then stated that
they were going to cause him to lose his job, and rang up the
sale, allowing the two underage females to leave with the beer.
At no time did the clerk ask to see identification, and �i�hen the
police went in to identify him, he admitted knofr�ing that the
young women were underage to purchase alcohol.
Since this is considered a first violation, the licensing office will recommend a S�00.00 fine,
pursuant to St. Paul Legislative Code §409.26.

At this time you have three options on how to proceed:

If you do not dispute the above facts and do not wish to have a public hearing, you �vill
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be �onsidered to be a waiver of the heazing to which you aze entitled. An
envelope has been provided if this is your choice.
2. Altematively, if you do not dispute the above facts, but wish to have a public heazin�
before the Saint Paui City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Monday, January 24, 2000. The
matter will then be scheduled before the City Council for a public hearin� to determine
what penalry, if any, to impose. You will have an opportunity to appeaz before the
Council and make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday,
January 24, 2000, how you wish to proceed.
If you have not contacted me by Monday, January 24, 2000, I will assume that you are not
contesting the facts and will schedule this matter for the St. Paul City Council and have it
piaced on the Consent Agenda during which no public discussion is allo�ved and the
recommended penalty will be imposed.

NARRATIVE
I, Sgt Ramstad, along with Sgt Burke, conducted liquor compiiance checks on
12/1'I/1999. We used Compliance Checker 45 who has a DOB of
7/19/1981 and Compliance Checker 31 who has a DOB of 2/3/1979. We
took their money and Identification so they were unable to show identification.
They were given department buy funds to make their purchases.
At about 1342 hours the Gheckers went into MGM Liquor Store at 275
White Bear Ave North. Checker 45 grabbed a 6pac of Corona and went to
the counter. The sales person asked her when she was born. She told him
1978. Checker 31 said "no you were bom in 1981 ". Checker 45 told the

Checker 31 was. She responded 20. The sales person told them they are
going to cause him to loose his job. He rang up the sale and the Checkers left
with the beer.
We identified the sales person as Moss, Charles Wesiey 2/2/1971 763
Thomas, St Paul, MN 55104. Home Phone 651-776-5976, Work Phone
651-224-7142. He admitted he knew they were both under age when he
sold the beer to them. He could not explain why he sold the beer after he
determined that the checkers were not of legal age.
The manager Brower, Gregory Wiiliam was advised of the violation. He was
advised that there would be follow-up done by LIEP and that the case would
be filed with the City Attorney's Office.

Deaz Sir/Madam:
The Airector of the Office of License, Inspections and Environmental Protection has
recommended adverse action against the off-sale liquor license held by FTL Corporation, d/b/a
MGM Liquor Warehouse for the premises at 275 White Bear Avenue North in Saint Paul. The
basis for the adverse action is as follows:
On December 11,1999, the Saint Paul Police Department
conducted a liquor compliance check at MGM Liquors, located
at 275 White Bear Avenue North. T�vo individuals, ages 18
and 20, entered the premises and the 18 year old female took a
six-pack of Corona beer to the counter. The clerk asked her
when she was born and she stated "1978" but the second
individual stated in the clerk's hearing "l�o, you were born in
1981." The clerk then asked the second female how old she
was, and she responded "Twenty." The clerk then stated that
they were going to cause him to lose his job, and rang up the
sale, allowing the two underage females to leave with the beer.
At no time did the clerk ask to see identification, and �i�hen the
police went in to identify him, he admitted knofr�ing that the
young women were underage to purchase alcohol.
Since this is considered a first violation, the licensing office will recommend a S�00.00 fine,
pursuant to St. Paul Legislative Code §409.26.

At this time you have three options on how to proceed:

If you do not dispute the above facts and do not wish to have a public hearing, you �vill
need to pay the recommended fine for this violation. If this is your choice, you should
make payment directly to the Office of License Inspections and Environmental
Protection, Room 300 Lowry Professional Building, 350 Saint Peter Street, Saint Paul,
Minnesota 55102. The letter should be directed to Ms. Christine Rozek. Payment of the
fine will be �onsidered to be a waiver of the heazing to which you aze entitled. An
envelope has been provided if this is your choice.
2. Altematively, if you do not dispute the above facts, but wish to have a public heazin�
before the Saint Paui City Council, you will need to send me a letter with a statement
admitting the violation and requesting a hearing by Monday, January 24, 2000. The
matter will then be scheduled before the City Council for a public hearin� to determine
what penalry, if any, to impose. You will have an opportunity to appeaz before the
Council and make a statement on your own behalf as to the penalty to be imposed.
If you do dispute the above facts, a hearing will be scheduled before an Administrative
Law Judge. At that hearing both you and the City will be able to appear and present
witnesses, evidence, and cross-examine the other's witnesses. The St. Paul City Council
will ultimately decide the case. Please let me know in writing no later than Monday,
January 24, 2000, how you wish to proceed.
If you have not contacted me by Monday, January 24, 2000, I will assume that you are not
contesting the facts and will schedule this matter for the St. Paul City Council and have it
piaced on the Consent Agenda during which no public discussion is allo�ved and the
recommended penalty will be imposed.

MGM SOLD ALCOHOL TO UNDER AGED PEOPLE DUF2lNG A COMPLIANCE CNECK.
NARRATIVE
I, Sgt Ramstad, along with Sgt Burke, conducted liquor compiiance checks on
12/1'I/1999. We used Compliance Checker 45 who has a DOB of
7/19/1981 and Compliance Checker 31 who has a DOB of 2/3/1979. We
took their money and Identification so they were unable to show identification.
They were given department buy funds to make their purchases.
At about 1342 hours the Gheckers went into MGM Liquor Store at 275
White Bear Ave North. Checker 45 grabbed a 6pac of Corona and went to
the counter. The sales person asked her when she was born. She told him
1978. Checker 31 said "no you were bom in 1981 ". Checker 45 told the
sales person the she was born in 1981. The sales person asked how old
Checker 31 was. She responded 20. The sales person told them they are
going to cause him to loose his job. He rang up the sale and the Checkers left
with the beer.
We identified the sales person as Moss, Charles Wesiey 2/2/1971 763
Thomas, St Paul, MN 55104. Home Phone 651-776-5976, Work Phone
651-224-7142. He admitted he knew they were both under age when he
sold the beer to them. He could not explain why he sold the beer after he
determined that the checkers were not of legal age.
The manager Brower, Gregory Wiiliam was advised of the violation. He was
advised that there would be follow-up done by LIEP and that the case would
be filed with the City Attorney's Office.
