WHEREAS, Chapter 3.02 (8) of the St. Paul Administrative Code
requires the City Attorney to conduct prosecutions for crimes and
offenses occurring in the City of St. Paul and within the jurisdiction
of the Ramsey County Municipal Court; and
'WI�REAS, The Office of the City Attorney conducts all of its
prosecutions in the Ramsey County Municipal Court; and
WHEREAS, therefore, the Office of the City Attorney, by reason
of conflict of interest, cannot provide an attorney to prosecute a
judge of the Ramsey County Municipal Court; and
WHEftEAS, Section 5.02 of the Charter of the City of Saint Paul,
and Section 2.05 of the Administrative Code, empower the Council, upon
the request of the City Attorney, to appoint special counsel and provide
compensation therefor, in cases where the City Attorn.ey eannot by reason
of conflict of interest provide representation; now, therefore, be it
ftESOLVED, That the Council hereby, upon the request of the City
Attorney� appoint Steve Simon as special counsel to prosecute the
Honorable Roland Faricy, Judge of the Ramsey County Municipal Court,
on a misdemeanor traffic violation which occurred in the City of St.
Paul and within the jurisdiction of the Ramsey County Municipal Court,
and fixes the compensation at �500.00 to fully prosecute the matter
through disposition in the Municipal Court.
