WHEREA5, upon the petition of Shallern Corporation, et al, the
Council of the City of Saint Paul by Council Resolution C.F. No. 278915
adopted June 29 , 1982 did vacate that section of public street herein-
after described:
All that part of the North one-half (N. 2) of Armstrong Avenue
which lies east of the southerly extension of a line 6.59 feet
west of and parallel to the west line of Lot 23 and which lies
west of the southerly extension of the East line of Lot 26, all
in Block 1 of D. R. Burbanks Addition to St. Paul; and also
All that part of the South one-half (S. 2� of Armstrong Avenue
which lies east of the northerly extension of the west line of
Lot 4 and which lies westerly of the east line of Lot 1 all in
Block 6, Finch's Addition to St. Paul.
�n]HEREAS, said vacation was granted on condition that the petitioner
comply with specific terms and conditions as set forth in said resolution;
WHEREAS, the Petitioner, Shallern Corporation, et al has
failed to comply with said terms and conditions;
NOW THEREFORE BE IT RESOLVED that the vacation of the above described
public street adopted by the Council of the City of Saint Paul in
Council Resolution C.F. No. 278915 is hereby rescinded.

RESOLVED, That upon the petition of Shallern Corporation,
et al, that section of public street hereinafter described,
be and the same hereby is vacated and discontinued as a public
street:
All that part of the North one-half

2. That a specific easement be retained to protect
the interests of Northern States Power Company
' within said portion of Armstrong Avenue.
3 . That a specific easement be retained to protect
the interests of Northwestern Bell Telephone
Company within said portion of Armstrong Avenue.
4. That an easement for water utility purposes be
retained over the North thirty (30) feet of the
west ten (10) feet of the vacated area .
5. That the Shallern Corporation, its successors or
assigns, hereinafter referred to as the petitioner,
shall furnish an $8, 500.00 deposit to the water
utility to insure payment of the work necessary to
abandon the existing water main and relocate the
existing fire hydrant. At the completion of the
project the petitioner also will be responsible to
pay to the water utility any amount exceeding the
$8, 500.00 deposit stated herein.
6. That a permanent 30-foot wide underground storm
sewer easement centered on the existing sewer must
be retained between elevations 15.0 and 40.0 St.
Paul City Datum in Armstrong Avenue.
7. That a permanent 30-foot wide stationary sewer ease-
ment centered on the existing sewer must be retained
in Armstrong Avenue with the usual restrictions.
That if the existing sanitary sewer should be re-
located or protected by sleeving in its service to
the existing properties in this block all c osts in
relocating or sleeving this sewer must be paid for by
the petitioner and approval for same must be obtained
from the Sewer Engineer.

8. That restrictions within the easement areas be
as follows:
A . No buildings, structures, or trees are
permitted within the easement area, or
any temporary structure, material storage
fixture or other objects that will prohibit
normal access to sewer and water facilities
for maintenance purposes .
B. No change from the existing grade is permitted
wittmut written permission from the Water
Utility and Department of Public Works.
C . No change in surfacing within the easement
area is permitted without written permission
from the Water Utility and Department of Public
Work s.
D. That the petitioner, shall fully indemnify,
defend and save harmless the Board of Water
Commissioners, the City of Saint Paul, its
officers, agents, employees, and servants from
all suits, actions or claims which shall arise
from any injuries or damages received or
sustained by any break in any service pipe,
water main, or connection in said reserved ease-
ment, arising out of or resulting from any
action or negligence of the petitioner, its
employees, agents or business invitees.
g. That the petitioner be required to provide an auto-
matic sprinkling system for his existing and proposed
development to the satisfaction of the Fire Depart-
ment. The petitioner will bear all cost and expense
associated with the sprinkling system including but
not limited to any costs incurred by the Waher Utility
in providing adequate water volume and pressure to
the site.

C.F. 278915 granting petition of Shallern Corp. for vacation of .
part of Armstrong Avenue due to Shallern' s non-compliance with the

John B. McCormick of our office has been assigned
to prepare this matter by October 6 Workload, vacation
schedules or other problems may result in this deadline not being

2. That a specific easement be retained to protect

5. That the Shallern Corporation, its successors or
assigns, hereinafter referred to as the petitioner,
shall furnish an $8, 500.00 deposit to the water
utility to insure payment of the work necessary to
abandon the existing water main and relocate the
existing fire hydrant. At the completion of the
project the petitioner also will be responsible to
pay to the water utility any amount exceeding the
$8, 500.00 deposit stated herein.
6. That a permanent 30-foot wide underground storm
sewer easement centered on the existing sewer must
be retained between elevations 15.0 and 40.0 St.
Paul City Datum in Armstrong Avenue.
7. That a permanent 30-foot wide stationary sewer ease-
ment centered on the existing sewer must be retained
in Armstrong Avenue with the usual restrictions.
That if the existing sanitary sewer should be re-
located or protected by sleeving in its service to
the existing properties in this block all c osts in
relocating or sleeving this sewer must be paid for by
the petitioner and approval for same must be obtained
from the Sewer Engineer.

8. That restrictions within the easement areas be
as follows:
A. No buildings, structures, or trees are
permitted within the easement area, or
any temporary structure, material storage
fixture or other objects that will prohibit
normal access to sewer and water facilities
for maintenance purposes.
B. No change from the existing grade is permitted
witYrout written permission from the Water
Utility and Department of Public Works.
C . No change in surfacing within the easement
area is permitted without written permission
from the Water Utility and Department of Public
Works.
D. That the petitioner, shall fully indemnify,
defend and save harmless the Board of Water
Commissioners, the City of Saint Paul, its
officers, agents, employees, and servants from
all suits, actions or claims which shall arise
from any injuries or damages received or
sustained by any break in any service pipe,
water main, or connection in said reserved ease-
ment, arising out of or resulting from any
action or negligence of the petitioner, its
employees, agents or business invitees.
9. That the petitioner be required to provide an auto-
matic sprinkling system for his existing and proposed
development to the satisfaction of the Fire Depart-
ment. The petitioner will bear all cost and expense
associated with the sprinkling system including but
not limited to any costs incurred by the Water Utility
in providing adequate water volume and pressure to
the site.

10. That the petitioner will be responsible for all
costs and expenses in the dedication of the cul-
de-sac right-of-way to the satisfaction of the
Department of Public Works and in a manner and
form approved by the City Attorney by January 1,
1983 .
11. That the petitioner will be responsible for all
costs and expenses in the construction of the pro-
posed cul-de-sac, including the c onstruction, re-
location and abandonment of all drainage facilities
made necessary by this vacation, all to the satis-
faction of the Department of Public Works by August
l, 1983 .
12. That the petitioner will be responsible for all
costs and expenses for the construction and instal-
lation of a Dead End Street Sign on Armstrong Avenue
and a "No Parking" sign in the Armstrong Avenue
cul-de-sac by the Department of Public Works. The
estimated cost is $250.00 . The petitioner will be
responsible for the erection and maintenance of the
necessary barricades for the vacated portions of
Armstrong Avenue until such time as the cul-de-sac
and building is constructed all subject to the
approval of the City Traffic Engineer.
13 . That the petitioner pay to the City as market value
the sum of $5,300.00, as compensation for the
vacation.
14. That the petitioner furnish the City with a bond in
the amount of $5,000 .00, and in addition thereto, by
acceptance of the terms and conditions of this
vacation agree to indemnify, defend and save harmless
the City of Saint Paul, its officers and employees
from all suits, actions, or claims of any character

Subject: Petition of Shallern Corporation, et al, for the vacation of a
certain part of Armstrong Avenue west of Drake Street.
Public Hearing - June 3, 1982
This petition is requested by Shallern Corporation and National Check-
ing Companies. The property on the south side of Armstrong Avenue is owned
by Shallern Corporation and is utilized as a corporate headquarters for Com-
bined Companies, Inc. , a related corporation. Canbined Companies, Inc. , pres-
ently has an option to purchase a major portion of the block on the north side
of Arcnstrong Avenue now owned by National Checking Company. It is the intent
of Combined Companies Inc. to expand their present facilities by constructing
additional office and warehouse space on the north side of Armstrong Avenue.
The new construction would be connected to the existing building and could be
constructed over a portion of the vacated Armstrong Avenue if permitted.
The residential neighbors on the south side of Armstrong Avenue and the
West Seventh Street Federation reviewed and support the proposed vacation. �
The vacation of this portion of Armstrong Avenue and the construction of a new
cul-de-sac will eliminate the problem of grain trucks using Armstrong as a
shortcut dawn Armstrong from West Seventh Street to the grain elevators which
are east of Drake Street. The Traffic Division of Public Works has been making
efforts to reroute the trucks from the grain elevator to Randolph via Drake
Street rather than using the residential streets.
The portion of the street to be vacated is 60 feet wide and 152 feet long
consisting of 9,120 square feet and lies between two (2) zoning areas RM-2
(Multiple Family) and I-1 (Industry). Note that the City Council will also be
deciding on the Shallern petition to rezone the RM-2 land to I-1.
Northern States Power Company reports having a pole and aerial wires also
gas lines in the proposed vacation area and they request that their interest
be protected.
The Telephone Company has an aerial cable on Northern States Power poles
on the nortt► side of Armstrong Avenue, serving this customer as well as others.
They need to continue this service and therefore, wish to retain their utility
easement rights in this street.

The Water Utility has a 6-inch water main and a fire hydrant in the
proposed vacation area. They will abandon the water main under the vacation
area and move the fire hydrant subject to an easement over the North thirty
(30) feet of the West ten (10) feet of t�e proposed vacation and subject to
the petitioner furnishing a deposit of $8,500.00 to cover the water utility
costs for the abandonment and relocation.
The Department of Public Works has no objections to the proposed vacation,
subject to the following easements, construction responsibilities, and costs.
1. A permanent 30-foot wide underground storm sewer ease-
ment centered on the existing sewer must be retained
between elevations 15.0 and 40.0 St. Paul C�xy Datum=fn Arm-

2. A permanent 30-foot wide sanitary sewer easement centered
on the existing sewer must be retained in Armstrong Avenue
with the usual restriction. If the existing sanitary sewer
is relocated in its service to the existing properties in

for by the petitioners and approval for same must be obtain-
ed from the Sewer Engineer.

in the dedication of the cul-de-sac right-of-way to the sat-
isfaction of the Department of Public Works and in a manner
and form approved by the City Attorney.
4. The petitioner must be responsible for all costs and expenses
in the construction of the proposed cul-de-sac, including
the construction, relocation and abandonment of all drainage
facilities made necessary by this vacation, all to the satis-
faction of the Department of Public Works.
5. The petitioner must be responsible for all costs and expenses
for the construction and installation by the Department of
Public Works for a Dead End Street Sign on Armstrong Avenue
and a "No Parking" sign in the Armstrong Avenue cul-de-sac
at an estimated cost of $250.00.
The Fire Department has stated that they cannot approve the vacation and
the proposed project unless the petitioners construct an adequate sprinkling
system. This sprinkling system will require replacement of the existing
6-inch water main in Juno Street from West Seventh Street to the project
(approximately 600 feet) with a larger main. All costs for this larger main
and sprinkling system will have to be borne by the petitioner.
There were no objections, recomanendations or restrictions received from
any other City department or utility company in response to my letter of in-
quiry sent them on April 21, 1982.
In view of the foregoing, I recommnend that the vacation be approved sub-
ject to the following terms and conditions;

Dear Mr. Donovan:
The Water Utility has an existing 6-inch water main in the portion of
Armstrong Avenue proposed to be vacated. An easement must be retained to
provide access to. this main over and across the north thirty (30) feet of
the proposed vacation.
Restrictions within the easement area are as follows:
1. No buildings, structures, or trees are permitted within the
easement area, or any temporary structure, material storage,
fixture or other objects that will prohibit normal access to
water facilities for maintenance purposes.
2. No change from the existing grade is permitted without
written permission from the Water Utility.
3. No change in surfacing within the easement area is permitted
without written permission from the Water Utility.
4. That the petitioner, its successors and assigns shall fully
indemnify, defend and save harmless the Board of Water
Commissioners, its officers, agents, employees, and servants
from all suits actions or claims which shall arise from any
injuries or damages received or sustained by any break in any
service pipe, water main, or connection in said reserved
easement, arising; out of or resulting from any action or
negligence of the petitioner, its employees, agents or
business invitees.

A review of the proposed vacation of Armstrong Avenue has been completed.
Armstrong Avenue is improved, 6e feet wide and extends to a length of 152 fee*. -
The petitioner plans to dedicate and construct a cul-de-sac at the end of the
vacated street rignt-of-way, as shown on the attached plan..
A permanent 30-foot wide underground storm sewer easement centered on the e:cist-
ing sewer must be retained between elevations 15.0 and 40.0 St. Paul City Datum
in A.rmstrong Avenue.
A permanent 3� foot wide sanitary sewer easement centered on the existing sewer
must be retained in Armstrong Avenue with the usual restrictions.
The existing sanitary sewer could possibly be relocated to service the existing
properties in this block. Al1 costs in relocating this sewer must be paa.d for
by the petitioners a.°�d approval for same must be obtained from the Sewer Engineer.
The petitioner must be responsible for all costs and expenses in the construction

The undersigned, as Owners of all adjacent land, present this petition
requesting the vacation of the following street:
The east 152.0 feet of the block of Armstrong Avenue, between Drake
Street and Osceola Avenue, (the area abutting lots l, 2, 3, and l�,
Finch's Addition) St. Pau1, Minnesota.
The property on the south side of Armstrong Avenue is owned by Shallern
Corporation and is utilized as a Corporate Headquarters for Combined
Companies, Inc. , a related corporation. The property on the north side
pf Armstrong Avenue is presently owned by National Checking Co.
Combined Companies Inc. , presently has an option to purchase the National
Ch.ecking property. It is the intent of Combined Companies, Inc. to
expand their present facilita_es by constructing additional office and
ware-house space on the north side of Armstrong Avenue. A connecting
link will be constructed on a portion of vacated Armstrong Avenue.
The plan for the area includes a cul-de-sac for Armstrong Avenue, adjacent
to the vacated partion of the street. Combined Companies, Inc. will
