Resolved, that upon the petition of Richard R. Lopez, et al, the
portion of public street hereinafter described, be and the same hereby
is vacated• and discontinued as a public street:
All that part of Germain Street as originally opened, ,
except the east ten feet thereof which lies southerly
of the most northwesterly line, extended northeasterly
across said street, of Lot 6, Tilsen' s 6th Addition
and which lies northerly of the southerly line, extended
easterly across said street of Lot 7 , Tilsen' s 6th Addition.
subject expressly to the following conditions and reservations :
l . That the vacation be subject to all the terms and
conditions of Chapter 130, codified March . l, 1981, of
the St. Paul Legislative Code, including the retention
of all public utilities easements.
2 . That an easement be retained to protect the interest
of Northern States Power Company.
3. That the petitioners pay to the City as market value
the sum of $8, 300 . 00 , as compensation for the vacation.
4 . That the petitioners furnish the City with a bond in
the amount of $5 ,000 .00 and in addition thereto, by
acceptance of the terms and conditions of this vacation
agree to indemnify, defend and save harmless the City of
Saint Paul, its officers and employees from all suits ,
actions, or claims of any character, including, but not
limited to, a claim brought because of any injuries, or
damages received or sustained by any person, persons or
property , on account of this vacation; or because of any
act or omission, neglect or misconduct of said petitioner;

Subject: Petition of Richard R. Lopez, et al, for the vacation of Germain
Street between Christie Place and East Idaho Street.
Public Hearing - September 14, 1982
The petitioners, being the owners of all the land abutting that part of
Germain 5treet, request Chat this vacation be granted.
The petitioners state that Chis part of Germain Street has never been used
as a public right-of-way and it serves no public purpose. If the vacation is
granted, the property will be used by the petitioners for residential purposes
with respect to Mr. and Mrs. Lopez and Mr. and Mrs. Gramse, and for cemetery
purposes with respect to the Independent Chesed Shel Emes Society.
The area to be vacated is 50 feet wide and 244.5 feet in length consisting
of 12,225 square feet and is zoned R-3 (Single Family).
Northern States power Company reports having poles and cables in the pro-
posed vacation area. They request that their interest be protected.
The Department of Public Works has reviewed the site of this proposed va-
cation and have no objections.
The Department of Planning and Economic Development has reviewed this va-
cation and finds no objections to the vacation as proposed.
There were no objections or recommendations from any other public or pri-
vate agencies involved.
In view of the foregoing, I recommend that the vacation be approved, sub-
ject to the follawing terms and conditions;
1. That the legal description read as follows:
All that part of Germain Street as originally opened,
except the east ten feet thereof which lies southerly
of the most northwesterly line, extended northeasterly

A review of the proposed vacation of Germain Street has been completed.
Germain Street was deeded to the City as a 60 foot wide street right-
of-way on December 4, 1885. The east 10 feet of this unimproved street
right-of-way was vacated in 1929.
The Department of Public Works has no objections to the vacation of
Germain Street.

The undersigned, constituting the owners of land
adjacent to the street sought to be vacated herein, as
disclosed by that certain report of ownership issued by the
Abstract Clerk for Ramsey County dated January 21, 1981, as
attached hereto, hereby present the within Petition:

WHEREAS, upon the petition of Shallern Corporation, et al, the
Council of the City of Saint Paul by Council Resolution C.F. No. 278915
adopted June 29 , 1982 did vacate that section of public street herein-
after described:
All that part of the North one-half (N. �) of Armstrong Avenue
which lies east of the southerly extension of a line 6.59 feet
west of and parallel to the west line of Lot 23 and which lies
west of the southerly extension of the East line of Lot 26, all
in Block 1 of D. R. Burbanks Addition to St. Paul; and also
All that part of the South one-half (:S. Z� of Armstrong Avenue
which lies east of the northerly extension of the west line of
Lot 4 and which lies westerly of the east line of Lot 1 all in
Block 6, Finch' s Addition to St. Paul.
�nTHEREAS, said vacation was granted on condition that the petitioner
comply with specific terms and conditions as set forth in said resolution;
WHEREAS, the Petitioner, Shallern Corporation, et a1 has
failed to comply with said terms and conditions;
NOW THEREFORE BE IT RESOLVED that the vacation of the above described
public street adopted by the Council of the City of Saint Paul in
Council Resolution C.F. No. 278915 is hereby rescinded.
