WHEREAS, the Minnesota Pollution Control Agency, on April 27 , 1984 , issued a
National Pollutant Discharge Elimination System and State Disposal System
Permit to the City of St. Paul, Metropolitan Waste Control Commission and the
Metropo�itan Council (hereinafter "Joint Permittees") authorizing the discharge
of combine�- sewer bypasses and overflows (CSO) to the Mississippi River, and
WHEREAS, the joint permittees are required, by the permit, to enter into an
agreement to define individual responsibilities for meeting the requirements
and conditions of the permit; now be it
RESOLVED, that the Council of the City of Saint Paul does hereby approve an
agreement between the City, the Metropolitan Waste Control Commission and the
Metropolitan Council, which defines individual responsibilities for meeting
the requirements and conditions of the National Pollutant Discharge
Elimination System and State Disposal System Permit and the proper city officers
be and are hereby authorized and directed to execute the said agreements on
behalf of the City of Saint Paul.

UNDER THE NATIONAL POLLUTANT DISCHARGc ELIMINATION SYS'�M
AND STATE DISPOSAL SYSTEM PERMIT PROGRAM
Pursuant to the provisions of the Federal Water Pollution Control Act, as
amended, (33 U.S.C. 1251 et seq; hereinafter the "Act") , Minnesota Statutes
Chapters 115 and 116, as amended, and Title 6, Part 4.8036 of the Minnesota Code
of Agency Rules (hereinafter 6 MCAR § 4.8036)
. THE CITY OF ST. PAUL,
METROPOLITAN�COUNCILA(HERE�NAF�ERC�JOINTIPERMITTEES"
)
are authorized by the Minnesota Pollution Control Agency �MPCA) , to discharge
from their combined sewer bypasses and overflows (CSO) to receiving water named
the Mississippi River and/or its tributaries , in accordance with monitoring
requirements and other conditions set forth in Parts I and II hereof. This
permit requires the deveTopment and submittal of a CSO Control Plan. The
CSO Control Plan shall represent an implementable CSO solution that will
eliminate CSO as a cause of non-compliance with water quality standards for
fecal coliform organisms in the metropolitan stretch of the Mississi
Present evidence on other pollutants is not sufficient to demonstratepthatvCSO
controls are necessary for compliance with other water quality standards.
The City of St. Paul , the Metropolitan Waste Control Commission (MWCC) and the
Metropolitan Council shall be jointly and severally liable for compliance with
the terrns and conditions of this permit to the extent of their statutory or
regula�ory authority over the activities necessary for compliance with this
Nermit.
This permit is a reissuance of an existing permit which has an expiration date
of midnight, June 30, 1977. This reissued permit shall become effective on the
date of issuance by the Director and >will supersede the existing permit upon
issuance.
This permit and the authorization to discharge shall expire at midnight,
December 31 , 1985. The Joint Permittees are not authorized to discharge after
the above date of expiration. In order to receive authorization to discharge
beyond Lhe above date of expiration, the Joint Permittees shall submit such
informetion and forms as are required by the MPCA no later than 180 days prior
to the above date of expiration as required by 6 h1CAR § 4.8036.

B. DISCHARGE LIMITATIONS
During the period beginning on the effective date of this permit and
lasting until December 31, 1985, the Joint Permittees are authorized to
discharge from bypass/overflow point(s) serial number(s) 001-045 in
accordance with the conditions contained in this permit.
1. Conditions for Discharae
The discharge from any combined sewer system bypass/overflow point by
the City or the MWCC is prohibited except:
a. During periods of hydraulic overload caused �Y rainfall or
snowmelt conditions which exceed the design hydraulit capacity of
the conveyance system.
b. During emergency conditions to include the foiiowi�:
1) Where unavoidable to prevent loss of 1ife, personal injury,
or severe property damage;
2) where excessive storm drainage or runoff war7d damage any
facilities necessary for compliance with tfiis �permit or any
_ other NPDES or SOS Permit issued to the C��y, MWCC, or
Council ; and
3) where emergency maintenance or emergency repairs are
required to assure system reliability su�j ect to the
conditions outlined in PAR7 I , C.
C. REPORTING ANO MONITORING REOUIREMENTS FOR DISCHARGE EVENTS
1. Telemetered Site Monitoring Requirements
The MWCC shall submit a monthly report to the MP�A summarizing
precipitation, regulator overflow duration, and regu�ator overflow
volume data collected through its remote - tele+�etry system.
Precipitation data shail be summarized from the MWCC's existing rain
oauge network. Overflow duration and overflow volume shall be
reported for each regulator identified by an asterisk on Attachment A,
except that overflow volume estimates shall not br required for
regulators 1-1 (Eustice at Wabash) , 1-2 (Wabash at Cromwell ) , or 27-07
(St. Peter at Kellogg). Each monthly report shall be submitted to the
Director at the following address and shall be postma rked no later
than the 21st day following the month during which the monitoring was
completed: .

a . Preliminary bypass notification shall be given immediately to the
Director (Attn: Enforcement Section, Oivision of Water Quality)
when the City or MWCC believes, based on the information then
available, that a bypass to waters of the state from any segment
' of the combined sewer system may be necessary pursuant to
conditions outlined in PART I , B.l.b. Authorized bypasses which

are exempt from this notification requirement. The notice shall
include, to the extent then available, the reasons therefore,
timetables , and appropriate alternatives that may be available to
minimize or abate the bypass. Any changes in the foregoing sha11
be immediately reported to the Director. The City or the MWCC
� shall immediately after the giving of said notice implement the
planning for appropriate alternatives to minimize or abate the
possible bypass. Thereafter, the City or MWCC shall implement
the appropriate, reasonable alternative(s) i.f any, to minimize or
abate the bypass. Appropriate alternatives shall include but not
be limited to those alternatives described in paragraph 3
hereinafter following. The failure of the City or the MWCC to
properly evaluate or interpret the information available shall
not void the City' s or the MWCC' s responsibility to comply with
this section. _
b. With �he exception of a discharge pursuant to PART I , B.l.a. , the
City or the MWCC shall report irnrnediately to the Enforcement
Section (612) 296-7373 any bypass which is caused by the
emergency conditions outlined in PART I , B.l.b. In addition all
unauthorized discharges, accidental or otherwise of oil , toxic
. pollutants, or other hazardous waste shall be immediately
reported as outlined above. The City or the MWCC shall take such
action as may be reasonable to minimize or abate pollution of
waters of the State. �
3. Request for Permission to Bypass for Maintenance or Repair
a.
Where a discharge from the conbined sewer system is needed to conduct
maintenance or repairs, the Director (Attn: Enforcement Section,
Division of Water Quality) must be notified in writing ten (10)
working days before the anticipated discharge and approval must be
received prior to removing this portion of the system from service.
Such request shall include a description of the circumstances which
surround the impending repair or maintenance situation and a
contingency plan which outlines procedures for minimizing or
eliminating waste discharges during the repair or maintenance work.

The contingency plan should consider alternatives such as temporary
holding tanks, diversionary pipes, treatmertt at the source,
alternative routing of flows or any other means for eliminating or
minimizing the direct discharc�:. of untreated wastewater.
4, Monitorin Re uirements in tne Event a B pass is Needed to Conduct
aintenance or epairs
In the event a discharge from outfall (s) 001-034 results from
activities necessary to maintain or repair the combined sewer system a
monitoring program as outlined in PART I , C.11. shall be conducted,
and a report as required in PART I , C.10. shall be submitted.
5. Annual Monitoring Requirements
The MWCC and City shall monitor the following regulators on an annual
basis:

Each of these regulators shall be sampled at least once per surrQner
during the months of July, August or September. Sampling shall be
conducted throughout the entire discharge duration following a
rainfall event of sufficient magnitude to cause an overflow at each
location.
Analysis shall be conducted according to the requirements of PART I ,
� C.11. and shall be reported ta the Director (Attn: Enforcement
Section , Division o; Water Quality) no later than ninety (90) days
following the sample collections. The monitoring report shall also
define the characteristics of the storm event sampled, including but
not limited to, volume, intensity, duratiQn, and antecedent
conditions.
6, Test Procedures
Test procedures for the analyses , of pollutants shall conform to
regulations promulgated pursuant to Section 304 (h) of the Act, and
Minnesota Statutes, Section 115.03, Subd. 1 (e)(7) as amended.
The MWCC and/or City shall periodically calibrate and perform
maintenance on all monitoring and analytical instrumentation used to
monitor pollutants discharged under this permit, at intervals to
ensure accuracy of ineasurements. The MWCC and/or City shall maintain
written records of all such calibrations and maintenance.

7. Recording of Results
For each measurement taken or sample collected pursuant to the
requirements of this permit, the MWCC and/or City shall record the
following informatiori.
1) The exact place, date, and time of sampling;
2) the dates the analyses were performed;
3) the person who performed the analyses;
4) the analytical techniques , procedures or methods used;
and
5) the results of such analyses.
8. Additional Monitoring by MWCC and/or City
If the MWCC and/or City routinely monitor any poilutant or parameter
of the combined sewer system not designated herein, or monitor a
designated pollutant or parameter more frequently than is required
herein, the results of such monitoring shall be included in the
calculation and reporting of values submitted in the report required
by PART I , C.S. and PART I , C.10.
If the MWCC and/or City perform any special monitoring or studies on
the combined sewer system, or on the receiving water, the results of
such monitoring or studies shall be provided to the MPCA upon request.
9. Recording �and Records Retention
A11 sampling and analytical records required by this permit shall
be retained by the MWCC and/or City for a minimum of three (3) years.
The MWCC and/or City shall also retain all original recordings from
any continuous monitoring instrumentation, and any calibration and
maintenance records, for a minimum of three (3) years. These
retention periods shall be automatically extended during the course of
any legal or administrative proceedings or when _so requested by the
Regional Administrator or the Director.
10. �Re or�ti.n.,�_on a Discharge Event Caused by Maintenance or Repair of the
Combined Sewer ystem
a. In order to maintain an accurate record of a discharge event, its
effect upon the receiving waters and the condition of or changes
in the combined sewer system pursuant to PART I ,C.4. , a report
shall be submitted to the Agency if a discharge event takes
place. The report shall be submitted by the responsible party to
- the Director (Attn: Enforcement Section, Division of Water
Quality) no later than sixty (60) days following the cessation of
such a discharge and shall contain at a minimum the following
information:

2) a surr8nary , of the impact of the discharge(s) upon the
receiving waters. This summary shall be based upon water
quality, flow volume , and other essential facts which may be
documented from past and ongoing monitoring and/or studies,
in addition to new data compiled from the sampling and
monitoring program required by this permit;
3) in the event of repairs or construction, the report shall
contain a complete description of all repairs or
construction completed, including any modifications in the
combined sewer system, any substantial changes in the
operational or maintenance procedures, and any other
significant activities which will alter the nature or
frequency of discharges; and
4) any other material factors affecting compliance with the
conditions of this permit and such information as the
Director may reasonably require of the MWCC pursuant to 6
MCAR § 4.8036 N, and Minnesota Statutes, Chapters 115 and
116 as amended.
b. Except for data determined to be confidential Under Section 308
_,of the Act, and Minnesota Statutes, Section I16.075, Subd. 2, all
reports prepared in accordance with the terms of this permit
shall be available for public inspection at the offices of the
MPCA. Procedures for submitting such confidential material shall
be pursuant to 6 MCAR § 4.8036 J.2. As required by the Act,
effluent data shall not be considered confidential , Knowingly
making any false statement on any such report, confidential or
otherwise, is subject to the imposition of criminal penalties as
provided for in Section 309 of the Act and Minnesota Statutes ,
Section 115.071 Subd. 2 (b).

D. OPERATION OF THE COMBINED SEWER SYSTEM
General operation of the combined sewer system shall be in compliance with
the following terms and conditions:
1. 0 eration of the S stem for Control of Combined Sewer Losses
The City and the MWCC shall operate the system for control of combined
sewer losses (including regulator devices, structures, systems, and
� programs) as efficiently as possible in order to minimize discharges
from the combined sewer system.
2. Maintenance of Facilities and Systems
The City and the MWCC shall at all times maintain in good working
order and operate as efficiently as possible all facilities or systems
of control installed or used in the combined sewer system and shall
conduct a regulator maintenance program in conformaoce with the
schedule in ATTACHMENT A. .
3. Svstem Reliability
The City and the MWCC are responsible for maintaining adequate
safeguards to min�mize the Cischarge of untreated or inadequately
treated wastes at all times. The City and the MWCC are responsible
for insuring system reliability. ,
4. Schedulin of Dischar es f rom the Combined Sewer S stem for
aintenance or epa�rs
Any maintenance or repair of the combined sewer system shall be
scheduled as much as possible during periods of high river flow and
shall be carried out in a�manner approved by the Director as outlined
in PART I , C.3.
5, Providing an Adequate Maintenance Staff
The City and the MWCC sha11 provide an adequate staff to carry out the
operation, maintenance, repair and testing functions required to
insure compliance with the conditions of this permit.
6. Deposition of Sludae or Removed Substances in the Interceptor System
The MWCC shall not deposit sludge or other removed substances from

a manner that would allow these substances to enter the receiving
r,•aters as a result of a discharge from bypass/overflow point(s)

of discharges in accordance with all applicable air„ water and solid
waste Statutes and Rules. When requested by the Dirrector, the City
and the MWCC shall submit for approval an acceptab�� plan for such
disposal and shall be responsible for obtaining MPC� approval and/or
permit of such disposal plans.
7. Stor-rrrwater Inflow
No new sources of stormwater inflow shall be direct'fy connected to any
portion of the sewer system that is designed to cartry sanitary or
combined sewage unless the source is in conformance: with the City' s
stormwater management program (St. Paul Ordinance Nm. 16919 adopted
May 28, 1982) . However, exemptions from this condiwion are allowed
for areas that are separated and no stormwater outl�t is currently
�vailable. Under such circumstances , provided the exemptions do not
cause a violation of PART I , E.1. below, storm sew�.TS may be
temporarily reconnected to the combined system unt%� a stormwater
outlet is constructed.
E. SCHEDULE OF COMPLIANCE
1. Sewer Separation Program
The City has determined that sewer separation is i�s preferred
alternative for controlling combined sewer bypass/awerflows. In
following with its preferred alternative the City ss.�hall continue a
sewer separation program in accordance with the schedule outlined
below.
Based upon historical budgeting and future project�:�ns, the City
, expects to account for expenditures of approximately four and one-half
million dollars annually on projects to correct CS(�.. For the purpose
of determining compliance with this condition, dur��ag the years this
permit is in effect, the City shall award a minimur� average of three
million dollars annually, in 1983 dollars, for CSO` sonstruction
contracts. .

Future expenditures for CSO projects shall be adjus�ted to 1983 dollars

It is the objective of this separation program that CSO discharges to
the Mississippi River will be progressively reduced throughout the
ongoing construction period leading to complete elimination of CSO
discharges. Towards this end it is incumbent upon the City to
� separate sewers in a manner and in an order of priority which will
progressively decrease the total CSO loading reaching the Mississippi
River throughout the Metro Area when considered as a whole.
The basis for compliance with this objective shall be that on an
annual basis the capacity of storm sewer pipe newly separated from an
existing combined sewer system and ultimately reconnected to the
combined sewer system shall not exceed the capacity of separated storm
sewer pipe which is permanently disconnected from the combined system.
The City shall submit in the annual . report required pursuant to PART
II ,A.3. a description of sewer separation work accomplished during the
previous calendar year and the net capacity increase of storm sewer
pipe resulting therefrom, an outline of projects scheduled for the
upcoming calendar year, the sewer separation budget approved by the
City Council for the upcoming year, a list of contracts executed for
the upcoming calendar year and the actual sewer separation
expenditures for the previous year.

2. CSO Contro� Plan -
The Joint Permittees shall , in accordance with their statutory or
regulatory authority over the necessary activities , develop a CSO Control
Pian in accordance with the schedule set out below. The CSO Control Plan
shall represent an implementable solution that will eliminate CSO as a
cause of non-compliance with water quality standards for fecal coliform
organisms in the Metropolitan stretch of the Mississippi River. Present
evidence on other pollutants is not sufficient to demonstrate that CSO
controls are necessary for compliance with other water quality standards.
The City is pursuing a program of combined sewer separation, and this
method for ;aehieving CSO control shall continue unless modified by the CSO
Control Plan. The CSO Control Plan shall include, but is not limited to:
revisions to the 201 Facilities Plan for CSO; identification of individual
projects with project costs, ranked in priority order; a comprehensive
project implementation schedule; and, for those projects scheduled to be
implemented during the first five years, identification of the responsible
parties for each project. The final CSO Control Plan is subject to MPCA
approval .
If the CSO Control Plan is not completed pursuant to the compliance dates
below, it is the intent of the MPCA to develop a schedule for meeting the
CSO objectives , based upon best available information and judgement, and
implement ._the solution through appropriate administrative and/or legal
procedures.

F. DEFINITIONS
1. The "MPCA" means the Minnesota Pollution Control Agency, as
constituted pursuant to Minnesota Statutes, Section 116.02, Subd. 1.
2. The "Director" means the Executive Director of the Minnesota Pollution
ontro gency as described in Minnesota Statutes, Section 116.03 as
amended.
3. The "Re ional Administrator" means the U.S. Envirornnental Protection
gency egiona ministrator for the regiort in which Minnesota
is located (now Region V).
4. The "Act" means the Federal Water Pollution Control Act, as amended 33
U:�:��51 , et seq.
5. A "Com osite" sam ie, for monitoring requirements, is defined as (1) a
ser�es o gra samp es collected at least once pe.r hour at equally
spaced time intervals and proportioned according to flow, or (2) grab
samples of equal volume collected at equally spaced intervals of
wastewater volume and collected not less than once per hour.
6. The "Grant A reement" mean� the formal EPA grant aff�r, as executed by
t e oint ermittees, accepting an EPA construction grant_, or the
grant agreement between the Joint Permittees and the MPCA in the case
of the Independent State Grant Program.
7. The "Joint Permittees" means the City of St. Paul (City) , the
Metropo itan aste Control Commission (MWCC} and the Metropolitan
Council (Council ) .
8. "Infiltration" means water other than wastewater that enters a
sewerage system (including sewer service connections) from the ground
through such means as defective pipes, pipe joints, connections, or
manholes. Infiltration does not include, and is distinguished from,
inflow.

9. "Inflow" means water other than wastewater that enters a sewerage
system including sewer service connections) from sources such as roof
leaders, cellar drains, yard drains, area drains, foundation drains,
drains f rom springs and swampy areas , manhole covers, cross
connections between storm Sewers and sanitary sewers, catch basins,
cooling towers, storm waters , surface runoff, street wash waters , or
drainage. Inflow does not include, and is distinguished from,
infiltration.

PART II
A. MANAGEMENT REQUIREMENTS
1. Street and Collection System Cleaning Program
The City shall conduct a street and collection system cleaning program
to reduce the amount of pollutants contributed to the river by CSO and
stormwater discharges. A summary of the cleaning program activities
shall be included in the annual report required by PART II, A. 3.
2. A reement Between the Joint Permittees Defining Responsibilities to
�Mee�i rements o t e ermit
The Joint Permittees shall enter into an Agreement to define the
individual responsibilities for meeting the requirements and
conditions of this permit. As a part of the above mentioned Agreement
the City and the MWCC shall define individual responsibilities to
assure that the regulator maiRtenance program as outlined in
ATTACNMENT A and all other maintenance and operational procedures are
properly conducted. The Agreement shall include but is not limited to
the following items: -
a. A delineation of responsibility to assure that all studies and
programs are completed and submitted to the Agency according to
the schedules contained in this permit.
b. A delfneation of responsibility for the maintenance and repair of
the conveyance structures contained in the combined sewer system.
c. A delineation of responsibility for the inspection, maintenance
and repair of all regulators , the regulator structure(s) and
outfall structure(s) in the event such coordination is needed to
carry out the maintenance program as outlined in ATTACHMENT A or
any other maintenance cr repair.
d. A condition outlining the coordination procedure between the City
and the MWCC for the maintenance and repair of the combined sewer
system, regulator(s) , regulator structure(s) and outfall
structure(s) in the event such coordination is needed to carry
out the maintenance program as outlined in ATTACHMENT A or any
other maintenance or repair.
e. A delineation of responsibilities for submittal of the
comprehensive report required pursuant to PART II , A.3.

f. A copy of the Agreement shall be submitted to the Director for
approval within ninety (90) days of the date of issuance of this
permi t.
3. Annual Report on the Combined Sewer System
The City and the MWCC shall submit an annual report to the Director
regarding the combined sewer system, the street and collection system
cleaning program, the sewer separation program, the rainleader
elimination program, and the maintenance program outlined in
ATTACHMENT A. At a minimum this report shall be coordinated among the
Joint Permittees and shall contain information on progress
accomplished pursuant to permit requirements, problems encountered in
the system and locations thereof, impact of the problem upon the
system, date or dates the problem occurred, past problems of a similar
nature, steps taken to correct the problem areas, recommendations for
permanent solutions to the problems encountered and any pertinent
information that would aid in understanding these problems and the
action taken to correct them. This report shall be submitted to the
MPCA before April 30 each year and shall cover the previous calendar
yea r.
4. Submittal of a Monitoring Plan -
The MWCC and City shall jointly submit a monitoring plan or monitoring
plan amendments to the Director for approval within ninety (90) days
after the date of issuance of this permit. The monitoring plan shall
deal with a11 phases of the bypass/overflow and routine monitoring
activities required herein. New monitoring plans or amendments to
previous monitoring plans shall be submitted if changes are to be made
or if additional or different monitoring is required by this permit.
The monitoring plan shall include the items described in 6 MCAR g
4.8036 N.2.
Upon review of the monitoring plan the Director may require changes or
additions to that portion of the monitoring program, including the
quality assurance program, required by the permit.
5. Construction
This permit authorizes construction to attain compliance with the
limitations and conditions of this permit only after plans and
specifications for the facilities have been submitted and approved in
writing by the Director prior to the start of any construction. The
requirements of this condition do not apply to the following
categories of projects:

B. RESPONSIBILITIES
1. Prohibited Wastes
Under no circumstances shall the City or the MWCC allow the
introduction of wastes prohibited by regulations promulgated pursuant
to Section 307 of the Act or rules adopted by the Agency (6 MCAR §
4.8036) into the sewer collection system, including but not limited to
the following:
a. Those which create a fire or explosion hazard in the combined
sewer system,
b. Those which will cause corrosive structural damage to the
combined sewer system,
c. Solids or viscous substances in amounts which cause obstructions
to the flow in sewers or interference with the proper operation
of the bypass/overflow control structures.
2. Changes in Discharges from the Combined Sewer System .
a. -All discharges authorized herein shall be consistent with the
terms and conditions of this permit. The discharge o` any
wastewater not consistent with the terms and conditions herein
shall constitute a violation of this permit. Such a violation
may result in the imposition of civil or criminal penalties as
provided for in Section 309 of the Act and Minnesota Statutes
Section 115.071.
b. Combined sewer system modifications, additions , and/or expansions
that increase the system capacity shall be reported to the
_ Director (Attn: Enforcement Section, Division of Water Quality)
prior to the changes taking place and this permit may then be
modified or reissued to reflect such changes: �
c. In no case are any system modifications or significant changes in
system operation including regulator adjustments permitted that
will cause an increase in volume or duration of normal overflow
events.
� 3. Coolinq Water
a . Discharge into the sanitary or combined sewer system of
non-contact cooline water which complies with all MPCA effluent
quality standards is prohibited unless there is no prudent and
feasible alternative.

4. Transfer or Ownership or Control
No permit may be assigned or transferred by the holder without the
approval of the Agency. In the event of any changes in control or
ownership of the facilities , a Request for Permit Transfer, signed by
all parties shall be sent to the Director (Attn: Enforcement Section,
Division of Water Quality) . Any succeeding owner or controller shall
also comply with the terms and conditions of this permit.
5. Permit Modification
After notice and opportunity for a hearing, this perm�t may be
modified, suspended or revoked in whole or in part during its term for
cause including, but not limited to, the following:
a. Violation of any terms or conditions of this permit;
b. Obtaining this permit by misrepresentation or failure tfl disclose
fully all relevant facts;
c. A change in any condition that requires either a temporary or
permanent reduction or elimination of the authorized discharge;
or '
d. Agency Rule 6 MCAR § 4.8036 5.1.
6. Right of Entry
The Joint Permittees shall , pursuant to Section 308 of the Act and
Minnesota Statutes 115.04, allow the Director, the Regional
. Administrator, or their authorized representatives, upon presentation
of credentials:
a. To enter upon the City' s and the MWCC's premises where a disposal
system or other point source or portion thereof is located for
the purpose of obtaining information, examination of records,
conducting surveys, or investigations;
b. To examine and copy any books, papers , records, or memoranda
pertaining to the installation, maintenance, or operation of the
combined sewer system, including but not limited to, monitoring
data of the combined sewer system or point source or records
required to be kept under the terms and conditions of this
permit;
c. To inspect any monitoring equipment or manitoring procedures
required in this permit; and
d. To sample any discharge of pollutants. •

7. Civil and Criminal Liability
Nothing in this permit shall be construed to relieve the Joint
Permittees from civil or criminal penalties , or preclude the
institution of any legal proceedings for noncompliance with applicable
State or Federal pollution control laws or for noncompliance with the
terms and conditions of this permit except that the Council shall be
liable for noncompliance with the terms and conditions of this permit
only to the extent of the Council 's statutory or regulatory authority
over the activities necessary for compliance with this permit.
8. Oil and Hazardous Substance Liability
'This permit shall not preclude the institution of any legal action or
relieve the Joint Permittees from any responsibilities, liabilities,
or penalties to which the Joint Permittees are or may be subject to
under Section 311 of the Act and Minnesota Statutes, Chapters 115 and
116 as amended. Each Joint Permittee is potentially liable only to
the extent of its statutory or regulatory authority.
9. Minnesota Laws
This permit shall not preclude the institution of an.y legal or
administrative proceedings or relieve the Joint Permittees from any
responsibilities, liabilities, or penalties for violation of effluent
and water quality limitations not included in this permit. Each Joint
Permittee is potentially liable only to the extent of its statutory or
regulatory authority.
10. Property Rights
The issuance of this permit does not convey any property rights in
either real or personal property, or any exclusive privileges , nor
does it authorize any injury to private property or any invasion of
personal rights, nor any infringement af Federal , -State, or Local laws
or regulations. �.
11. Severability
The provisions of this permit are severable, and if any provisions of
this permit, or the application of any provision of this permit to any
circumstance, is held invalid, the application of such provision to
other circumstances , and the remainder of this perrnit, shall not be
affected thereby.

This Agreement, made and entered into this day of July, 1984, by
and between the City of St. Paul , a municipal corporation of the State of Minnesota
(hereinafter the "City") , the Metropolitan Waste Control Commission, a political
subdivision of the State of Minnesota (hereinafter the "Commission") , and the
Metropolitan Council , a political subdivision of the State of Minnesota (hereinafter
the "Council ") .
Witnesseth That, in the joint and mutual exercise of their powers and in con-
sideration of the mutual covenants herein contained, the parties hereto recite
and agree as follows:
Section 1. Recitals.
1.01. The City owns and operates a sewer system located inside the boundaries,
comprising various lateral , sub-trunk and trunk sewers; pumping stations; flow
regulating devices; and other equipment and appurtenances.
1.02. The Commission owns and operates a sewer system located inside and out-
side the City, comprising interceptor sewers, pumping stations, flow regulating
devices, treatment works, and other equipment and appurtenances.
1.03. The Council has powers and responsibilities as provided in Minnesota
Statutes, including the responsibility to adopt a Water Resources Management
Development Guide-Sewage Treatment and Handling Policy Plan,_and the responsibility
to review and approve or disapprove the Commission's Development Program and Capital
Budget.
1.04. Sanitary sewage and surface water is received by the City sewer system
and is discharged into the Commission's sewer system. During periods of snowmelt
and/or rainfall , sewage and surface water is discharged in such amounts that the
design hydraulic conveyance capacity of the sewer system is exceeded, resulting in
the overflow of such combined sewage into the Mississippi River, all at the points
described in the attached Exhibit A.
1.05. The City has for several years been engaged in a program to provide
facilities designed to minimize the number and volume of combined sewer overflows
into the Mississippi River or to eliminate them altogether.
1.06. The overflows of combined sewage into the Mississippi River are regulated
through the permits issued by the Minnesota Pollution Control Agency (the Agency) .
The Agency is desirous of eliminating or better controlling such overflows and
recognizes that this can only be accomplished over a period of several years through
the joint efforts of the City, the Commission, and the Council . Accordingly the
Agency has issued its Permit No. MN 0025470 to the City, the Commission, and the
Council (the Permit) authorizing the continuation of such combined sewer overflows
until December 31, 1985, which permit is attached hereto as Exhibit A.
1.07. The Permit requires the City, the Commission, and the Council as joint
permittees, to undertake certain actions and programs hereinafter described toward
efficient operation and maintenance of the combined sewer system and toward
development of a combined sewer overflow (CSO) Control Plan.
1.08. The purpose of this agreement is to define the responsibilities of the
City, the Corrgnission, and the Council under the Permit, Part II .A,2.

' 6.02. Bypass Notification. The City and the Commission shall each have the
obligation to notify the other joint permittees immediately following notification
to the Agency in accordance with Part I .C.2 of the Permit.
6.03. Agency Communications. Written communication and/or reporting to the
Agency by any of the joint permittees in accordance with the Permit requirements
or regarding Permit conditions and provisions shall include copies to the other
joint permittees.
6.04. Costs. Each of the_ parties agrees to provide funds for and pay the cost
of performing its obligations under this agreement, subject to the following
provisions:
(1) The City agrees to reimburse the Corr�nission for the Cost of work performed
" on the City's sewer system under Section 2.03.
(2) The City agrees to reimburse the Commission for costs on a time and
materials basis for providing bypass monitoring during maintenance or
repair of portions of the sewer system which the City has responsibility
under Section 2.01, as per Section 3.02.
(3) The City agrees to pay one-third of any permit fee levied by the Agency,
by reimbursing the Commission. The Commission agrees to submit all
required permit fees to the Agency on behalf of the joint permittees.
When feasible, the Cormnission agrees to credit costs due from. the City pursuant to
this agreement against the costs due to the City under the annual sewer maintenance
agreement between the City and the Commission. Each party shall be responsible for
keeping accurate and cor�plete records of all costs incurred during the performance
of its duties under this agreement. The above allocation of cost does not preclude
the designated responsible party from recovering costs from another party, after the
action(s) required by the Permit and this agreement have been completed by the
designated responsible party.
6.05. Amendments. This agreement may be modified only by written amendment
executed by the City, the Commission, and the Council.
6.06. Effectiveness. This agreement shall be effective upon its execution
by the City, the Commission, and the Council .
6.07. Termination. This agreement shall terminate on December 31, 1985, or
upon termination of the permit, whichever is earlier, unless extended by amendment,
per Section 6.05.
6.08. Severability. The provisions of this agreement are severable, and the
invalidity or impossibility of performance of any of them shall not invalidate or
render ineffective any other provision.
IN WITNESS WHEREOF, the parties have executed this agreement by authority of
their respective governing bodies as of the day and year first above-written.
