RESOLUTION
1 WHEREAS, Citizen Service Office, Aivision of Code Enfoxcement has requested the City
2 Council to hold public hearings to consider the advisability and necessity of ordering the repair or
3 wrecking and removal of a two-story, wood frame dwelling located on properiy hereinafter referred to as
4 the "Sub}ect Property" and commonly known as 411 Sherburne Avenue. This property is legally

WHEREAS, based upon the records in the Ramsey County Recorder's O�ce and information
obtained by Division of Code Enforcement on or before September 17, 1999, the following are the now
known interested or responsible parties for the Subject Property: James R. Justice, 4ll Sherburne
Avenue, St. Paul, MN 55103-1942; Crreater Frogtown Com.Dev. Corp., 689 Dale Stxeet North,
St. Paul, NIN 55104
WIIEREAS, Division of Code Enforcement has served in accordance with the pxovisions of
Chapter 45 of the Saint Paul Legislative Code an order identified as an "Order to Abate Nuisance
Building(s)" dated October 29, 1999; and
WHEREAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and

requested that the City Clerk schedule public heazings before the Legislative Hearing Officer of the City
Council and the Saint Paul City Council; and
WI�REAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chaptex 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of
the public hearings; and

WI3EREAS, a hearing was held before the Saint Paul City Council on Wednesday, Febri.iary 23,
2000 and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paui City Council hereby adopts the following Findings and Order
concerning the Subject Pxoperty at 411 Shexburne Avenue:
That the Subject Properry comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then lmown xesponsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Properry which
declazes it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacantJNuisance Buildings.
8. That the known intexested parties and ownexs are as previously stated in this xesolution
and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the 3ubject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and correcting ali deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and oxdinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within fifteen (15) days after the date of the Council
Hearing.

1 2. If the above corrective action is not completed within this period of time the Citizen Service
2 Office, Division of Code Enforcement is hereby authorized to take whatever steps aze necessary
3 to demolish and remove this structure, fill the site and chazge the costs incurred against the
4 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
properry or fixtures of any kind which interfere with the demolifion and removal shall be
removed from the property by the responsible parties by the end of this time period. If all
personal property is not removed, it shall be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such properry as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and 'mterested parties
in accordance with Chapter 45 of the Saint Paul Legislative Code.

Division of Code Enforcement has declared this building(s} to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by correctin� the deficiencies or
by razing and removin� this building(s).
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsibie parties to either repair, or demolish and remove this buildin� in a timely
manner, and failing that, authorize the Division of Code Enforcement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as tases.

The meeting was called to order at 10:02 a.m.
STAFF PRESENT: Sally Peterson, Code Enforcement
Resolution ordering the owner to remove or repair the building at 1216 Reaney Avenue. If
the owner fails to comply with the resolurion, Code Enforcement is ordered to remove the
building.

Sa11y Peterson reported the building has been vacant since July 1998. The properry owner is
I3(JD (Housing and Urban Development). Six summary abatement notices ha�e been issued to
remove refuse, secure the building, and cut tall grass. An inspection was conducted on 8-25-99
and a list of deficiencies which constitute a nuisance condifion was developed. Vacant building
fees aze not paid. Rea1 estate tases are paid. Estimated mazket value of the property is $48,800;
estnnated cost to repair, $40,000; estimated cost to demolish, $8,000 to $9,000. On 7-27-99, a
code compliance inspecrion was completed. A$2,000 bond has not been posted.
Pat Olawsky and Rich Lemcke appeared. Mr. Olawsky stated the property was sold for $50,000;
however, that person reneged on the agreement. There were four other offers, and they plan to go
back to these other offers to sell the properry. This may take 45 days at the maximum.
Gerry Strathman asked is the building secure. Ms. Peterson responded yes.
Is the exterior being maintained, asked Mr. Strathman. Mr. Olawsky responded the sidewalks aze
being shoveled, and he is personally inspecting the property once a week.
Did Code Enforcement haue any problems with the granting of addifional time, asked Mr.
Strathxnan. Ms. Peterson responded she spoke to Steve Magner this morning who is fine with
additional time being granted.
Mazgaret Mudek, 119 E. Isabel, appeazed and stated the properly has been on sale since August
when she first bid on it. A$20,000 bid is not realistic on this building because of the repair wark
that is needed. The building is not secured well. The $50,000 estimate quoted by Code
Enforcement may not be conect anymore because the Jacuzzi bathtub has been stolen and the
building has been broken into numerous times. The police have been called, the building is
open, the back doors and windows aze kicked in. Bids have been $60,000 to fix the building.
The last buyer dropped out of her bid because she could not afford the repairs.

Mr. Stratlunazi asked when the building was last checked. Ms. Peterson responded on January
24.
Gerry Strathman recommended laying over to the Apri14, 2000, Legislative Hearing. This will
a11ow the owners time to go through the active bidders for the properiy. If there is not a
successful sale by Apri14, then this matter will be looked at again.

Sally Peterson reported the property was condemned June 1997 and has been vacant since
August 1997. The owner has moved out of state and would like the properiy demolished.
Habitat for Humanity is planning to build a home on the properiy. Seven summary abatement
notices haue been issued to remove refuse, secure the building, and cut tall grass. On 10-18-99,
an inspection was done on the property and a list of deficiencies which constitute a nuisance
condition was developed. The vacant buitding fees are not paid. Real Estate taxes are unpaid in
the amount oF $4006.85. The estimated market value is $30,300; estimated cost to repair,
$70,000; estunated cost to demolish, $6,000 to $7,000.

Resolution ordering the owner to remove or repair the building at 1216 Reaney Avenue. If

Sa11y Peterson reported the building has been vacant since July 1998. The properry owner is
I3(JD (Housing and Urban Development). Six summary abatement notices ha�e been issued to
remove refuse, secure the building, and cut tall grass. An inspection was conducted on 8-25-99
and a list of deficiencies which constitute a nuisance condifion was developed. Vacant building
fees aze not paid. Rea1 estate tases are paid. Estimated mazket value of the property is $48,800;
estnnated cost to repair, $40,000; estimated cost to demolish, $8,000 to $9,000. On 7-27-99, a
code compliance inspecrion was completed. A$2,000 bond has not been posted.
Pat Olawsky and Rich Lemcke appeared. Mr. Olawsky stated the property was sold for $50,000;
however, that person reneged on the agreement. There were four other offers, and they plan to go
back to these other offers to sell the properry. This may take 45 days at the maximum.
Gerry Strathman asked is the building secure. Ms. Peterson responded yes.
Is the exterior being maintained, asked Mr. Strathman. Mr. Olawsky responded the sidewalks aze
being shoveled, and he is personally inspecting the property once a week.
Did Code Enforcement haue any problems with the granting of addifional time, asked Mr.
Strathxnan. Ms. Peterson responded she spoke to Steve Magner this morning who is fine with
additional time being granted.
Mazgaret Mudek, 119 E. Isabel, appeazed and stated the properly has been on sale since August
when she first bid on it. A$20,000 bid is not realistic on this building because of the repair wark
that is needed. The building is not secured well. The $50,000 estimate quoted by Code
Enforcement may not be conect anymore because the Jacuzzi bathtub has been stolen and the
building has been broken into numerous times. The police have been called, the building is
open, the back doors and windows aze kicked in. Bids have been $60,000 to fix the building.
The last buyer dropped out of her bid because she could not afford the repairs.

BE IT RESOLVED, that based upon the testimony and evidence presented at the above

8. That the known intexested parties and ownexs are as previously stated in this xesolution

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the 3ubject Property safe and
not detrimental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and correcting ali deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and oxdinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within fifteen (15) days after the date of the Council
Hearing.

Paul shall remove and dispose of such properry as provided by law.
