ZONING CODE REFERENCE: Sec. 67.406, . 67.500 5. STAFF INUESTIGATION & REPORT: DATE: 7/16/84 BY: Patricia James A. PURPOSE: Preliminary Plat Approval for Skyline Oaks , a condominium B. SITE & AREA CONDITIONS: Site comprises 3.26 acres of land, including public rights-of-way to be vacated. There are steep slopes through the site from the northwest to the southeast. C. REQUIRED FINDINGS: (1 ) �111 the applicable provisions of the Legislative Code are complied with; The applicant has submitted a petition to rezone this site to PD-Planned Development. The proposal is also undergoing site plan review. Upon approval of the rezoning and approval of the site plan, Legislative Code provisions will be complied with. (2) The proposed subdivision will not be detrimental to the present and potential surrounding land uses; By taking appropriate erosion control measures, the developmer�t will not adversely affect the surrounding area. The proposed use will be similar in density to the surrounding single family area. (3) The area surrounding the subdivision can be planned and developed in coordinatian and compatibility with the proposed subdivision; The surrounding area is currently developed and is compatible with the proposed subdivision. (4) The subdivision is in conformance with the comprehensive plan; The Land Use Plan recommends alternatives to single family detached dwellings and careful development of environmentally sensitive areas. The District 3 Plan recommends a s�milar form of development for this site. (5) The subdivision preserves and incorporates the site's important existing natural features, whenever possible; . . ��/�o�/ PLAT STAFF REPORT Applicant: Derrick Land Company Page 2 The proposal clusters the housing on the f.latter portions of the site and and preserves the steep slope areas. (6) Al1 land intended for building sites can be used safely without endangering the residents by peril from floods, erosion, continuously high water table, severe soil conditions or other menace; Stormwater management and erosion control are the key� to safe development of these sites. Applicants must obtain approval of their erosion control plan prior to the issuance of permits. (7} The subdivision can be economically served with public facilities and services. Applicants must provide a looped water main to the site. All other public facilities are in place and adequate. D. ADDITIONAL FINDINGS: 1 . The preliminary plat has been reviewed by the appropriate city departments and has been found to be acceptable, provided that a looped water main is installed to service the site and that erosion control and retaining wall plans for both during and after construction are su6mitted and approved. 2. The proposed lots 2 and 3 at the northeast corner of the site will have to undergo site plan review prior to construction to address steep slope concerns. F. STAFF RECOMMENDATION: Based on the findings in C and D, staff recommends approval of the preliminary plat for Skyline Oaks subject to the following conditions: 1 .
