WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the City
Council to hoid public hearings to consider the advisability and necessity of ordering the repair or
wrecking and removal of a two-story, wood frame dwelling with a stone foundation and porch supports
and a detached two-stall, wood frame gazage located on properry hereinafter refened to as the "Subject
Properiy" and commonly known as 1216 Reaney Avenue. This property is legally described as follows,
to wit:
Lot 6, Block 2, E. C. Bowen's Addition
WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before July 30, 1999, the following are the now known
interested or responsible parties for the Subject Property: H.U.D. Property Disposition, 220 2° Street
South, 2n Floox, Mpls., MN 55401; First Preston, 900 128`� Street West, Ste 202, Burnsville, MN
55337,
WHEREAS, Division of Code Enforcement has served in accardance with the provisions of
Chapter 45 of the Saint Pau1 Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated September 9, 1999; and
WF�REAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WI�REAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by October 11, 1999; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(s) to constitute a nuisance condition; subject to demolition; and
WHEREAS, this nuisance condition has not been corrected and Division of Code Enforcement
requested that the City Clerk schedule public hearings before the Legisiative Hearing Officer of the City
Council and the Saint Paul City Council; and
WI�REAS, the interested and responsible parties have been served notice in accordance with
the provisions of Chapter 45 of the Saint Paul Legis:ative Code, of the time, date, place and purpose of
the public heazings; and

WIIEREAS, a hearing was held before the Legislative Heuing Officer of the Saint Paul City
Council on Tuesday, February 15, 2000 to heaz tesfvnony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Sub}ect Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating this shucture in
accordance with all applicable codes and ordinances, or in the altemative by demolishing and removing
the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of
the structure to be completed within fifteen (15) days after the date of the Council Hearing; and
WIIEREAS, a hearing was held before the Saint Paul City Council on Wednesday, February 23,
2000 and the testimony and evidence including the action taken by the Legislative Hearing Officer was
considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 1216 Reaney Avenue:
That the Subject Properiy comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then lmown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacanUNuisance Buildings.
That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the foilowing order:
1. The above referenced interested or responsible parties shall make the Subject Property safe and
not detrnnental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and correcting all deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and

1 2. If the above corrective action is not completed within this period of time the Citizen Service
2 Office, Division of Code Enforcement is hereby authorized to take whatever steps are necessary

4 Subject Property pursuant to the provisions of Chapter 45 of the Saint Paul Legislative Code.

3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
properiy or fixtures of any kind which interfere with the demolition and removal shall be
removed from the properry by the responsible parties by the end of this time period. If all
personal properiy is not removed, it shall be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul Legislative Code.

Division of Code Enforcement has declared this building(s) to constitute a"nuisance" as defined
by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by correctins thz deficiencies or
by razing and removing this building(s). �
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a timely
manner, and failin� tt�at, authorize the Division of Code Enforcement to proceed to demolition
and removal, and to assess the costs incurred against the real estate as a special assessment to be
collected in the same manner as taxes.

Gerry Strathxnan stated this property was laid over from February 15 because HUD (Housing and
Urban Development) requested addirional time to sell it.
Steve Magner reported he has not heard any more feedback from HiJD or First Preston
Management Company. They have had three purchase contracts on the property, and none of
them have closed.
Gerry Strathman recommended approval.
Resolurion ordering the owner to remove or repair the building at 358 Aurora Avenue. It
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported this property has been vacant since 10-23-98. Eight suminary abatement
notices haue been issued to remove refuse, cut tall grass, secure dwelling, and remove snow/ice.
On 11-10-99, an inspection of the building was conducted, and a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. The vacant building
fees and real estate taxes are paid. Taxation has placed a mazket value of $53,900 on this
properry. On 1-25-00, a code compliance inspection was completed. A bond has not been
posted. The esfimated cost to repair is $40,000; estimated cost to demolish, $7,500 to $$,500.
Larry Bauer, owner, appeazed and stated Code Enforcement came to the properiy. He thought he
would be sent a list of items to repair, but he never received anything. Mr. Magner responded
Mr. Bauer should have received a copy of the code compliance inspection from Aon Wagner of
the Office of License, Inspections, and Environmental Protection (LIEP).
Mr. Strathman asked is he planning to repair the building. Mr. Bauer responded yes but he did
not know what to do.

The meeting was called to order at 10:02 am.
STAFF PRESENT: Sally Peterson, Code Enforcement

the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.

Sally Peterson reported the building has been vacant since July 1998. The properry owner is
HiJD (Housing and Urban Development). Six summary abatement notices have been issued to
remove refuse, secure the building, and cut tall grass. An inspection was conducted on 8-25-99
and a list of deficiencies which constitute a nuisance condition was developed. Vacant building
fees are not paid. Real estate t�es are paid. Estimated market value of the properry is $48,800;
estnnated cost to repair, $40,000; estimated cost to demolish, $8,000 to $9,000. On 7-2'7-99, a
code compliance inspection was completed. A$2,OQQ bond has not been posted.
Pat Olawsky and Rich Lemcke appeared. Mr. Olawsky stated the properiy was sold for $50,000;
however, that person reneged on the agreement. There were four other offers, and they plan to go
back to these other offers to sell the properry. This may take 45 days at the masimum.
Gerry Strathman asked is the building secure. Ms. Peterson responded yes.
Is the exterior being maintained, asked Mr. Strathman. Mr. Olawsky responded the sidewalks are
being shoveled, and he is personally inspecting the property once a week.
Did Code Enforcement have any problems with the granting of additional time, asked Mr.
Strathxnan. Ms. Peterson responded she spoke to Steve Magner this morning who is fine with
additional time being granted.
Margazet Mudek, 119 E. Isabel, appeared and stated the properiy has been on sale since August
when she first bid on it. A$20,000 bid is not realistic on this building because of the repair work
that is needed. The building is not secured well. The $50,000 estimate quoted by Code
Enforcement may not be conect anymore because the Jacuzzi bathtub has been stolen and the
building has been broken into numerous tunes. The police have been called, the building is
open, the back doors and windows are kicked in. Bids have been $60,000 to fix the building.
The last buyer dropped out of her bid because she could not afford the repairs.

Mr. Strathman asked when the building was last checked. Ms. Peterson responded on January
24.
Gerry Strathman recommended laying over to the Apri14, 2000, Legislative Hearing. This will
allow the owners time to go through the active bidders for the property. If there is not a
successful sale by Apri14, then this matter will be looked at again.
Resolution ordering the owner to remove or repair the building at 411 Sherburne Avenue.
If the owner fails to compiy with the resolution, Code Enforcement is ordered to remove
the building.

Sally Peterson reported the properry was condemned June 1997 and has been vacant since
August 1997. The owner has moved out of state and would like the property demolished.
Habitat for Humanity is planning to build a home on the property. Seven sunuiiary abatement
notices have been issued to remove refuse, secure the building, and cut tall grass. On 10-18-99,
an inspection was done on the property and a list of deficiencies which constitute a nuisance
condition was developed. The vacant building fees are not paid. Real Estate t�es are unpaid in
the amount of $4006.85. The estimated market value is $30,300; estimated cost to repair,
$70,000; estimated cost to demolish, $6,000 to $7,000.

by Legislative Code, Chapter 45. Division of Code Enforcement has issued an order to the then
known responsible parties to eliminate this nuisance condition by correctins thz deficiencies or
by razing and removing this building(s). �
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the community continues to suffer the blighting influence of this property. It is the
recommendation of the Division of Code Enforcement that the City Council pass a resolution
ordering the responsible parties to either repair, or demolish and remove this building in a timely

Gerry Strathxnan stated this property was laid over from February 15 because HUD (Housing and
Urban Development) requested addirional time to sell it.
Steve Magner reported he has not heard any more feedback from HiJD or First Preston
Management Company. They have had three purchase contracts on the property, and none of
them have closed.
Gerry Strathman recommended approval.
Resolurion ordering the owner to remove or repair the building at 358 Aurora Avenue. It
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Steve Magner reported this property has been vacant since 10-23-98. Eight suminary abatement
notices haue been issued to remove refuse, cut tall grass, secure dwelling, and remove snow/ice.
On 11-10-99, an inspection of the building was conducted, and a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. The vacant building
fees and real estate taxes are paid. Taxation has placed a mazket value of $53,900 on this
properry. On 1-25-00, a code compliance inspection was completed. A bond has not been
posted. The esfimated cost to repair is $40,000; estimated cost to demolish, $7,500 to $$,500.
Larry Bauer, owner, appeazed and stated Code Enforcement came to the properiy. He thought he
would be sent a list of items to repair, but he never received anything. Mr. Magner responded
Mr. Bauer should have received a copy of the code compliance inspection from Aon Wagner of
the Office of License, Inspections, and Environmental Protection (LIEP).
Mr. Strathman asked is he planning to repair the building. Mr. Bauer responded yes but he did
not know what to do.

The meeting was called to order at 10:02 am.
STAFF PRESENT: Sally Peterson, Code Enforcement

the owner fails to comply with the resolution, Code Enforcement is ordered to remove the

Sally Peterson reported the building has been vacant since July 1998. The properry owner is
HiJD (Housing and Urban Development). Six summary abatement notices have been issued to
remove refuse, secure the building, and cut tall grass. An inspection was conducted on 8-25-99
and a list of deficiencies which constitute a nuisance condition was developed. Vacant building
fees are not paid. Real estate t�es are paid. Estimated market value of the properry is $48,800;
estnnated cost to repair, $40,000; estimated cost to demolish, $8,000 to $9,000. On 7-2'7-99, a
code compliance inspection was completed. A$2,OQQ bond has not been posted.
Pat Olawsky and Rich Lemcke appeared. Mr. Olawsky stated the properiy was sold for $50,000;
however, that person reneged on the agreement. There were four other offers, and they plan to go
back to these other offers to sell the properry. This may take 45 days at the masimum.
Gerry Strathman asked is the building secure. Ms. Peterson responded yes.
Is the exterior being maintained, asked Mr. Strathman. Mr. Olawsky responded the sidewalks are
being shoveled, and he is personally inspecting the property once a week.
Did Code Enforcement have any problems with the granting of additional time, asked Mr.
Strathxnan. Ms. Peterson responded she spoke to Steve Magner this morning who is fine with
additional time being granted.
Margazet Mudek, 119 E. Isabel, appeared and stated the properiy has been on sale since August
when she first bid on it. A$20,000 bid is not realistic on this building because of the repair work
that is needed. The building is not secured well. The $50,000 estimate quoted by Code
Enforcement may not be conect anymore because the Jacuzzi bathtub has been stolen and the
building has been broken into numerous tunes. The police have been called, the building is
open, the back doors and windows are kicked in. Bids have been $60,000 to fix the building.
The last buyer dropped out of her bid because she could not afford the repairs.

Mr. Strathman asked when the building was last checked. Ms. Peterson responded on January
24.
Gerry Strathman recommended laying over to the Apri14, 2000, Legislative Hearing. This will
allow the owners time to go through the active bidders for the property. If there is not a
successful sale by Apri14, then this matter will be looked at again.
Resolution ordering the owner to remove or repair the building at 411 Sherburne Avenue.
If the owner fails to compiy with the resolution, Code Enforcement is ordered to remove
the building.

Sally Peterson reported the properry was condemned June 1997 and has been vacant since
August 1997. The owner has moved out of state and would like the property demolished.
Habitat for Humanity is planning to build a home on the property. Seven sunuiiary abatement
notices have been issued to remove refuse, secure the building, and cut tall grass. On 10-18-99,
an inspection was done on the property and a list of deficiencies which constitute a nuisance
condition was developed. The vacant building fees are not paid. Real Estate t�es are unpaid in
the amount of $4006.85. The estimated market value is $30,300; estimated cost to repair,
$70,000; estimated cost to demolish, $6,000 to $7,000.

WHEREAS, Citizen Service Office, Division of Code Enforcement has requested the City
Council to hoid public hearings to consider the advisability and necessity of ordering the repair or
wrecking and removal of a two-story, wood frame dwelling with a stone foundation and porch supports
and a detached two-stall, wood frame gazage located on properry hereinafter refened to as the "Subject
Properiy" and commonly known as 1216 Reaney Avenue. This property is legally described as follows,

WHEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before July 30, 1999, the following are the now known
interested or responsible parties for the Subject Property: H.U.D. Property Disposition, 220 2° Street
South, 2n Floox, Mpls., MN 55401; First Preston, 900 128`� Street West, Ste 202, Burnsville, MN
55337,
WHEREAS, Division of Code Enforcement has served in accardance with the provisions of
Chapter 45 of the Saint Pau1 Legislative Code an order identified as an"Order to Abate Nuisance
Building(s)" dated September 9, 1999; and
WF�REAS, this order informed the then known interested or responsible parties that the
structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and
WI�REAS, this order informed the interested or responsible parties that they must repair or
demolish the structure located on the Subject Property by October 11, 1999; and
WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring this
building(s) to constitute a nuisance condition; subject to demolition; and

WIIEREAS, a hearing was held before the Legislative Heuing Officer of the Saint Paul City

and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Sub}ect Property safe and not detrimental to the public peace, health, safety and

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 1216 Reaney Avenue:
That the Subject Properiy comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.

That the costs of demolition and removal of this building(s) is estimated to exceed three
thousand dollars ($3,000.00).
That there now exists and has existed multiple Housing or Building code violations at the
Subject Property.
That an Order to Abate Nuisance Building(s) was sent to the then lmown responsible
parties to correct the deficiencies or to demolish and remove the building(s).
That the deficiencies causing this nuisance condition have not been corrected.
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacanUNuisance Buildings.
That the known interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the foilowing order:
1. The above referenced interested or responsible parties shall make the Subject Property safe and

removed from the properry by the responsible parties by the end of this time period. If all
personal properiy is not removed, it shall be considered to be abandoned and the City of Saint
Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties
in accordance with Chapter 45 of the Saint Paul Legislative Code.

Gerry Strathxnan stated this property was laid over from February 15 because HUD (Housing and
Urban Development) requested addirional time to sell it.
Steve Magner reported he has not heard any more feedback from HiJD or First Preston
Management Company. They have had three purchase contracts on the property, and none of
them have closed.

Steve Magner reported this property has been vacant since 10-23-98. Eight suminary abatement
notices haue been issued to remove refuse, cut tall grass, secure dwelling, and remove snow/ice.
On 11-10-99, an inspection of the building was conducted, and a list of deficiencies which
constitute a nuisance condition was developed and photographs were taken. The vacant building
fees and real estate taxes are paid. Taxation has placed a mazket value of $53,900 on this
properry. On 1-25-00, a code compliance inspection was completed. A bond has not been
posted. The esfimated cost to repair is $40,000; estimated cost to demolish, $7,500 to $$,500.
Larry Bauer, owner, appeazed and stated Code Enforcement came to the properiy. He thought he
would be sent a list of items to repair, but he never received anything. Mr. Magner responded
Mr. Bauer should have received a copy of the code compliance inspection from Aon Wagner of
the Office of License, Inspections, and Environmental Protection (LIEP).
Mr. Strathman asked is he planning to repair the building. Mr. Bauer responded yes but he did
not know what to do.

The meeting was called to order at 10:02 am.
STAFF PRESENT: Sally Peterson, Code Enforcement
Resolution ordering the owner to remove or repair the building at 1216 Reaney Avenue. If

Sally Peterson reported the building has been vacant since July 1998. The properry owner is
HiJD (Housing and Urban Development). Six summary abatement notices have been issued to
remove refuse, secure the building, and cut tall grass. An inspection was conducted on 8-25-99
and a list of deficiencies which constitute a nuisance condition was developed. Vacant building
fees are not paid. Real estate t�es are paid. Estimated market value of the properry is $48,800;
estnnated cost to repair, $40,000; estimated cost to demolish, $8,000 to $9,000. On 7-2'7-99, a
code compliance inspection was completed. A$2,OQQ bond has not been posted.
Pat Olawsky and Rich Lemcke appeared. Mr. Olawsky stated the properiy was sold for $50,000;
however, that person reneged on the agreement. There were four other offers, and they plan to go
back to these other offers to sell the properry. This may take 45 days at the masimum.
Gerry Strathman asked is the building secure. Ms. Peterson responded yes.
Is the exterior being maintained, asked Mr. Strathman. Mr. Olawsky responded the sidewalks are
being shoveled, and he is personally inspecting the property once a week.
Did Code Enforcement have any problems with the granting of additional time, asked Mr.
Strathxnan. Ms. Peterson responded she spoke to Steve Magner this morning who is fine with
additional time being granted.
Margazet Mudek, 119 E. Isabel, appeared and stated the properiy has been on sale since August
when she first bid on it. A$20,000 bid is not realistic on this building because of the repair work
that is needed. The building is not secured well. The $50,000 estimate quoted by Code
Enforcement may not be conect anymore because the Jacuzzi bathtub has been stolen and the
building has been broken into numerous tunes. The police have been called, the building is
open, the back doors and windows are kicked in. Bids have been $60,000 to fix the building.
The last buyer dropped out of her bid because she could not afford the repairs.

Mr. Strathman asked when the building was last checked. Ms. Peterson responded on January
24.
Gerry Strathman recommended laying over to the Apri14, 2000, Legislative Hearing. This will
allow the owners time to go through the active bidders for the property. If there is not a
successful sale by Apri14, then this matter will be looked at again.

an inspection was done on the property and a list of deficiencies which constitute a nuisance
condition was developed. The vacant building fees are not paid. Real Estate t�es are unpaid in
the amount of $4006.85. The estimated market value is $30,300; estimated cost to repair,
$70,000; estimated cost to demolish, $6,000 to $7,000.
