Bi�ard Appzoval • ' � /7a� ., HU'li Approval ' �� � �ontract 84-47 DRAFr CONSOLIDATID COOPERATION ACzf2F.II�LVT � This Agre�nent entered into this day of , 198 , by and between the PUBLIC HOUSING AGII�ICY OF Tf� CITY OF SAIlVT PAUL (herein called the '"PHA") and the CITY OF SAINT PAUL, �SOTA (herein called the "City") ; WITNESSETH: j�AS, The Housing and Redevelopment Authority of the City of Saint Paul, �Iinnesota (herein called "HRA") and the City have previously entered into the following: � A) Cooperation Agreement dated January 26, 1950, for 2,000 Dwelling Units (D.U.) with amenc�nents thereto dated; October 28, 1960 for O.D.U.; August 3, 1962 for 250 D.U. ; and October 29, 1964 for 800 D.U. respectively; B) Cooperation Agreement dated June 19, 1967 for 1500 D.U.; and C) Cooperation Agre�nent dated March 14, 1972 for 1200 D.U.; and 4��REAS, the Public Housing Agency of the City of Saint Paul was created by Chapter 228 of the Laws of P�iinnesota, 1977; and �5, pursuant to Chapter 228 the PHA succeeded to all the rights, duties, titles and obligations of the HRA relating to the provision for and administration of the public housing proqram for the City; and W�REA.S, the previously executed Cooperation Agreements and 1�nenc�ments are not uniform in their application to dwelling units awned and achnirr� ��iA; and WI�REA.S, it is the intent of the parties hereto, that t�e rreviously_.e�ecuted Cooperation Agre�nents arid Amer�.nts be declared null and void and be replaced by . this Agreesr�nt which expresses the entire understariding between the parties with respect tr� the subject matter oontai.ned herein. Agreement to all qualified dw�elling units; - NOW, TI�REFORE, in consideration of the mutual covenants hereinafter set forth, the parties do hereby agree as follaws: A. Whenever used in this Agre�nent: l. The term "Development" shall mean any existing low-rent housing or law-rent housing hereafter developed or aoquired by the PHA with financial assistance frori the United States of America, acting through tne Secretary of Housing and Urban Development (herein called the �'Goverrunent") . 2, The term "Taxing Body" shall mean the State or any political sub- division or taxing unit thereof in which a Development is situated and which would have authority to assess or levy real or personal - pr�perty taxes or to certify stich taxes to a taxing body or public officer to be levied for its use and benefit with respect . to a Development if it w�se not exe�npt fran taxation. 3. The term "Shelter Rent" shall mean the total of all charges to all i residents of a Development for dwelling rents and non-dwelling i: rents (excluding all other incon�e of such Develo�nent) , less the �� j: {: costs to the P:�, of all dwelLing and non-dwelling utilities and special services such as heat, water, electricity, gas, sewage disposal or qarabage removal. F. During the period comnencing with the date of the acquisition of any part , of the site or sites of any Development and continuing so long as either: (a) Such Development is awned by a public body or governmental agency and is used for laa-rent housing purposes, or (b) Any contract between the PHA and the Goverrunent for loans or annual contribution, or both, in connection with such Development remains in force and effect, or (c) Any bonds issued in connection with such Development or any mr�nies due to the Government in connection with such Development r�riain unpaid, whichever period is the longest, the City without cost or charge to the � i PF�, or tthe residents of such Development (other than the PIU7r and Service ` Charges payment) shall insofar as it is lawfully able to do so: : l. Grant such deviations from the building code of tne City as are reasonable arid necessary to prcenote ecoriomy and efficiency in the �mprovement and ac�inistration of such Development, and at the same tu� safeguard health and safety; and 4. Make such changes in any zoning of the site and surrounding territory of such Development as are reasonable and necessary for the develop�- ment and protection of such Develo�enent and the surrounding territory; 5, Accept grants of easer►ents necessary for the improvement of such Development; and 6. Cooperate with the P1� by such other lawful action or ways as the . City and the PHA may find necessary in connection with the improv�it . i ' and ac�trninistration of such Develo�nent. � 7, Provide such services as are normally provided to other inhabitants or dwellings in the City for which the PHA will pay the City a service charge as stipulated elsewhere in this agre�nent. 8. Within a reasonable time after receipt of a written request from the PHA, the City will accept necessary dedications of land for, and will grade, improve, pave, and provide sidewalks for, all streets bounding such Development or necessary to provide ade-•• quate access thereto (in consideration whereof the PHA shall pay to the City the amount that would be assessed against the Develop-- ment site for such work if the site were privately awned) ; and 10.
