An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, F & M Leasing Corporation duly petitioned to rezone Lot 4 Block
5, Kipps Glen Terrace, located on the west side of Glen Terrace between Agnes and
Benson, from R-4 to I-1 for the purpose of providing additional off-street parking
for an existing warehouse, the petition having been certified by the Planning
Division on November 6, 1984, as having been consented to by at least 67% of the
owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated within
100 feet of the total contiguous property within one year preceding the date of
the petition; and
WHEREAS, The Zoning Committee on November 15, 1984, conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on November 16, 1984, and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
November 24, 1984, and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
December 6, 1984, where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 35 as incorporated by
reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows :
That property located on the west side of Glen
Terrace between Agnes and Benson being more

Section 2.

Dear Sir:
On November 15, 1984, the Zoning Comnittee of the Planning Comnission
held a public hearing on this rezoning. Petitioner was present and
testified. There was no other testimony, and no correspondence was
received on the case. At the close of the public hearing the Committee
voted 6-0 to recomnend approval of the rezoning to I-1.
On November 16, 1984, the Planning Commission upheld the Zoning
Committee's recommendation on a voice with one member voting no.
This rezoning is scheduled to be heard by the City Council on December
6, 1984. Please let me know by December 5th if any member of the City
Council wishes to have slides of the site presented at the public
hearing.

1. Petitioner proposes expanding the existing parking area onto this lot. The
zoning code requires that parking be located in the same zoning district as the
' pricipal use or in a P-1 district.
2. The Land Use component of St. Paul ' s Comprehensive Plan recommends �encouraging
labor intensive light industry but recognizes that labor extensive uses such as
warehousing are also needed.
3. The Land Use Plan supports buffering between land uses.
4. The Economic Development Strategy of the Comprehensive Plan states that the
city' s first priority shall be to meet the expansion needs of local firms.
5. The District 9 Plan recommends that existing land uses remain essentially the
same and that industrial uses should not be expanded.
6. The intent of the I-1 district is to accommodate �rholesale and a�arehouse
activities and industrial opperations whose physical effects do not affect
surrounding districts in a detrimental way.
7. If the rezoning is approved, a site plan must be submitted prior to
construction of the parking lot. A visual screen will be reyuired along the
northern property line to buffer the neighboring residence. Other landscaping
raill also have to be provided.
8. The lot does not meet R-4 standards in �that it does not have 5,000 sq. ft. of
area. _

H. STAFF ArJALYSIS: Approving the rezoning v�ill allow peitioner to expand the parking
area an���•iill provide an opportunity for more effective buffering of the parking
from the neighboring residential uses. Because of the setbacks reyuired for
structures if an I-1 district adjoins a residential district , the liklihood of a
building being constructed on this lot are slim. The proposed rezoning is not a
major change to the existing land uses in the area and will not permit a
substantial expansion of the industrial use, so the proposal is not in direct
conflict with the District 9 Plan.
I. STAFF RECOMA1ENDATION: Based on findings 1-8 and the staff analysis , staff
recommends approval of the rezoning to I-1.

R An Ordinance amending Chapter 60 of the Saint Paul
� Legislative Code pertaining to zoning for the City
s of Saint Paul and the zoning maps thereof.

� WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, F & M Leasing Corporation duly petitioned to rezone Lot 4 Block
5, Kipps Glen Terrace, located on the west side of Glen Terrace �etween Agnes and
Benson, from R-4 to I-1 for the purpose of providing additional off-street parking
for an existing warehouse, the petition having been certified by the Planning
Division on November 6, 1984, as having been consented to by at least 67% of the
owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated within
100 feet of the total contiguous property within one year preceding the date of
the petition; and
WHEREAS, The Zoning Committee on November 15, 1984, conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREASa_ The Planning Commission considered the rezoning petition at its
meeting held on November 16, 1984, and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said-
rezaning petition was duly published in the official newspaper of the City on
November 24, 1984, and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on

considered a1T the facts and recommendations concerning the petition; now,
therefore,

reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:

Section 2.
