The only alley access is provided by a driveway easement across Parcel B. Parcel B is an "L" shaped lot occupied by a 12-unit apartment building with a 4-car garage off the alley. C. The site is currently 2 parcels under single ownership. One parcel consists of the duplex and 2 garages (a 3-car garage and a 4-car garage) , and the other parcel consists of the 12-unit apartment building. 2. The owner proposes combining the 4-car garage with the apartment building and retaining the 3-car garage on the remaining duplex lot. 3. The apartment building is currently a legal nonconforming use. The proposed division will give the apartment building a more nearly conforming lot area while maintaining all necessary requirements for the duplex. 4. The division meets all requirements of Sections 67.304 and 67.406 of the Zoning Code. 5. The division will not be detrimental to the present or potential development on the site nor to the neighboring property. G. WHEREAS, the Division of Housing and Building Code Enforce- ment, on behalf of the City Council did notify by mail the above noted parties of interest at their last known address; 4VHEREAS, a public hearing was held by and before the Council of the City of Saint Paul in the Council Chamber of the Court House in said city at 10 : 00 a.m. on Thursday, November 8, 198:4, to con- sider the advisability and necessity of ordering the correction or wrecking and removal of said structure on the above described property inasmuch as said structure is reported to constitute a hazard to public health, safety and welfare; WHEREAS, upon the facts presented at the said hearing consist- ing of photographs, inspection reports and the recommendation of the Building Department, it is further determined that the above building constitutes a hazardous building within the definition of Minnesota Statutes 463 .15 for the following reasons: 1 . This building is hazardous because of age, deterioration, lack of proper maintenance and the following list of deficiencies : a. Some: of the roof shingles are missing; b. The roof sheathing has rotted boards and several holes; c. The floor above the west side ceiling joists have rotted boards and holdes; d. The interior of the garage has piles of debris (fiber board scraps and tree limbs and branches) ; e. The windows are broken; f. The siding is worn; 2 . This building is creating a nuisance; 3. This building contributes a blighting influence on the neighborhood; 2 . , • r . ` �-� ��/-/�i-3�� now, therefore, be it, RESOLVED, That in accordance with Minnesota Statutes Sections 463 . 15 through 463. 25 and based upon the foregoing findings of the City Council, the Council of the City of Saint Paul does hereby make the following Order: ORDER l. The owners of the above described building shall make the same safe and not detrimental to the public peace, health and safety and welfare by having the said building razed and the materials therefrom removed from the premises within thirty (30) days from the date of the service of this Order; 2. Unless such corrective action is taken to comply with this Order or an Answer served upon the City of Saint Paul and filed in _ the office of the Clerk of the District Court of Ramsey County, Minnesota, within twenty (20) days from the date of the service of this Order a Motion for Summary Enforcement of this order to raze and remove the said building will be made to the Ramsey County District Court; 3. In the event that the building is to be razed by the City of Saint Paul pursuant to judgment of the District Court, all personal property or fixtures of any kind which may unreasonably interfere with the razing and removal of this building shall be removed within ten (10) days from the entry of judgment; and if not so removed, the City of Saint Paul shall remove and dispose of such personal property and fixtures as provided by law; 4 .
