RESOLVED, 'that upon execu�ion and delivery of a release in
full to the City of Saint Paul, the proper City officers are hereby
authorized and directed to pay out of the Tort Liability Fund
09070-511-000 to Scott Kolbeck the sum of $250 . 00 in full settlement
of his claim for damages sustained November 13 , 1982, as more
particularly set out in a communication to the City Clerk on
May 16, 1983 .

RE: Claim against the City of Saint Paul
by Scott Kolbeck
This is a request for the sum of $250 for complete settlement of
the claims of Scott Kolbeck.
Scott Kolbeck sued the City for false arrest, false imprisonment
and assault. The claim arises out of plaintiff ' s arrest on
November 13 , 1982 for obstructing legal process. The situation
involved a barroom fight and subsequent arrest of many individuals .
The charges against Mr. Kolbeck were later dropped.
Mr. Kolbeck claims he was an innocent bystander, who did not even
know the individual who was being arrested at the time he allegedly
jumped into the fight. He claims it is a case of mistaken identity.
The officers involved, however, feel confident about their identifi-
cation of Mr. Kolbeck.
Under the circumstances I feel it is a fair settlement amount.
