An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Baker West Partners duly petitioned to rezone property legally
described as That part of Lot 20, Block 79, St. Anthony Park and that part of Lot
8, Auditor's Subdivision No. 4 and that part of vacated Ellis Avenue and that part
of the Alley which lies northerly of Ellis Avenue vacated and northeasterly of
said Lot 20, described as follows: Beginning at the southeast corner of said lot
20; thence southwesterly to a point on the northeasterly line of Territorial Road, �
said point being 323.82 feet northwesterly from the most southerly corner of Lot
9, Auditor' s Subdivision No. 4; thence northwesterly along the northasterly line
of Territorial Road, to a line drawn parallel with and 135 feet at right angles
southeasterly from the southeasterly line of Hunt Place; thence northeasterly
along said parallel line and its extension, to the northeasterly line of said
Alley, thence southeasterly along said Alley to the north line of vacated Ellis
Avenue; thence west to beginning, located on the northerly side of Territorial
Road between Raymond Avenue and Hunt Place from RM-2 to P-1 for the purpose of
providing additional off-street parking for Baker Court, the petition having been
certified by the Planning Division on August 2, 1984 as having been consented to
by at least 67% of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WNEREAS, The Zoning Committee on September 20, 1984 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on September 28, 1984 and recommended that the City Council approve
the petition; and

Dear Sir:
On September 20, 1984, the Zoning Comnittee of the Planning Corr�nission
held a public hearing on this rezoning. No one appeared in support or
opposition. At the close of the public hearing, the Committee voted 7
to 0 to recommend approval of the rezoning.
On September 28, 1984, the Planning Comnission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on October
18, 1984. Please notify me by October 17, 1984, if any member of the

F. FINDINGS•
1. Petitioners propose rezoning this residentially zoned land to provide
additional parking for the businesses to the east. Rezoning the property to P-
1 prevents the land f rom being used for commercial expansion without another
rezoning.
2. Approval of a rezoning to P-1 is conditioned on 8 findings:
a. The parking lot is accessory to a business use and adjoins the use's
zoning lot, meeting the first condition;
b. The parking lot will be closed when the business-uses are closed, meeting the
second condition. However, the lot must remain accessible to the
residences to the north so that they can use their garages;
c. No loading area is shown on the site plan, and the parking space dimensions
are designed only for private passenger vehicles, meeting the third
condition;
d. Petitioners will not use the lot for repair work, service, or sales,
meeting the fourth condition;
e. Petitioners propose no signs on the lot; the fifth condition does not

screening along the alley to the north and a wall along the minimum setback
line. A condition attached to the approval requires intensive landscaping
along the south and west perimeters of the lot. With these variances, the
site plan meets the requirements of Sec. 62.104 and thus the last

Pursuant to your request, I have prepared the following property
description for the purpose of rezoning land west of and adjacent '
to Baker Court for additional parking.
That p art of Lot 20, Block 79, St. Anthony Park and that part
of Lot 8, Auditor' s Subdivision No. 4 and that part of vacated
Ellis Avenue and that part of the Alley which lies northerly
of Ellis �venue vacated and northeasterly of said Lot 20, de-
scribed as follows :
Beginning at the southeast corner of said Lot 20; thence
southwesterly to a point on the northeasterly line of Terri-
torial Road, said point being 323.82 feet northwesterly from
the most southerly corner of Lot 9, Auditor's Subdivision
No. 4; thence northwesterly along the northeasterly line
of Territorial Road, to a line drawn parallel with and 135
feet at right angles southeasterly from the southeasterly
line of Hunt Place; thence' northeasterl� along said parallel
line and its extension, to the northeasterly line of said
�lley; thence southeasterly along said l�lley to the north
line of vacated Ellis f�venue; thence west to beginning.
It is understood that this is to be used only for rezoning, that
the alley has not yet been vacated, that the boundaries of this
tract and the proposed plat of Baker West Townhomes will depend
on the vacation, and that the plat will include the above as a
separate lot.
