An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Mounds Park United Methodist Church duly petitioned to rezone
Lots 14, 15, and 16 of Block 2, H. F. Schwabe' s Addition located on the southeast
corner of Euclid Avenue and Earl Street from R-4 to P-1 for the purpose of
providing off-street parking for church use, the petitivn having been certified by
the Planning Division on September 13, 1984 as having been consented to by at
least 67� of the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of the property
situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Zoning Committee on October 4, 1984 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on October 12, 1984 and recommended that the City Council approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 23, 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
November 1, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 22, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows :
That property located on the southeast corner of
Euclid Avenue and Earl Street, being more
particularly described as Lots 14, 15, and 16 of
Block 2, H.F. Schwabe's Addition, be and is hereby
rezoned from R-4 to P-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.

Dear Sir:
On October 4, 1984, the Zoning Committee of the Planning Corr�nission held
a public hearing on this rezoning. The petitioners were represented.
There was no other testimony at the hearing. At the close of the public
hearing, the Committee voted 7 to 0 to recomnend approval of the
rezoning to P-1 based on the findings in the staff report.
On October 12, 1984, the Planning Comnission upheld the Zoning
Committee's recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on November
1, 1984. Please notify me by October 31, 1984, if any member of the
City Council wishes to have slides of the site presented at the public
hearing.

The meeting was chaired by Joseph Pangal , Chairman.
MOUNDS PARK UNITED METHODIST CHURCH (#9641) : Rezone property located at
the southeast corner of Euelid and Earl from R-4 to P-1 to allow a 41-
car parking lot.
The applicant was present. There was no opposition present at the
hearing.
Pts. James showed slides and reviewed the staff report with a
recommendation for approval subject to approval of the final site plan.
She farther stated that 3 letters were received in support.
Mr. McGuire stated that the petitioner had submitted a revised site plan
and that it meets all conditions for approval .
Hearing no testimony, Mr. Pangal closed the public hearing portion of
the meeting. �
Ms. Morton asked if District 4 had . any commen�.
'� P1s. James stated that staff had not received anything.
Mr. McGuire said that he attended a Land Use Committee meeting of
District 4, and that this matter was considered. He said that the Land
Use Committee was in support, but that the full community council had
not considered the issue yet. .
Ms. Zieman asked if the fence along the al.ley would be 6 feet or 4.5
feet.
Bill Rasmussen, 1314 E. 3rd, representing the church, stat�ed that he
drew the site plan. He said that they proposed a 6 foot fence to
block the view of the parking lot. He further stated that staff has
recommended a 4.5 foot fence, and that he has no objection to that.
Mr. Galles then asked why the lot was to be closed when not needed for
church activities.

Ms. James stated that the P-1 distr9ct was not intended for general
purpose lots with anyone parking in it at any time. It should only be
available to the church.
- . Mr. Levy moved approval of the rezoning based on findings 1 and 2 of the

seconded the motion, which passed on a roll call vote of 7 to 0.

1. Petitioner proposes removing the existing house and garage and constructing a
41-car parking lot.

a. The parking lot will be accessory to the church and is located across Earl
from it, meeting the first condition.
b. Petitioners have not submitted a shared parking agreement. Their site plan
should be revised to show how the parking lot will be closed off when it is
not needed for church activities in order to meet the second condition.
c. The proposed lot does not show any loading area, meeting the third
condition.
d. The petitioner has not proposed any sales or repair work or any other
commercial use, meeting the fourth condition.
e. Petitioner's site plan shows no signs on the lot, meeting the fifth
condition.
f. Petitioner proposes no bui]dings, meeting the sixth condition.
g. Petitioner has submitted a parking plan in compliance with the seventh
condition.
h. The site plan is being reviewed by city staff. The following cor�nents have
been received: -
(1) A visual screen (fence or landscaping) should be provided along the
front setback 1ine;
(2) Compact spaces should be identified on the site; �
(3) The lot must be closed off when not needed for church activities;

(5) Petitioner proposes a 6' high fence along the alley on top of the
retaining wall . A 4.5' wall would be sufficient; and
(6) The existing sanaitary sewer connection to Euclid must be properly
abandoned and the storm sewer connection must be properly constructed.
G. STAFF RECOMMENDATION: Based on findings 1 and 2, staff recommends approval of the
rezoning to P- provided that the final site plan complies with city standards.

� WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
� Legislative Code, Mounds Park United Methodist Church duly petitioned to rezone
C� Lots 14, 15, and 16 of Block 2, H. F. Schwabe' s Addition located on the southeast
corner of Euclid Avenue and Earl Street from R-4 to P-1 for the purpose of �
providing off-street parking for church use, the petition having been certified by
the Planning Division on September 13, 1984 as having been consented to by at
least 67� of the owners of the area of the property to be rezoned, and further
having been consented to by at least two-tnirds of the owners of the property
situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Zoning Committee on October 4, 1984 conducted a public hearing �
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting hel-d on October 12, 1984 and recommended that the City Council approve the
petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 23, 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought ta
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
November 1, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

� by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
