THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 15, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
That property located on the south side of York
Street between Flandrau and White Bear Avenues being
more particularly described as Lot 2, Block 3,
Birmingham Park Addition be and is hereby rezoned
from R-4 to P-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.

Dear Sir:
On August 16, 1984, the Zoning Committee of the Planning Corrmission held a
public hearing on this rezoning. At the close of the public hearing,
the Comnittee voted to lay the matter over to its September 20, 1984
meeting to enable the applicant to obtain the necessary variances from
the Board of Zoning Appeals.On September 20, 1984, the Zoning Committee
again considered the rezoning petition. The petitioner was present to
answer questions. The staff reported that the necessary variances had
been obtained from the Board of Zoning Appeals. At the close of the
public hearing, the corrrnittee voted 7 to 0 to recommend approval of this
rezoning to P-1.
On September 28, 1984, the Planning Comnission upheld the Zoning Comnittee's
recorrmendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on October 18,
1984. Please notify me by October 17, 1984, if any member of the City
Council wishes to have slides of the site presented at the public
hearing.

A. PURPOSE: Rezone property from R-4 to P-1 to construct a 10 car parking lat for the
East Side Medical Clinic.
6. SUFFICIENCY: Petition found sufficient by Planning Division on July 30, 1984.
Parcels eligible: 18; parcels needed: 12; parcels signed: 12.
C. PARCEL SIZE: 40' (York) by 148.63' = 5,942.2 sq. ft.
D. EXISTING LAND USE: Lot 2 is currently used as side yard for the house to the west.
A large garage currently occupies the center of the site. There is a steep bank
along the York frontage and a gentler slope along the alley.
E. SURROUNUING LANU USE:
North: Single family residential (R-4)
East: Multi family residential with chiropractic office (RM-2)
South: East Side Medical Clinic (B-2)
West: Single family residential (R-4)
F. ZONING HISTORY: In 1980, the City Council denied a petition to rezone the rear of
lots 2 and 3 to P-1 for parking accessory to the clinic.
G. FINDINGS: �
1 . Petitioner proposes a 10 car parking lot accessory to the medical clinic to the
south. The existing garage will be removed in order to provide the parking.
2. Approval of a rezoning to P-1 is conditioned on 8 findings:
a. The parking lot shall be accessory to and for use in connection with a .
business. There may be a public alley between the P-1 district and the
district to be served.
The proposed parking lot vrill be accessory to the East Side Medical Clinic
and is across the alley from the site. .
b. The parking lot shall not be used during hours when the principal use is
not in operation. During such periods, the parking lot shall be
inaccessible for public use.
Petitioner is negotiating a shared parking agreement with the owner of the
apartment building� to the east. Residents will be able to park in the lot
after clinic hours.
c. The parking lot shall be used solely for the parking of private passenger
vehicles and not for off-street loading.
Petitioner's site plan shows no space for off-street loading of any kind.
d. No commercial repair work or service of any kind or sales shall be
conducted on the parking lot. Petitioner ,�does not propose using the lot
for repair. � •

e. No signs of any kind, other than signs designating entrances, exits and
conditions of use shall be maintained on such parking lot.
f�etitioner proposes one sign that states "please exit an York cr White
Bear" at the southwest corner of the parking area, and a stop sign at the exit on
York. Given the layout of the parking lot, traffic will be moving toward
the York Street exit. Signs should be placed on the parking lot showing �
entrance only at the alley and exit only at York.
f. No buildings other than that for attendant shelter shall be erected on the
premises. �
Petitioner does not propose an attendant shelter.
g. Applications for the rezoning shall be made by submitting a dimensional
layout of the area requested showing the intended parking plan.
Applicant has submitted such a plan.
h. P-1 districts shall be developed and maintained in accordance with the
. requirements of Section 62.104.
On September 11 , 1984, the Board of Zoning Appeals approved variances of
minimum distance between the entrance to the parking lot and the adjacent
R-4 lot; and the requirement for a wall along the minimum setback line.
3. Applicant is removing required parking for the residential use to the west.
This parking must be replaced. This can be done by providing a parking pad off
the alley at the rear of lot 3, as shown on the revised site plan.
H. STAFF RECOMMEI�DATION: Based on findings 1-3, staff recommends approval of the
rezon�ng to P-1.

Agreement: It is agreed that the lot will remain open when not used
by the East Side Medical Center so that occupants or visitors of
occupants of the apartment dwelling at 905 White Bear Avenue may

variance being granted by the Board of Zoning Appeals. Nis, James stated
that they can do this, but the recammendation will still have to wait to
go to the City Council. .

stated that the� current proposed rezoning would have better traific flow
and reduced alley access.
Dr. Richard Sells, 891 4lhite Bear Avenue, representing the East Side
, � P4edical Clinic, stated that they need additional parking space for their
customers. The customers have been using or�street parking in front of
neighboring house�, and the residents of these houses object. They have
applied for a variance, and expect it to be approved. He further stated
that the 1980 rezoning �iould have created additional traffic in the �
alley, and that ihe current site plan has an alley entrance ar.d exit
onto York.

Bordered on the east by a stone wall 1 to 2 feet high �
on the south end and gradually increasing to 4 feet high �
in the middle to north end. ,

Adjacent to the wall, the lot eZevation is about one �
foot higher than the wall. ,
An oId garage measuring 20 x 24 feet occupies the middle I
of this lot at the highest point.
The North end of the lot has a 4 foot grass bank � �,
which rises abruptly above the sidewalk with a '
gradual elevation to about 5 feet in the middle of
the iot. '
The south end of the lot rises abruptly 3 feet above
the alley with a grass bank. From this point, there
is a gradual eievation to the middle of the lot about
4 feet above the alley.
The garage driveway runs down on the north side to the �
street between lots 2 and 3.

The Plan: The first step is to remove the garage. Excavation �
would involve removal of large amounts of dirt from "'
the lot to bring the center of the lot about 3 feet � '
' lower than its present level. The excavation would � t
be done so that the center would be slightly lower `:��
than the east and west side all the way from the front � ~..�'
to the back of the lot. There would be gradual •-•.�:
incline from the alley at the south end to the midclle A�'
of the lot, and then a gradual decline from the middle �
to the north end. �

DR.AINAGE Plan: Ali drainage would slope from the edges to the center
� of the lot, and then from the center to the north and
south so that all of the water would drain to the alley
on the south and to York Street on the north.
Set Back: On the north end of this parking lot, there would be
a set-back from j/o�E #ve to conform with that of the house
on the west and the apartment on the east.
Landscaping: An exit driveway will come from the parking area to
York Street on the north. Attractive bushes and low
shrubbery will be placed in a crushed rock setting
adjacent to this exit driveway. It is our intention
to keep this area of parking and adjacent Iandscaping
clean and attractive at all times. ,

Parking Surface: A blacktop surface will be instal.led where cars
are to park with markers indicating the spaces for
each vehicle. Crushed rock will be placed in
the 4 foot set backs from the lot lines on
the east and west sides of the parking area.
Other Features: A sign will be piaced on the southwest corner of
; ;" . the parking area, which will read, "Please Exit '
� '� on York or White Bear" . At the exit on York, a
; � = STOP sign will be placed. This parking lot should

An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
� of Saint Paul and the zoning maps thereof.

� WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and � 64.210 of the
� Legislative Code, Richard J. Sells, duly petitioned to rezone Lot 2, Block 3,
�6 Birmingham Park Addition located on the south side of York Street between Flandrau
� and White Bear Avenue from R-4 to P-1 for the purpose of providing off-street
parking for a medical clinic, the petition having been certified by the Planning
Division on July 3Q, 1984 as having been consented to by at least 67% of the
owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated within
100 feet of the total contiguous property within one year preceding the date of
the petition; and .
WHEREAS, The Zoning Committee on September 20, 1984 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting hel-d on September 28, 1984 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the C�ty Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 6, 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the praperty sought to
be rezoned; and
WNEREAS, A public hearing before the City Council , having been �onducted an
October 18, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the �etitfon; now,
therefore, •
