THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section l. That Section 402.01 of the Legislative Code be and is hereby amended so as to add a new subdivision thereto: Subd. 4. Limitatian of Number of Bingo Licenses. No more than 60 ingo icenses s a e issued or permitted to be issued in the City of Saint Paul. This restriction shall apply only to bingo licenses issued for two or more bingo dates during a 12-month period. This limitation shal.l apply to licenses issued by the City of Saint Paul and to licenses issued by the A4innesota State Charitable Gambling Control Board. Section 2. That Section 402.03, subdivision l of the Legislative Code be amended to read as follows: 402.03. Licensing requirements. Subdivision 1. Application. Any eligible association desiring to be licensed shal]. apply in duplicate to the inspector on a form to be supplied by the inspector. The application shall state the dates and times on which permission to play is requested, a complete listing of the names and addresses of all members as of the date of the appli- cation, and such other information as the inspector may request, and shall be accompanied by an itemized record of all receipts and disbursements of the appli- cant organization for the preceding calendar year, signed and verified by an officer of the applicant organization. Together with the application, the bingo manager shall file with the city the fidelity bond in the amount of $10, 000 as required by Laws of Minnesota for 1976 , Chapter 261, Section 7. Notwithstanding any other provision of law, said bond requirement shall not be waived. The application shall contain a statement (s) certified to on behalf of nonprofit or charitable organizations which received bingo pr:oceeds during the past year from the organization setting forth the amounts of monies received and the purposes for which the monies were spent. Section 3. That Section 402 . 04, subdivisions 1, 3, 4, 5, 7 and 10 of the Legislative Code be amended to reac7 as follows: Subdivision 1. Limitation on rent. Reasonable charges may be paid by an organization conducting bingo for rent of a hall or other place in which to conduct bingo, for rental of bingo cards and other equipment and for maintenance and janitorial service, but such charges per four hour session shall not exceed a-�e�a�-e�- 39-ge�-�e�t�-l�ee��-sess}en; $100 for rent, $15 for use af kitchen, and $15 f'or hall cleanup, nor a total of 130, except that for good cause s own, t e council may by resolution approve a higher renta]. fee. No organization conducting the game of bingo in accordance with this chapter shall conduct the game in any building or structure which is not licensed pursuant to Chapter 403. Subd. 3. Members only to operate bingo. The game of bingo can be conducted only by the members of the association. No member shall receive any compensation in excess of $20 per bingo session for -2- . - � � � � .� � �'� -,�`�y�. ��> �1 r his services in conducting, assisting in conducting or operating said game, from which required social security taxes and withholding taxes shall be deducted. No person shall so assist in operating the game unless he shall have been and shall be a member or the spouse of a member, in good standing, of said organization . Every person, while helping in the operation of any bingo game, shall carry a membership card or other certificate showing that he is a member or spouse of a member in good standing of the sponsoring organi- zation. No person who operates or assists in the operation of bingo or the spouse of said person shall play bingo at any time in any bingo l�a�� game where said person operates or assists in the operation of bingo. Organi- zations may expend up to 100 per year from bingo receipts for dues or mem ership in a bingo trade association. Subd. 7. Prizes. Award of prizes made in connection with the conduct of said game shall not require prior participation in a bingo game. Prizes far a single bingo game shall not exceed $100 except prizes for a game of the type commonly known as a "cover-all° game. "Cover-all" prizes may exceed $100 provided that the aggregate value of such prizes for a bingo occasion shall not exceed $500 . Merchan- dise prizes shall be valued at fair market price. For purposes of this chapter "prizes" do not include free plays awarde . Subd. 10. Game conduct and procedure. (1) Public view of proceedings. All bingo games shall be conducted in full view of the public and all accounting for and changing of money shall take place in the same room or hall in full view of game participants. (2) Numbers . The selection and calling of numbers shall be in view of game participants and all numbers called shall be determined by chance by use of a fix-proof device of a kind approved by the inspector. (3) The organization sha11 maintain in full public view a recor o t e n er o ingo games p ayed or t at is eing p aye at a times during eac bingo session. Section 4.
