APPEAR.ANCE: Dennis Brose PROCEEDINGS : Mr. Brose explained he was appealing the vacant building fee for the period of March through July. The building was damaged by a fire. It is co-owned by three people and one of the individuals would not release insurance funds held in escrow so that the repairs could begin. This has now been resolved and the work will begin one week from today. Steve Roy explained that the purpose of the vacant building fee is to encourage owners to do the needed repairs and he felt Mr. Brose now intends to do this. BOARD ACTION: Ron Glassman moved to grant a waiver of the vacant building fee for the per�od March through July, ($55 . 00) on con- dition work start one week from today, October 16 , 1984 . (requirement for deadbolt locks and shared baths) ; and variance from items Nos. 3 and 15 in the report for 847 West 7th Street (handrail on front steps and shared bath- room facilities) . APPEARANCE: Richard Williams PROCEEDINGS : NIr. Williams addressed the board stating he is the Executive Director of this correctional halfway house. He ex- plained they are seeking a variance from No. 3 at 847 W. 7th and No. 15 . He explained he did not feel a handrail is necessary as this door is never used for exit except in the case of emergency. The bathroom on the main floor is used by staff and they would be willing to c-�ease the use by staff if a variance could be granted on the bathroom ratio. He further stated they are asking variance from Nos . 14 and 15 for 855 WESt .:'��h:_,,Street�� �a� �� � � ` they do not feel deadbolt locks are �enef��cial; and if they limit use of the bathroom to clients only, they are seeking a variance on the bathroom ratio. also at 855 West 7th Street. Don Miller, Health Department, said it is not necessary la�exe�� ��o have deadbolt locks on individual doors . He felt he had no objection to granting the variance on bathrooms , as long as use by the facility' s staff is discontinued. BOARD ACTION: Bill Tilton moved to grant the variance from code for item No. 15 at 855 West 7th Street, item No. 15 at 847 West 7th Street, pertaining to shared baths; and to deny the variance on item No. 3 at 847 West 7th Street, and that a handrail be in- stalled. SUBJECT: Request variance from items No. 4 ,5 ,6 ,7 ,11 ,14 ,15 ,16 , 20 , 21 , 22 , 28„�9 , 30 , 31 and 34 , because of financial hardship and practical difficulty. � APPEARANCE: Nick Fahey and Grant Golberg PROCEEDINGS: Mr. Fahey and Mr. Golberg explained they owned the property for about three years now and inherited a lot of work orders on it which they were unaware of at the time of purchase. They feel the outside is in bad shape but are now in the process of repairing. Some of these repairs will cost a substantial amount of money; they are not realizing any money from the building at the present time. They asked for some direction for financial assistance from the board. They explained the work that is taking place and showed progress on some and some of the work is already completed. ` � � Minutes , Board af Appeals & Review ��� ��� � - • �Ieeting of October 9 , 1984 } page 4 Alice noted there is extensive use of the extension cord from the house to the garage, and although the tenant says he will reel it in every night, this is hard to enforce. She feels another method should be found and the use of the extension cord discontinued. She also felt the progress on the building has not been that good and expressed concern that the appellants are not admitting that some of these are, in fact, violations and feels it is inappropriate to grant variances until this is guaranteed. She further stated it would be inappro- priate in the case of the retaining wall , until ownership is established for sure. She pointed out to the owners that many of the thinqs needed to be done are maintanance type and due to normal deterioration of the building and will be ongoing. Mr. Fahey and Mr. Golberg assured her they do accept the fact that these are existing violations and are just needing more time and, hopefully, some direction on how to obtain financing. Alice Bijjani suggested they go to the Rehab office at 1010 Univer- sity and try the Multi Unit Division for assistance in obtaining a loan. BOARD ACTION: Bill Tilton moved to deny the variance pertaining to code violation on Nos. 5 , 6 , 7 , 9 , 14 , 15 , 16 , 17 , 19 , and 30 in the city' s letter of inspection; and to grant an extension of time to June l, 1985 to correct code violations Nos . 4 , 8 , 11, 12 , 13 , 18 , 20 and 31, on condition all work be completed by that date; and to grant a variance on numbers 29 and 30 of the inspection report for as long as the present tenant lives there only. Rudolph Sawyer seconded the motion. At this point in the meeting Helen Burke, 940 Goodrich, asked if it would be appropriate to addres the board. She lives directly across the street from this property and is upset about the deteriorating condition of it. She stated she has lived there 28 years and in the last 10 years the property has started to go down hill from lack of care and upkeep. She and other neighbors who were also present feel this can have an adverse effect on their property and would like to see these conditions corrected. Both Mr. Fahey and Mr. Golberg assured her they are now working on the outside of the property, as well as the inside, and intend to improve it substantially. , FURTHER ACTION: In view of additional information and pictures , Bill Tilton moved �o amend his motion to eliminate No . 8 from the extension of time and that this be corrected as soon as possible this fall. Rudy Sawyer who seconded the original motion, seconded the motion to amend. MOTION CARRIED UNANIMOUSLY.
