WHEREAS, Melvin L. Peterson has applied to the Board of Zoning
Appeals for a variance from the strict application of the provisions
of Section 61.101, Schedule of Regulations, of the Saint Paul Legis-
lative Code so as to allow him to construct a deck to be located
two feet from the side lot line of his property located at 1005 East
Maryland Avenue, the legal description of which is Lot 17, Block 7,
Stees Addition to the City of Saint Paul; and �
WHEREAS, following a public hearing with notice to affected
property owners, the Board of Zoning Appeals by its Resolution No.
9624 adopted August 28, 1984, denied the request for a variance; and
WHEREAS, Melvin L. Peterson has duly filed with the City Clerk
his appeal from this determination made by the Board of Zoning
Appeals; and
WHEREAS, acting pursuant to Sections 64.205 through 64.208,
and upon notice to appellant and other affected property owners, a
public hearing was duly conducted by the City Council on October 11,
1984 and the Council having heard the statements made and considered
the variance application, the report of staff and minutes and find-
ings of the Board of Zoning Appeals, does hereby
RESOLVE, that the Cauncil of the City of Saint Paul does hereby
reverse the decision of the Board of Zoning Appeals in this matter
and does hereby grant to Melvin L. Peterson the variance requested
so as to allow him to construct and maintain a deck which is to be
set back two feet from the west lot line on his property at 1005
East Maryland Avenue, legally described as Lot 17, Block 7, Stees
Addition to the City of Saint Paul; and, be it
FURTHER RESOLVED, that the City Clerk shall mail a copy of this
resolution to Melvin L. Peterson, the Zoning Administrator, Planning
Commission and the Board of Zoning Appeals and shall file a certified

line.

Dear Sir:
On August 28, 1984, the Board of Zoning Appeals held a public hearing on
the application of Melvin Peterson to vary the minimum side yard required
for outdoor decks from 4 feet to 2 feet. Staff recommended that the
application for variance be denied.
The applicant testified that the deck was erected to replace a stairway
before he knew that a building permit was required. Ne also explained the
hardship that would be felt without variance and why the unique
relationship of his house to the neighbor's house minimizes the impact of
the variance.
The hearing was closed and the case was discussed by members of the Board.
One member indicated that he would be inclined to approve the variance if
the applicant was able to obtain a maintenance easement from the neighbor
but otherwise feels compelled to deny the variance. A motion to deny the
application for variance passed on a 6 to 0 vote.

B. AP,EA & FRONTAGE: 40' frontage along Maryland Avenue by 120' along tne interior lot
line for 4,800 plus 400 square feet (1/2 of the aliey) for a total of 5,200 square
feet of land area.
C. SITE & AREA CONDITIONS: The site is occupied by a single-family house and detached
two-car garage. The surrounding land is primarily occupied by single-
family houses and accessory structures except for a commercial node located
l block east at the intersection of Maryland and Earl .
D. ZONING CODE CITA7IOPd: Section 61.101, Schedule of Regulations, requires all
construction be setback to provide a minimum 4' side yard.
E. FIPJDINGS:
1. There is no physic�l basis upon which to grant a variance. The subject property
is not unusual in size, shap2, or topography.
2. Strict application of code regulations would not result in exceptinal undue
: difficulty by reason of the existing condition of the property. T�e applicant may
m�dify the deck width without obstructing entrance to the house.
3. The applicant constructed the deck without securing a building permit. Any
hardship re5ulting f rom said construction is self-created.
4. It appears that allowing reduction of side yard could result in overcrowding and
im�air tne spirit and intent of the code unless the applicant secures and records
an easement that aliows the applicant to encroach upon the westerly neighbors
property to complete construction and for ongoing maintenance.

servz as a� obstruction Lo the neighboring property, nor will it alter the basic
ch�,racter of tha.t property. I find it difficult to comprehend this claim of the
dar_ger of "overcro�ding."
Mr. Haider states also tnat I ma,y, in his opinion, cut off two feet of tne
deck without obstructing entranee to the house. The deek as it now stands is five
fe�t wide at the side of �he house. It replaces a set of steps four feet wide tha.t
I consid�red �oo �rrow for easy access to the sids door. I simply believe that
a deck only three feet wide would present som�thing of a hardship in terms of de-
enr_z access to wha� is for r�e ths primary aecess to my house.
I confess to beir�; somewhat baf£led by both the reco�nendations of Mr. Haider
and the decision�of the Board. I've been denied what is ordinaxily a very routine
application for a two foat varia.nce in spite of the fact that there is no neigh-
borhoo3 opposition tc the propaaecl deck. Qne neighbor is on recor3 as having wrztten
to -�he Boaxd in supgort of ray appeal. Yvonne Miller, the owner of the property a,d-
jacent to -che deck, has assured ne persona,Ily �hat she has no opposition to the deck
as it now stands or to a.ny request for the necessary variance. Idot one of my
nezghbors within 100 feet showed up to object when my case was discussed by the

ror reasons unlrnown to me, I feal tYzat I've been wronged by the decision of the
Board and hope tha,t the evidence and iogic presented here will be enough to rectify
the situation. I was certainly wrong in ignorantly constructing the deck without
securing a building permit, and I am well aware tha,t ignorance of the law is no
excuse. What I ask now is that I be allowed to legally protect a deck that is,
in the final ana.l��is, causing no one any txouble. Nor, do T b�lieva, dops it
viola-te either the spirit or code of this city. �

MELVIN L. PETERSON (#9624) : Request for variance to allow a newly
constructed deck to remain 2 feet from the interior lot line; code requires
the deck to be setback 4 feet from the side lot line.
Applicant was present at the hearing. No opposition was present.
Mr. Haider gave the slide presentation and reviewed the staff findings with
a recommendation f or denial . The Board receive� one letter in support of
the variance request.
Mr. Osborn questioned the width of the deck on the diagram and also where
�_. the sidewalk was located. Mr. Haider answered that the deck is 5 feet
wide, and that the sidewalk is located along the side of the house. He
further stated that applicant should have placed the west neighbors house
on the diagram; the house abuts on Cypress and Maryland, and does not have
the same setback as the applicants.
Melvin L. Peterson, applicant, stated that his neighbor's house to the west
lies on the corner of Maryland and Cypress and that there is 2� feet
between the two homes. He stated that he built the deck before he knew
that a building permit was required. He disagreed with the finding that
the construction would be a hardship ta the neighbor. Mr. Peterson further
stated if his request was denied he would have to cut off 2 fee� of the
deck; re?ocate the footings, and he would like not to have to reconstruct
the deck. Mr. Peterson stated his neighbor at 1001 E. iNaryland had no
objection to his building a deck but would not grant an easement as .
suggested by zoning staff because the neignbor was in the process of
selling the property.
Nearing no further testimony, Ms. Morton closed the public hearing portion
of the meeting.
Mr. Osborn stated he was sympathetic with the applicant and he would be
inclined ta approve the request for variance if he were able to obtai;� the '
eas?ment, which th� applicant is not able to obtain and therefore it is not �
possible for him to vote to approve the variance.
