Council for the purpose of considering the actions taken by the
said Board; and
WHEREAS, Acting pursuant to Sectior�s64 .205 through 64 .208 and
upon notice to appellant and other affected property owners, a
public hearing was duly conducted by the City Council on October 4 ,
1984 where all interested parties were given an opportunity to be
heard; and

WHEREAS, The Council having heard the statements made and having
considered the variance application, the report of staff, the minutes
and findings of the Board of Zoning Appeals, does hereby
RESOLVE, That the Council of the City of Saint Paul does hereby
modify the decision of the Board of Zoning Appeals in this matter
and does hereby find and issue the following determination which
shall govern the zoning variances herefor granted:
1) That the decision of the Board of Zoning Appeals to vary
the provisions of the zoning code so as to allow Adath Israel
Synagogue to construct a building addition to be set back 68 feet
from the front property line and two feet from the rear lot line
be and is hereby affirmed subject to the condition that the north
curb cut and access lane meet modern public works and zoning code
standards of minimum width and that the proposed south egress be
posted to direct traffic to proceed with a right turn only and that
all construction be completed in accordance with the application
for variance and the site plan on file with the Saint Paul Planning
Division.

WHEREAS, Adath Israel Sprragogue has applied to the Board of
Zoning Appeals for a variance from the strict application of the
provisions of Sections61.101 and 62.104 (11) of the Saint Paul
Legislative Code pertaining to minimum front and rear yar d setbacks
required for buildings, and from the requirement that off-street
parking not be allowed in a required front yard in an R-1 zoning
district for the purpose of constructing a building addition to
their existing structure and constructing an off-street parking
, facility for_ their property located at 2337 Edgcumbe Road, legally
described as Lots 5 through 7, Block 5, Bohland's Edgcumbe Hills
Addition; and
WHEREAS, Following a public hearing with notice to affected
property owners, the Board of Zoning Appeals by its Resolution No.
9621 dated September 11, 1984 varied the provisions of Section
61.101 and Section 62.104 (11) permitting the construction of a
building addition to be set back 68 feet from the front property
line, two���£eet from the rear lot line, and allowing vehicles to be
parked 28 feet from the front property line at 2337 Edgcumbe Road,
subject to the condition that the north curb cut and access lane
meet modern public works and zoning code standards of minimum
width and that the proposed south egress be posted to direct
traffic to proceed with a right turn only and that all construction
be completed in accordance with the application for variance and
the site plan on file with the Saint Paul Planning Division; and
WHEREAS, The decision of the Board of Zoning Appeals was based
upon the following findings af fact: �
1) An existing synagogue cannot be reconstructed or addition-
al off-street parking provided under strict provision of the code.
2) The plight of the applicant is due to the physical condition

PURPOSE: To consider an appeal of a variance granted to AdatP� Israel
Synagogue by the Board of Zoning Appeals to allow construction
of a building additian and parking in the front yard.
Qoard of Zoniny Appe«ls Decision: Approve (5-0) on the condition that the
north access lane is widenetl pursuant to modern public works
standards and the south egress be posted to allow a "right
turr� onl y" .

submitted (signed by 13 ovrners) ; Southwest District Council
Resolution.
Dear Sir:
On Auyust 14 and 28, 1984, ttie Board of Zoniny Appeals P�eld public hearings
on the application of Adath Israel Synagogue to vary the minimum front and
rear yard standards to permit renovation of a synayogue and allow parking
in the required front yard (set back 28 feet from front lot line) . Staff
recommended that the applicatior� for variance be approved.
The applicant explained the proposal , highlighting the severe handships
that would be felt without variance and the extent to which the site plan
was altered to increase the compatability with the neiyhborhood.
There was considerable testimony in opposition. Concern raised included
the anticipated effect the proposal �vould have on: property values;
neighborhood character; pedestrian and motor vehicle safety; aesthetics of
the site; functioning of the boulevard within the park system; relationship
with adjacent property; and vahether the proposal is a stop gap solution to
the long-term problems associated with the synayogue' s increasing
membership.

The hearing was closed and the case was discussed by members of the Board.
Two conditions to increase site safety were outlined by a member of the

WHER�AS, ADATN ISRAEL SY�aAGOGUE has applied for a variance from tne strict
application of the provisions of Sections 6i .101 and 62.104(11) o� the
Saint Paul Legislative Code pertaining to minimum front and rear yard
setb�cks required for buildings and a requirement that parking not �e
allowed in a required fir�ont yard in the R-1 zonir,g district; ,and
WHrR�aS, the Saint Paul �oard of Zoning Appzals c�nducted a public nzaring
on Augus� 14 and August 2�, 1984, pursuant to said appeal in accordance
with the requirements cf Sec�ion 64.204 of the �egislative Code; and
WHEREAS, the Saint Paul Board of Zoning Appea7s based upon evidence presen- �
ted at the public hearing, as substantially reflected in the minutes, made
the following findings of f act:
1 . ` An existing synogogue cannot be reconstructed or additional off-street
parking provided under strict provision of the Code.
2. The plight of the applicant is due to the physical condition of the
property. The severe topography and structural orientation require-
ments of a sanctuary of Jewish worship limit reconstruction opportuni-
tites to those proposed by the applicant. Additional parking can only
be provided in the front yard. Use of the existing parking facility
is limited during winter by reason of the severe grade of the access
ro ad.
3. The variance, as amended, can be granted without detriment to the
community or intent of the Code.
4. The variance can be granted without detriment to public health and
safety or the neighbors' supply of light and air or property values.
Granting the variance would reduce on-street parking and may increase
traffic safety.
5. Granting the variance will not permit any use that is not permitted in
the R-1 zone. �
6. The request for variance is based upon a desire to enjoy full use of
the property and not merely for economic gain.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Board of Zoning Appeals �
that the provisions of Sections 61 .101 and 62.104(11) be hereby waived to
allow construction of a building addition to be set back 68' from the front
property line, 2' from the rear lot line and allow vehicles to be parked
28' from the front property line at 2337 Edgcumbe Road (Lots 5-7, B1ock 5,
Bohland's Edgecumbe Hills Addition) on the condition that the north curb
cut and �ccess lane meet modern public works and Zoning Code standards of
minimum width and that the proposed south egress be posted to direct
traffic to proceed with a right turn only and that all construction be
completed in accordance with the application for variance and the site plan
on file with the St. Paul Planning Division.

ADATH ISRAEL SYNAGOGIfE (�9621): Request for variance to allow remodeling
of synagogue and parking in the front yard.
Mr. Haider gave the slide presentation and revieti�ed the staff findings.

Ms. Lane stated that the staff repor� did not include the rear yard set-
back.
Rab�i Asner Zeingold, representing Adat1� Israel Syna�ogue, apologized to
the neignbors and residents of tf�e Synagogue area for any hardship and ill
feelings that have been caus°d by their request for variance; that was not
their intention. He further stated that he wanted to stress the need for
an additiona1 parking area. Rabbi Zeingold t2stified that h� had lived
with the site as it is presently for the past 18 years. Th� parking 1ot
has a steep grade, which is a problem even under the best of situations.
He stated that people of the Jewish faith do not drive any motorized
vehicles on the Sabbath, therfore parking is not a prablem on the Sabbath.
The available parking is severely inadequate, however, during morning and
evening weekday services when typically 80 individuals come to worship.
Rabbi Zeingold stated that the present parking lot accomodates a maximum of
12 cars. Synagogue members first park in those parking spaces, then park
on the hill and continue to double park on the hill . This situation is
made arorse in the w�nter months, especially with elderly members of the
Synagogue, and it can be extremely dangerous . Ne also outlined the diffi-
culty in maneuvering on-site due to the re]ationship of th2 access road to
Hampshire and Edgcumbe Road.
Rabbi Zeingold further testified that it was his belief and that of his
architect that granting the variance would not b� detrimental to the
neighbors because the entire area will be shield2d by berming and
plantings. He stated that they vrill b2 more than happy to do wi�atever
needs to be done to shield the area. Rabbi Zeingold stated a letter had
been sent to all individuals on the City`s Notification of Public Hearing
mailing list which stated the Synagogue`s position for requesting the
variance, but that no one had contacted him with suggestions for im�rove-
ment or objected to the proposal as outlined in the letter.

Rabbi G�rshon Grossbaum, Synagogue member, spo'�e in support. H° stated
that the 5uilding is inadequate. The sanctuary nas only tv�to restroom
facilities, one for men arci one for women. The kitchen is a problem in
that they have a need to kezp meat and dairy and utensils separated, so
thQy �ctually need two kitchens. He also autlined energy factors to the
building use. Rabbi Grossbaum further stated that there are plantings on
` the surrounding properties so that houses around tr�e Synagogue are screened
and that the parking lot would not be visable from Edgcumbe Road.
h1r. Irv Rosenblum, 1631 8irchNiood, spoke in s�!oport stating that to get
� into the Synagogue you have to first climb the steep hill . There are many
eldPrly members of the Synagogue and it is very hard an tnem.
f�'r. Charles Tr�zinski , 1848 Nampshire, pro�erty adjacent to the Synagogue,
spo�ce in opposition. Although he is sympathetic with th� Synagogue, he is
not tivilling to risk lowering the values of his property. He f ezls the
cnanges pro�osed by the Synagogue are extensive and that members of the
Synagogue have the obligation to protect the neighbors. He stated that
be�ore he bought his home 1-1/2 years ago that he investigated the zoning
rules, and that was the reason he uren� ahead with the p�rchase .of his home.
H° stated that he feels the Synago�ue should prove that the value of the
properties �vi11 not be lowered. He does not want tQ loo;c out his window to
see asphalt. He believes that the congregation members bougnt the property
kno�r�ing it �rrould not serve long-term needs, and ne is concerned r�ith what
th� next five years ��rill bring with a continuing growing congregation. He
requested that the Board deny the variance.
P�Ir.� William Dunn, 38 Oren Cou�t, testified in opposition stating he had
� bought his home 20 years ago and that he enjoys the area very much. He
stated that the Synagogue property was originally sold in 1953 to a
Lutheran Church until 1954 �vhen it uras sold to the Synagogue, and in 1973
the Synagogue built on a building addition at which time there were no
provisions made for the f ront entrance or additional parking. When they
bougnt that property they knev�l the eleva�ions and the adverse conditions.
Mr. Dunn stated that aft2r rruch research ti�ith Mr. Haider and h1r. Robert
Doty tha± it is his firm belief that the granting or the variance would
reduce property values substantially and therefore should be denied. He
also submitted a letter for the case record. ,
Mr•. Thomas B. Wieser, Attorney, Suite 430 Minnesota Buiiding, representing :
Har•ry Kirby of 1834 Hampsnire, spoke in opposition. He stated that the
burden of proof on the ap�licant is very heavy; that the applicant must
sho�,� proof of hardship based sol��ly on the condition of the property;
ap�licant must show that the property is not currently put to a reasonable
use. Ne stated that the property has been used for the past 30 years and
he questioned ho� the variance will chang� that standard. Mr. Wieser

stated tnat the Kirby's nome nas a large picture window and that they do
not �vant to look out over a paved parking lot. Mr. Wieser had some
questions of the plan as submitted, that he �.as unable to determine the
elevation of the pr�operty parlcing lot, and if the Synagogue plans to
elevate the grade higher off Edgcumbe. Mr. Haider stated it is the appii-
cants intent to have the parking lot at grade wizh the iower level of the
building, and that the architect has not provided the final elevation and
grading plan. ��ir. Wieser stated tha't the plan sho+�red taking away of a
parking space. Mr. Haider said that it ap�ears that one space is being
covered by the building but that a substitute parking space is provided.
Mr. 4Jieser submitted a letter for the record.
h1r. George hlorzoef, 44 Orme Court, testified in opposition stating he
objects to the approval of the variance.
Ms. MichellQ Lichtig, Community Organizer of the So:�th�vest Area District 15
Cormiunity Council , testified stating she v�as not speaking either in
opposition or favor, but that she v��anted th2 opportunity to have both the
residents and the applicant reviear the situation and work ou-t a compromise.
Ms. Lichtig sta�ed a meeting had been scheduled for Tuesday, August 14,
1984 at 7:00 by the Southvrest Area District 15 Corrrnunity Council . The
District 15 Council could make its recommendatian if the Soard continued
this case until August 28, 1984. �
Mr. Grais moved to lay ove� a decision on the matter to A�lgust 28, 1984,
but to continue with further testimony. Mr. Kirk seconded the motion,
which passed on a voice vote of 4 to 0.
Ms. J. C. Fesler, 1863 Hampshire, spoke in opposition. She stated that al-
though the topography of the property is unique, the N�ho1e Nighland area is
unique. She feels that as a homeo�rner the neighborhood integrity should be
maintained.
Mr. Barry Leafman, 1834 Hampshire, spoke in o�position stating he o�,�ns
property at the rear of the Synagogue and that his living room area looks
out across the street and front of the synagogue and he doesn't want to
look out onto asphalt. He further stated 'ne dces not see any safety
factors concerning tnis variance. He also indicated that he would not have
purchased his home had there been a parking lot in front of the Synagogue.
Mr. Harold Brunn, 1845 Hampshire, testifiecl in opposition, stating he has
lived in his home for over 20 years. Ne stated that he supparts others
testifying in opposition, that the congretation of the Synagogue knew the
rules of the game when they purchased the property, and he urged the Board
to deny the variance.

h�•r. Oaniel Dale �estiried on behaif of his moth�r, Olga Dale ti�no resides at
2345 Edgcumbe. Mr. Da1e stated that his mo�ther has been trying to sell her
home for the past six months and that out of 60 persons �.v�o have looked at
her home they have not received one offer diae to the pTaeement of the
Synagogue at the neighboring lot. He further stated that granting the
variance alould exacerbate this situation and be an extreme nar�ship to his
mother. He urged the Corr�nittee to deny the request for variance.
f�s. P�orton asked Ra�bi Grossbauin if he would like to address the issues
raised by the neighbors and to summarize their vari�nce requ�st. .
Rabbi Grossbaum stated that the issues addressed by the neighbors nad been
recognized frorr the very beginning. He stated that he realizes the
neighbors want the neighborhood to be maintained and it is not tneir inten-
t�on to abuse the r2ighborhood in any ti,ray. Hz relt not sufficient
a�tention had been made to the site plan which illustrates efforts to
provide intensive plantings to enhance both the site a�d neigi��orhood in
genzral . Rabbi Grossbaum also s�ated that if granted, the variance v�iould
enhance all af the adjoining properties, that they will see a "parlc" area
and no�c asphalt parking area. He testified that the neighbors to the soutn
have plantings that block th� view and that they have pavement 9n front o-f
their home. Rabbi Grossbaum stated it is their in}ent to come up with
topograhic and landscape plans that will protect neighboring properties.
Rabbi Grossbaum further stated that when they purchased the buiiding and
property that they had a iimited amount of -funds with w}�ich to work, and at
that particular time were hoping tha� the front entrance u�lo+ald be adequate,
but have found out that it is not. They have not ou�Lgrown the space. The
interior square footage for assembly area will remain the same, and the
variance to the rear will not disturb anyone. With regards to the
suggestion that they relocate, Rabbi Grossbaum stated that is not an
option, again stating that tneir congregation does not drive motorized
vehicles on the Sabba�h and several holidays and relocating would caus�
severe undue hardship. If the Synagogue �rere relocated outside of rvalking
distance such as to Mendota, 40 or 50 families would have to relocate
outside of St. Paul nearer to the Synagogue. The Synagogue would not be
against relocating if there were an appropriate site available in the
community, but regretably their options are limited to the proposed
renovation. He concluded by stating that the questions and needs of the
neighbors will be taken into considera�ion. �
With no further testimony, Ms. h1orton adjourned the meeting and reminded
those in attendance of the scheduled meeting of the South�vest Area District
Council .

Mr. Haider stated this case is continued from the August 14 Board of Zoning
Appeals Meeting, and that there are neighbors present today who did not
attend the August 14th meeting who wish to testify. He further stated that
although it is not customary to reopen public testimony in the old business �
portion of the agenda, the Board should consider hearing additional testi-
mony in this complex case and the Board should also consider adjusting the
agenda to accomnodate a full hearing of the case at the end of the agenda.
Ms. Summers made a motion to move discussion of the Adath case #9621 to the
end of the meeting in order to hear further testimony. Mr. Osborn seconded
the motlon, whlch passed on a voice vote of 5 to 0.
Mr. Haider read a letter submitted by William Reiling after indicating that
it is a fairly conclusive outline of the issues raised by neighbors opposed
to the variance. He showed slides and overhead pro�ection presentations.
Asked by Ms. Morton how many parking spaces are proposed in the front yard
and how many are required by code, Mr. Haider stated 15 are proposed and
that the code requires 11.
Ms. Morton stated to the audience that the Comnittee voted to hear further
testimony on this case and asked that the testimony not be repititious.

Mr. William Rosen, Attorney, 1016 Conwed Tower, representing Adath Isreal
Synagogue, stated that Mr. Haider completely outlined their situation. If
the building was expanded without providing parking in the front yard and
required parking was not waived, it would then be necessary to expand
parkin� on the bluff after paving the all�y, but th�t waul� b� � po9r
alternativ� to anly be propnsed as a last resart. Mr. Ros�n explain�d that
their proposal to renovate the Synagogue and park in the front yard
reflects a need to utilize the building as modern design practices dictate,
as compared to a desire to accomodate membership growth. The Synagogue has
members of the congregation who are handicapped and confined to wheelchairs
who are denied access to the Chapel and restroom facilities. These new
found building requirements must be addressed now because the building
expansion of 1973 was not sensitive to accessibility of the handicapped.
The proposed plan increases the Synagogue 12 feet to the east and the
remainder of new floor space is for handicapped accessible restroom
f acilities, hallways, an office for the Rabbi , and a small Chapel .
Mr. Rosen further stated that the Sabbath to Orthodox Jews is the crux to
their existence, and they are forbidden to drive on the Sabbath. He ex-
plained why a car may be parked on a neighborhood street during the Sabbath
worship by indicating that those members of a denomination of the Jewish ,
f aith other than Orthodox who are permitted to operate motor vehicles
during the Sabbath do occasionally travel a long distance to worship at
Adath. They may park their vehicle a few blocks away and, in respect for
the Orthodox congregation they are visiting, walk the final distance to __ _
the Temple. The number of persons who park in the neighborhood on the
Sabbath, however, is so small as to be insignificant.
Mr. Rosen also stated that the Orthodox Synagogue have prayer worship
services three times a day, with the last two worship services separated by
a study period. This worship generates an average of 6 to 15 cars. He
stated that Adath could live with a decision to grant the variance to
expand the Synagogue and waive the required parking by using a drop-off
lane on the lower level , but such a solution is not in the best interest of
the Synagogue or neighborhood. He stated that his clients proposal should
be viewed as an improvement that will make their property more beautiful
and safe. It is their view that the presence of a house of worship in any
neighborhood is an asset that sustains property values. With regard to
some undercurrent that Adath Isreal Synagogue should move, Mr. Rosen stated
that they must stay where they are to avoid relocating the entire congrega-
tion. He urged the Committee to approve the variance.
Ms. Michelle Lichtig, Southwest Area District Council Community Organizer,
stated that Mr. Brunn, 1845 Hampshire, asked to be put on record in
opposition to the variance. She further stated that the Brunn's are not in
opposition to the building expansion as much as concerned with the parking
lot and traffic problems. Ms. Lichtig also presented the Southwest Area
District Council recomnendation that the variance be denied in
consideration of public safety.

Ms. Janet Fesler, 1863 Hampshire, testified in opposition. She believes
that the variance, if approved, would be a detriment to surrounding proper-
ty values, noting that neither the applicant nor city staff has provided
evidence to illustrate that granting the variance would not impair property
values.

children who conceivably will either continue with the congregation or _ _
leave the faith. She further stated that Mr. Rosen's statements that new-

found realities of life necessitate the renovation is inconsistent with the
fact that little has actually changed. Snow in Minnesota has been a
reality since the Ice Ages as has the Orthodox traditions mentioned. She
concluded her testimony stating that the hardship of the applicant are self-
created and urged the Comnittee to deny the variance.
Mr. Eugene Lynsch, 64 Orme Court, testified that he has lived in the �
neighborhood since 1948 and considers the proposal detrimental to the area
and is strongly opposed to the variance.
Daniel Dale testified in opposition on behalf of his mother. He stated
that granting the variance would permit the Synagogue to stand 22 feet
forward of his mothers home and this will impair the market potential of
the house.
Mr. Thomas Wieser, 430 Minnesota 6uilding, testified in opposition on
behalf of Mr. and Mrs. Kirby, 1834 Hampshire. He stated that Mr. Rosen's
presentation did not address the variance, and the plight of the applicant
was created by the applicant themselves. They had the opportunity to
correct building deficiencies when they renovated the Synagogue in 1973.
He has attended several meetings concerning this variance and at each
meeting learns about different plans. Today the applicant stated that
required parking could be placed on the bluff if the alley was improved.
This is not part of the plan first talked about or reflect the variance
application before the Board. He asked the Board to deny the application
for variance of building and parking setbacks.
Mr. William J. Dunn, 38 Orme Court, testified in opposition. He stated he
has lived in the area for the past 20 -,y-ears and that he en�oys living in
the area. Mr. Dunn testified that he has interviewed many people, both in
support and in opposition, and that he has attended several Southwest Area
District Council meetings. He gave a brief history of the site from 1964
to the present, and stated the applicant knew the problems the building and
land had when the purchased the property. He further stated that although
Mr. Haider did send him a map with spot elevations, it did not show the
proposed topography of the berm. He presented the Board with real estate
statistics showing property values in the immediate neighborhood and indi-
cated that property values will decline if the variance is granted.

Mr. Barry Leafman, 1834 Hampshire, testifed that he is totally opposed to
the variance. He stated he was speaking for neighbors that are opposed to
the encroachment on the parkway area. He further stated that he questions
if a landscape architect has been invalved in the site plan as was pro-
mised. He also feels that no solid foundation has been presented to indi-
�ate that prop�rty valu�s in the area will be maintained if the proposed

Rabbi Asher Zeilengold, 1001 S. Prior, testified in support stating that
members of the Synagogue read a chapter of the Bible each week, and that
they judge with righteousness. He quoted a verse from Jeremiah which
states they should "pray for the City in which you live", and that he does
just that. Rabbi Zeilengold told the Board that a few weeks ago vandals
painted in red over the sign in front of the Synagogue that reads "Save
Soviet Jews", and that a man not of the Jewish f aith stopped by his office
to tell him it hurts to see this desecration and requested the Rabbi to ,
have the sign repainted and send him the bill . The Synagogue is keenly
aware of their obligatian to maintain the beauty of the site and shall
aspire to improve the property if the variance is granted.
Hearing no further testimony, Ms. Morton closed the public hearing portion
of the meeting.
Ms. Summers asked if the variance was granted would the site plan review
guarantee that landscaping would be done, and also if the south exit onto
Edgcumbe could be designated for "right turn only".
Mr. Haider stated that the applicant will be required to furnish a
performance bond to guarantee completion of all work shown on the site plan
within one year. Mr. Haider stated that the "right turn only" provision
could be attached to the variance approval as well as a requirement that
the north curb cut and access lane be widened to comply with modern public
works standards.
Ms. Summers stated that she felt the Synagogue was trying to alleviate the
parking problem and that the Synagogue is a permitted use of the site, and
believes that a performance bond will assure neighbors that landscape
screening shall be provided.
Ms. Sumners made a motion for approval of the variance based on findings 1
through 6 of the staff report with the condition that the north access lane
is broadened and the south egress be posted to allow "right turn only".
Mr. Woods seconded the motion, which passed on a roll call vote of 5 to 0.

A. PURPOSE: To consider a variance of building and parking setback requirements to
al—low remodeling of a synagogue and parking in the front yard.
B. AREA & FRONTAGE: This irregular shaped parcel has approximately 195' frontage
along Edgecumbe Road by an average depth of approximately 170' for 33,150 square
feet plus 1,950 square feet of alley right-of-way for 35,100 square feet of total
land area.
C. SITE & AREA CONDITIONS: This site is occupied by a synagogue and adjunct parking
lot on the upper portion of a steep sloping lot. The land in the surrounding area
is exclusively used for single-family residences.
D. ZONING CODE CITATION: Section 61.101 requires that structures be setback a
istance equal to the average setback in the balance of the block (80' in this
case) and maintain existing nonconforming rear yard. Section 62.104(11)
requires that off-street parking spaces not be located within a required
front or side yard.
E. FINDINGS: �
1. An existing synogogue cannot be reconstructed or additional off-street parking
provided under strict provision of the Code.
2. The plight of the applicant is due to the physical condition of the property.
The severe topography and structural orientation requirements of a sanctuary
of Jewish worship limit reconstruction opportunities to those proposed by the
applicant. Additional parking can only be provided in the front yard. Use of
the existing parking facility is limited during winter by reason of the severe
grade of the access road.
3. The variance, as amended, can be granted without detriment to the comnunity or
intent of the Code.
4. The variance can be granted without detriment to public health and safety or
the neighbors' supply of light and air or property values. Granting the
variance would reduce on-street parking and may increase traffic safety.
5. Granting the variance will not permit any use that is not permitted in the R-1
zone.
6. The request for variance is based upon a desire to enjoy full use of the property
and not merely for economic gain.
F. STAFF RECOMMENDATION: Based on findings 1 through 6, staff recommends the amended
application for variance be approved.

Dear Fred:
I am responding to the notice of the expansion of the Synagogue on
Edgec�ambe Bouievard. They wish to receive two variances. One for
construction and that alone is not particularly offensive, but the
parking violates the setback requirements significantly. Instead
of 80 feet there will only be 28 feet. This is not a minor variance.
Tne parking disturbs the character of the neighborhood visually which
has a lawn and trees. The berming of the front of the parkinc� driveway
and parking lot only helps to some degree for those persons traveling on
Edgecumbe but does not help those of us who look f rom the north and south
directly on to the parking lot.
Actualiy, the expansion of the Synagogue will expand their attendance and
the parking problem which now exists will become worse because the new
parking lot tivill not alleviate the situation and they will continue to
park all over the neighborhood as they are now doing. Because they cannot
park on Edgecumbe they park on Hampshire all the way from Edgecumbe up to
Orme Court. It is not as if their services are only one day a week. There
seems to be services regularly and therefore there are people parking in
front of the homes on Hampshire on a regular basis.
There is another problem because Edgecumbe is a heavily traveled street
being it is an extension of Fairview with access to the freeway. Con-
sequently, the cars coming down Fairview and Edgecumbe to the south are
going at a rapid speed and it's going to be difficult for people to puli
out of driveways. It certainly is going to be a safety hazard and I
suggest that the Department of Public Safety look at this situation
and give a report.

I am not familiar with the situation on the rear yard but the request
is for a significant variance from ten feet to two feet. It would be
one thing to ask the neighbors to agre� to some minor var.iances to improve
the utility of the Synagogue but these are not minor variances; these are
siqnificant deviations from the ordinar�ce for a use which is in variance
from the R-1 intent to begin with; hence, we believe it is quite bold to
ask for thi ap roval . We object strenuously to this approval which would
cre a.jo var ances and deviations to the R-1 neighborhood which exists.

Dear Council and Board of Appeals:
tiVe are homeowners living within 350 feet of Adath Israel
Synagogue. We disapprove of the applicant ' s plans for a
zoning variance.
' We realize that within a Rl zone that houses of worship are
permissable. However, the proposed variance will further complicate
a bad situation with regards to traffic and parking in our
neighborhood.
We call to your attention that a variance may not be granted
unless strict enforcement of the zoning code would cause
undue hardship owing to circumstances unique to the individual
property on which the variance is granted. Those "unique
circumstances" are not present in the applicant 's situation .
See, Saint Paul Legislative Code, Sect . 6Q.226 .
The hardship referred to in the city ordinance must be one that
relates to the topography or configuration of the lot
involved. That hardship is not present in the applicant 's
lot , nor is it the basis for their request .
A similar restriction on variances is set forth in 1VI.S.A.
� 462 . 358, subd. 6 , where the Legislature provided for
"unusual hardships" as a ground for branting same, and states
that variance may be granted upon the specific grounds set
forth in the regulations.
Granting such a variance does not meet the hardships
required of the ordinance or the state statutes , and should '
be rejected.

xesidential one with substantial propexty values. Those
pxoperty values have been enhanced and maintained by the

propexty �alues and jeopardize the investment made by
adjacent landowners, including Mx. and birs. Kixby.

Please be advised that I, the undersigned, William Dunn, owner and
resident of 38 Orme Court, St. Paul, Minnesota, acknowledge receipt of
the Public Hearing Notice, with the hearing set for 1:30 P.M, on Tuesday,
August 14, 1984, pertaining to variarzce requested by applicant, Adath
Israel Synagogue, being Zoning File No. 9621.
I have investigated the above matter and obtained a plot plan showing
the proposed development of the land owned by said applicant located at
2337 Edgcumbe Road, St. Paul, Minnesota, being Lots 5, 6 and 7, Block 5,
Bohland' s Edgcumbe Hills Addition, together with other data.
'rhe original structure was built in 1953 by a Lutheran church which sold
the property to applicant on March 31, 1964, and in 1973 applicant added
the 46 ft, x 45 ft. addition to the original building.
I have read the applicant ' s letter dated July 23, 1984 setting forth the
present six problems as the basis for a variance in the zoning of its land,
which six problems existed at the time of purchase by the applicant.
After giving the matter serious consideration, I am opposed to the grant-
ing of the variance requested by the above applicant.
My grounds for opposing the granting of the above variance are as follows:
l. That my residential property located at 38 Orme Court will suffer a
substantial loss in monetary value, as will all other homes in the
immediate vicinity of applicant ' s land.

2 , That the original structure on agplicant' s land is about 36 ft. x 72 ft.
x 12 ft. , containing 2592 sq. ft.
3 . That the applicant in 1973 enlarged the original building by an ad-
dition of about 46 ft. x 45 ft. , containing 2070 sq. ft.
4. That applicant now proposes a further addition to the building of
about 32 ft. x 57 ft. and about 12 ft. x 46 ft. , containing a total
area of 2376 sq. ft. , plus an addition adjoining the alley in the rear
about 8 ft. x 30 ft. , containing 240 sq. ft. , which addition would be
only 2 ft. from the rear lot line according to the plot plan submitted
to the �ity of Saint Paul, plus an additional area of about 10 ft. x
20 ft. , containing 200 sq. ft. located near the Southeast corner o'f
the original building.
5 . That the proposed 15 parking spaces, together with a berm on the land
adjacent to Edgcumbe Road, would make a parking lot out of the front
of the lot of applicant in one of the finest residential areas of the
City of Saint Paul.
6. That the Southwest Area District Council should approve or disapprove
of the applicant ' s request before any action on the part of your

I now have a clear understanding of the expansion of the
Synagogue on Edgecumbe Boulevard. Hence, I would like to
summarize my thoughts in this letter. I appreciate all the
work your office has done and all of the work that has been
done by the District Council 15 .
The legal position has been well stated by the attorneys . It
is encumbent upon the owner to prove that they cvill not alter
the character of the neighborhood. I do not think that they
have demonstrated that . It has been stated that a hardship
would exist if the variance were not granted. This may be true
but the hardship is created because of the owner of the property.
When the congregation was started in 1964 with the purchase of
this property there were 25 to 30 families . Now their con -
gregation has 125 families . It is quite likely that this will
continue to grow. The property cannot handle this size con-
gregation and it will not be able to handle an increasing
congregation which they state they anticipate in the future.
Hence, this would not be a long-term solution in any event .
The information that has been given out by your office and the
information that has been presented at the District Council is
not accurate and does not reflect the true proposal. For
example, it was stated that they intend to raise the parking
lot seven feet from the existing grade. This has not been
shown . It was stated that no one would see the cars in the
parking lot . From my front yard and from my living room windows
and from my windows on the second floor at 1835 Hampshire, I
view directly from the north on to their front yard. Obviously,
if the parking lot were raised seven feet , it would be worse .
No amount of berming would correct this situaLion . This condi-
tion exists for several homes in the neighborhood.

Correcting the view fr�m the vehicles proceeding on Edgecumbe
is not the �ssue . The issue is tne disturbance to the exis�-
ing homes in tn.e neighborhood.
The effect on home values has been mentioned on several occasions .
Clearly, I believe there will be an effect on home values and I
have statistics on presei�t home values . If this is an issue
which needs to be analyzed in depth, I would be happy to do it .
Suffice .it to say that it is just logical that when you have a
major variance ar.d put a parking lot in the front yard, it is going
to have an effect on values for the immediate surrounding homes .
I will mention again the issue of safety because I believe that
we are dealing witn an issue of safety in having a parking lot pull
out into Edgecumbe which carries a significant amount of fast mov-
ing trafFic f�om St . Paul to the freeway.
In summary, we believe that legally the owner has to maintain
the character of the neighborhood which would not be maintained
with this major variance. The growth of the congregation is such
that even with the granting of this variance , the solution is not
adequate and at best , temporary. The granting of the variance
and construction of the parking lot and building would have a
negative effect on home values . The direct access to Edgecumbe
would create a safety hazard.
For these reasons it seems logical that the request for variance
should enied.

Dear Mr, Haider:
The original Code �aas intended to preserve the integrity and character
of the neighborhood so that a controlled environment could be created
in which property owners had assurance of certain continuity of
policy indefinitely.
Variance from Code should not be approved where the character and
quaZity of a residential neighborhood is altered by the desires of a
new resident in the neighborhood.
This is an area of $200, 000 residences constructed approximately 25
years ago and permitting further expansion in variance to the Code
will severely diminish property value in the vicinity and jeopardize
the investment therein.
From a small, quiet church this facility has grown to be an activity
which, because of its growing size, seriously impacts the daily lives
of the area residents. It has been remodeled once and now seeks
further expansion in violation of the Code.
If the variance is approved and the historical pattern continues, it
is reasonable to project further expansion on present property and
on adjacent property which might be acquired in the future as the
activity continues to expand. A dangerous precedent would be estab�
lished if the current variance is approved.
In past years the residences in this area had to abide by the Code
though many would have liked a smaller front yard in order to increase
backyard living area. It was not perr�itted then because the wide
boulevard and beautiful front yards were mandatory. It would dis--
criminate to permit Code variance now! �
Much of t3�e justification for this variance put forth by the petitioners �
is the growth of their congregation and physical problems internally in
the building. I can only say that all the complaints given by the
petitioners were well known over ten years ago when they purchased the
property and nothin� has changed that property since they purchased it.

An estimate ma�e by a knowledgeable appraiser indicates a potential
property devaluation of 25--25$ if variance is approved.
I personally would not have purchased my home 20 months ago had I
known the City Zoning Board would even consider legalizing the
deterioration of the residential quality through irresponsible spot
zoning changes. Furthermore, it seems to me somewhat ludicrous to
negatively impact my property values which are subject to extremely
high �roPerty taxes (over 500� higher than comparable property in
previous residence in another state) in order to er.hance the value
of property, presumably not even taxed.
For all of the above reasons, the variance af building and parking
setback requirements requested by Zoning Fi1e No. 962I should
definitely not �e approved.

Please be advised that I, the undersigned, William J. Dunn, owner and
resident of 38 Orme Court, St. Paul, Minnesota acknowledge receipt of
the Public Hearing Notice, with the hearing set for i:30 P.M. on Tuesday,
August 28, 1984, pertaining to variance requested by applicant, Adath
Israel Synagogue, being Zoning File No. 9621.
I have investigated the above matter and obtained a plot plan showing
the proposed development of the land owned by said applicant located at
2337 Edgcumbe Road, St. Paul, 1"linnesota, being Lots 5, 6 and 7, B1ack 5,
Bohland' s Edgcumbe Hills �ddition, together with other data.
The original structure was built in 1953 by a Lutheran church which sold
the property to applicant on March 31, 1964 for $25, 000.00 and in 1973 ap-
plicant added the 46 ft. x 45 ft. addition to the original building.
I have read the applicant ` s letter dated July 23, 1984 setting forth the
present six problems as the basis for a variance in the zoning of its land,
whi�h six problems existed at the time of purchase by the applicant.
A tter giving the matter serious consideration, I am opposed to the grant-
ing of the variance requested by the above applicant for the following
reasons :
l. That my home located at 38 Orme Court and other homes in the area will
suffer substantial loss in monetary value,

3 . That the applicant in 1973 enlarged the original building by an ad-
dition of about 46 ft. x 45 ft., containing 2070 sq. ft.
4_ That applicant now proposes a further addition to the building of
about 32 ft. x 57 ft. and about 12 ft. x 46 ft. or 237o sq. ft. , plus
an addition adjoining the alley in �the rear about 8 ft. x 30 ft. , con-
taining 240 sq. ft. , which addition would be only 2 ft. from the rear
lot line according to the plot plan submitted to the City of Saint Paul,
plus an additional area of about 10 ft. x 20 ft. , containing 200 sq. ft.
located near the Southeast corner of the original building or a total
area of 28I6 sq. ft.
5 . That the proposed '_5 parking spaces, together with a berm on the land
adjacent to Edgcumbe Road, would make a parking lot out of the front
of the lot of applicant in one of the finest residential areas of the
City of Saint Paul.
6. That on August 20, 1984 the Southwest Area District Council voted against
the granting of a variance as requested by the applicant.
