An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Ace Auto Parts & Salvage, Inc. duly petitioned to rezone Lots 1
thru 10 inclusive Block 2, Green's Addn. to the City of Saint Paul and Lots 17 and
18 of Guerin's Outlots all in Ramsey County located on the south side of Acker
between Rice and Park from I-1 to I-2 for the purpose of expanding an auto
salvage business the petition having been certified by the Planning Division on
August 21, 1984 as having been consented to by at least 67% of the owners of the
area of the property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100 feet of the
total contiguous property within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on September 6, 1984 conducted a public hearing
� for the purpose of considering the rezoning petition, and pursuant to Section
� 107.03 of the Administrative Code, submitted its recommendation to the Planning
. � Commission that the petition be granted; and

� WHEREAS, The Planning Commission considered the rezoning petition at its
��meeting held on September 14, 1984 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the safd
rezoning petition was duly published in the official newspaper of the City on
September 22, 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
October 4, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 12, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows: .
That property located on the south side of Acker
between Rice and Park being more particularly
described as Lots 1 thru 10 inclusive Block 2,
Green's Addn. to the City of Saint Paul and Lots 17
and 18 of Guerin's Outlots , all in Ramsey County be
and is herby rezoned from I-1 to I-2.

The City Council requests that you prepare an ordinance granting the
petition of Ace Auto Parts & Salvage, Inc. to rezone from I-1 to I-2,
property on the south side of Acker between Rice and Park and north of
the railroad tracks to expand an auto salvage business. (Lots 1-10,
Blk. 2, Green`s Add. and Lots 17 & 18, Guerin`s Outlots.)
At the public hearing today, the petition was granted with a request that
the ordinance also include the recammendation of the Planning Staff that
a variance be granted as it relates to outdoor storage. I would suggest
you contact Mr. Chuck McGuire of the Planning Staff for more details as
to the variance.

Dear Sir:
On September 6, 1984, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner was present and
testified. One person testified in opposition. At the close of the
public hearing, the Committee voted 6 to 0 to approve the rezoning.
On September 14, 1984, the Planning Commission upheld the Zoning Committee' s
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on October 4,
1984. Please notify me by October 3, 1984, if any member of the City
Council wishes to have slides of the site presented at the public
hearing.

Vern Brawn, 101 W. Sycamore, spoke in opposition. He stated that he
does not . like the junk cars that Ace Auto Parts currently t��s parked on
the city s�reets. He wanted to know why this is allo�-�ed. He shov:ed the
committee pictures of the site, he suggested that pei°haps Ace Aui:o
f. Parts puL up a rei�ce, and rer�c�e Lhe cars �arked or: t�:e street. He

Mr. Panga] suggested to t�1r. Bro�rn that he call the pc�ice department
' about the cars on the street, and stated that zoning staff will
determire the status of the permit for the crushing operation.
Hearing no further testimony, Mr. Pangal closed the public hearing

process now, and that the site plan is in approvable form.

D. EXISTING LAND IISE: The westerly parcel is below grade alon� Rice Street. It is
currently occupied by a small house and trees and shrubs. The easterly parcel is
vacant and is being used for gravel and crushed cement storage.
E. SURROUNDING LAND USE:
North: Ace Auto Parts, single faraily residential mixed with industrial (I-1 )
East: Vacant (I-1)
South: Railroad yards (I-2)
West: Railroad, industrial (I-2)
F. ZUNING HISTORY: Prior to 1975 the site was zoned Tight industry. In 1975 it was
classified I-1 . The Sycamore-Acker 40-Acre study approved in 1981 did not change
the classification, but recommended that the I-1 on the north side of Acker be used
' as a buffer for the residential area on Sycamore.
G. FINDINGS:
1. Petitioner must rezone this property to expand his business. Junk yards are
first permitted in the I-2 district. The present location is therefore legally
nonconforming.
2. If the rezoning is approved, petitioner will have to obtain a special condition
use permit and site plan approval before the use can be established.
3. The Land U se component of St. Paul' s Comprehensive Plan recommends labor
intensive li�ht industry at this location.
4. The Economic Development strategy of the Comprehensive Plan states that the
City's first priority is to meet the expansion needs of local firms.
5. The District & Plan recommends retaining and stabilizin� existing businesses.
6. The I-2 Industrial District is intended for activities whose external effects
will be felt in surrounding districts. Junk yards must be entirely enclosed
within a building or within an 8' obscuring wall. One property line must abut
a railroad right-of-way.
7. The Sewer Engineer is working with the petitioner to develop an easement for _
stormwater ponding on the eastern portion of the site.

H. STAFF ANALYSIS: The proposed rezoning will enable petitioner to retain and expand
the existing auto salvage business while retaining the I-1 buffer for property to
the north. It is therefore a more suitable solution than rezoning the existing
site. Given the topography of the area, the proposed location would have less of a
visual impact on Rice Street than the existing location.
I. STAFF RECOMMENDATION: Based. on findings 1 , 2, 4-7 and the staff analysis, staff
recommends approval of the rezoning to I-2.

It has recently come to my attention that Ace Auto parts is in the
process of acquiring Lots 18, 19 and part of Lots 20, 21 of Guerin's
Outlots just south of Acker Street for use as a used auto parts �
storage area. As part of the purchase agreement, the sale is
contingent on the rezoning of the land from I-1 to I-2. -
I am , writing to inform you that 2ot 17 and part of Lot 21 have
recently been identified as necessary for construction of a regional
stormwater ponding area. I have been in contact with Marcus Weyandt
of Ace Auto Parts to discuss my concerns about the sale and rezoning.
Mr. Weyandt is presently investigating the feasibility of developing
a joint use facility which would include storage of auto parts �not
subject to gasoline or oil contamination, as well as shallow
stormwater panding.
If an agreement far the joint use of this area can be reached and the
, appropriate ponding easements dedicated to the city, I would have no
objection to the proposed rezoning. If the joint use facility turns
out to be impractical, I would have to request that no action be taken
on the rezoning of Lot l7 and part of Lot 21 until the city has had a
chance to acquire this property in the usual manner.

request for a zoning change to be heard on September 6, �984 at 3�3�:
This support is based heavily on our understanding that Ace Auto
intends to remove the car motors, old cars, etc. which currently sit
in public view. Owners of the company have told us that they will
mone these items onto their new property once it has been rezoned.
Our organization is then available to work with Ace Auto on any other
facade iarprovements they may be interested in.
I3orth End Area Revitalization, Inc. is a new non-profit organization
on Rice Street begun by the business association and the District
� Council. Our focus is currently on strengthening the comarercial
district on Rice Street between the railroad tracks near Ace Auto
and Washington Jr. High School. This is why we have an interest
in this zoning change request, and why we are offering our support
based on the above understanding.
