ZUNING HISTORY: Prior to 1975 the site was zoned Tight industry. In 1975 it was classified I-1 . The Sycamore-Acker 40-Acre study approved in 1981 did not change the classification, but recommended that the I-1 on the north side of Acker be used ' as a buffer for the residential area on Sycamore. G. FINDINGS: 1. Petitioner must rezone this property to expand his business. Junk yards are first permitted in the I-2 district. The present location is therefore legally nonconforming. 2. If the rezoning is approved, petitioner will have to obtain a special condition use permit and site plan approval before the use can be established. 3. The Land U se component of St. Paul' s Comprehensive Plan recommends labor intensive li�ht industry at this location. 4. The Economic Development strategy of the Comprehensive Plan states that the City's first priority is to meet the expansion needs of local firms. 5. The District & Plan recommends retaining and stabilizin� existing businesses. 6. The I-2 Industrial District is intended for activities whose external effects will be felt in surrounding districts. Junk yards must be entirely enclosed within a building or within an 8' obscuring wall. One property line must abut a railroad right-of-way. 7. As part of the purchase agreement, the sale is contingent on the rezoning of the land from I-1 to I-2. - I am , writing to inform you that 2ot 17 and part of Lot 21 have recently been identified as necessary for construction of a regional stormwater ponding area. I have been in contact with Marcus Weyandt of Ace Auto Parts to discuss my concerns about the sale and rezoning. Mr. Weyandt is presently investigating the feasibility of developing a joint use facility which would include storage of auto parts �not subject to gasoline or oil contamination, as well as shallow stormwater panding. If an agreement far the joint use of this area can be reached and the , appropriate ponding easements dedicated to the city, I would have no objection to the proposed rezoning. If the joint use facility turns out to be impractical, I would have to request that no action be taken on the rezoning of Lot l7 and part of Lot 21 until the city has had a chance to acquire this property in the usual manner.
