An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, William J. Kernal duly petitioned to rezone The NWIy 90 ft. of
Blocks B & D, Beaver Lake Heights Add. lying SWIy of the SEIy ext. of the NEIy
line of Lot 1, Block 18, Beaver Lake Heights Add. and the NWIy 90 ft. of Blocks B
& D, Beaver Lake Heights Add. lying NEIy of the SEIy ext. of the SWIy line of the
NEIy 10 ft. of Lot 3, Block 18, Beaver Lake Heights Add. located on the southside
of Stillwater Avenue between Algonquin and Hazel from RM-2 to 6-2 for the purpose
of keeping newly divided lots in a single zoning district the petition having been
certified by the Planning Division on August 28, 1984 as having been consented to
by at least 67� of the owners of the area of the property to be rezoned, and
further having been consented to by at least two-thirds of the owners of the
property situated within 100 feet of the total contiguous property within one year
preceding the date of the petition; and

WHEREAS, The Zoning Committee on September 6, 1984 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on September 14, 1984 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
September 22, 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
October 4, 1984, where all interested persons were heard, and the Council having

Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 16, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
That property located on the south side of
Stillwater Avenue between Algonquin and Hazel
Streets being more particularly described as The

• F. ZONING HISTORY: On December 9, 1g82, the City Councii approved a rezoning to B-3
to permit the existing auto body shop to expand. In May, 1g84, petitioner
submitted a survey and rezoning petition to permit the auto body shop to expand to
the east and south. This survey and rezoning created two tracts with split zoning
(B-2 and RM-2) . The B-3 rezoning was approved by the City Council on August 16,
1984• The lot split was approved by the City Council on the same date, subject to
approval of rezonings for the two tracts with split zoning.
G. FINDINGS:
I. Petitioner must rezone the southerly portions of Parcels 1 and 3 as shown on
the enclosed survey from RM-2 to B-2 because the subdivision regulations
prohibit lots with split zoning classifications.
2. The southerly tracts are not now separated from the northerly business-zoned
property by any kind of fencing or visual screening. These tracts appear to be
functionally related to the business-zoned land. The multifamily uses to the
south are separated from these tracts by a fence.
3. Approval of the rezonings to B-2 would provide a buffer between the auto body
shop in the middle of the area and residential use to the east and west.
¢. The intent of the B-2 district is to serve a consumer population larger than
that served by the B-1 district and is generally characterized by a cluster of
establishments. There is an existing commercial cluster at this location.

H. STAFF ANALYSIS: The redivisison of land that necessitates this rezoning would
create a clearer delineation between the existing residential uses to the south
and the businesses to the north. All of the business uses are required to
maintain a 10' rear yard along the southern property line, since they adjoin a
residential side yard. If the rezoning is not approved, the southerly portion of
parcel 3 will become a landlocked RM-2 parcel.
I. STAFF RECOMMENDATION: Based on findings 1-4 and the staff analysis, staff
recommends approval of the rezonings to B-2.

An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City
of Saint Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.210 of the
Legislative Code, Ace Auto Parts & Salvage, Inc. duly petitioned to rezone Lots 1
thru 10 inclusive Block 2, Green's Addn. to the City of Saint Paul and Lots 17 and
18 of Guerin's Outlots all in Ramsey County located on the south side of Acker
between Rice and Park from I-1 to I-2 for the purpose of expanding an auto
salvage business the petition having been certified by the Planning Division on
August 21, 1984 as having been consented to by at least 67% of the owners of the
area of the property to be rezoned, and further having been consented to by at
least two-thirds of the owners of the property situated within 100 feet of the
total contiguous property within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on September 6, 1984 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the Planning
Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on September 14, 1984 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
September 22, 1984 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought to
be rezoned; and
WHEREAS, A public hearing before the City Council , having been conducted on
October 4, 1984 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 12, as incorporated
by reference in Section 60.301 of the Saint Paul Legislative Code, as amended, is
hereby further amended as follows:
That property located on the south side of Acker
between Rice and Park being more particularly
described as Lots 1 thru 10 inclusive Block 2,
Green's Addn. to the City of Saint Paul and Lots 17
and 18 of Guerin's Outlots, all in Ramsey County be
and is herby rezoned from I-1 to I-2.
Section 2.
That the provisions of Section 60.632 paragraph (2) be and are hereby waived
to permit outdoor storage of used automobiles and automobile parts in an area less
than 300 feet from a residential district.
Section 3.
This ordinance shall take effect and be in force thirty (30) days from and
after its passage, approval and publication.
