RESOLVED, that upon execution and delivery of a release in
full to the City of Saint Paul, the proper City officers are hereby
authorized and directed to pay out of the Tort Liability Fund
09070-511-000, to Janice Smoot the sum of $1, 672 . 10 in full settlement
of her claim for damages sustained Sep-tem�er 2 , 19�3, as a result
of an accident with a City owned vehicle at or near the intersection
of Concord and State Streets in St. Paul.

RE: Janice Smoot v. City of Saint Paul
In this case, a St. Paul police officer drove left of the center
line on his way to a non-emergency call and collided with a vehicle
making a legal left turn in front of him. Plaintiff, driver of the
vehicle hit by the officer, has sued the City for property damages
in the amount of $2, 786 .20 . This office recommends settlement of
this claim for the amount of $1, 672 .10, which represents 60� of
plaintiff ' s damages.
