RESOLVED, that upon execution and delivery of a release in
full to the City of Saint Paul, the proper City officers are hereby
authorized and directed to pay out of the Tort Liability Fund
09070-511-000 to Spencer David Patterson the sum of $4, 500 .00
in full settlement of his claim for damages sustained August 8,
1980, as more particularly set out in a communication to the City
Council on August 26, 1980.

RE: Claim against the City of Saint Paul
by Spencer Patterson
On August 8, 1980, Spencer Patterson was seriously injured when
his car crashed into a bulldozer on Chestnut and Hill in the City
of St. Paul . The collision occurred on a portion of Chestnut
Street which was closed by the City to allow the Chicago, Milwaukee,
St. Paul and Pacific Railroad to upgrade the crossing on Chestnut
Street as it approaches Shepard Road. The City of St. Paul had
barricaded the street, but in the early morning hours of August 8,
1980, a windstrom blew the barricades out of position. Sometime
after the windstrom, but before dawn, Spencer Patterson drove his
car into the construction area and collided with a bulldozer be-
longing to the railroad. He brought suit against the railroad and
the City of St. Paul for damages in excess of $50, 000 . This office
recommends settlement of the lawsuit for a total dollar amount
of $9, 000 to be shared equally by the railroad and the City of
St. Paul.
