1 BE IT RESOLVED, that, upon the petition of I.egacy Properties of Minnesota, as documented in
2 Finance Department File Number 20-1999, public property hereinafter described is hereby vacated and
3 discontinued as public property.
4 Pazcel 1. that part of Pierce Street lying southeriy of the westerly extension of the north line of
5 Biock 5, Excelsior Pazk and northeasterly of the northeast line of the Soo Line Raiiroad
6 right-of-way;
7 BE IT FiTRTHER RESOLVED, that, to clear a cloud on the tide caused by a building encroachment,
8 as documented in Finance Department File Number 20-1999, public property hereinafter described is
9 hereby temporarily vacated and discontinued as public property.
10 Parcel 2. the southerly 1.00 feet of that part of Carroll Avenue lying easterly of the east right-of-
11 way line of Pierce Street and westerly of the northerly extension of the east line of Lot 3,
12
Block 5, Excelsior Pazk.
13 And, subject to the herein stated exceptions, the easements therein aze hereby released.
14 These vacations shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of
15 the Saint Paul I,egislative Code as amended, and to the following conditions:
16 1. That the vacation of Pazce12., described above, and the release of easements therein, shall be
17 only temporary. Upon demolition of the encroaching building, the said Pazcel 2. shall revert to
18 public right-of-way and all easements therein shall be restored.

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That, with the accompanying Utility Easement Certificates of Intended Non-Use, filed
voluntarily on behalf of U.S. West Communications, Incorporated, Northern States Power
Company, District Energy St. Paul, Incorporated, MCI Metro Incorporated, MediaOne, The
Water Utility, and The Department of Public Works, made a part hereof by this reference and
filed in the office of the Ciry Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated Pazcel 2.
described above.

9 hereby temporarily vacated and discontinued as public property.

Company, District Energy St. Paul, Incorporated, MCI Metro Incorporated, MediaOne, The
Water Utility, and The Department of Public Works, made a part hereof by this reference and
filed in the office of the Ciry Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated Pazcel 2.

7 BE IT FiTRTHER RESOLVED, that, to clear a cloud on the tide caused by a building encroachment,
8 as documented in Finance Department File Number 20-1999, public property hereinafter described is
9 hereby temporarily vacated and discontinued as public property.

Company, District Energy St. Paul, Incorporated, MCI Metro Incorporated, MediaOne, The
Water Utility, and The Department of Public Works, made a part hereof by this reference and
filed in the office of the Ciry Clerk of Saint Paul, the City, for itself and on behalf of these
corporations and departments, waives the right to the utility easements in the vacated Pazcel 2.
