WHEREAS, The Metropolitan Waste Control� Commission has re-
quested that the City of Saint Paul convey to it at no compen-
sation a permanent sewer easement over a portion of the property
owned by the City of Saint Paul, the easement to be used by the
Waste Control Commission for the construction of a project
identified by the Commission as the Lower Beltline Interceptor
Project No . 77-05, the project consisting of approximately 3 ,100
lineal feet of a 60 inch gravity interceptor sewer from a point
beginning near the intersection of Warner Road and Highway 61 and
then in a westerly direction along the existing sanitary bypass
to a connection with the existing joint interceptor sewer within
the City of Saint Paul ; and
WHEREAS, The Department of Public Works and the Valuation
Engineer have recommended that the City of Saint Paul grant this
request by the Waste Control Commission; now, therefore, be it
RESOLVED, That the Council of the City of Saint Paul does
, hereby authorize and direct the proper City officers to execute
a Quit Claim Deed on behalf of the City conveying a 35 foot
permanent sanitary sewer easement over the following described
property to the Metropolitan Waste Control Commission, a duly
constituted agency of the Metropolitan Council in form approved
by the City Attorney:

That part of the Northwest Quarter of the Northwest
Quarter of Section 3, Township 28, Range 22, lying
Westerly of State Trunk Highway No. 10 - 61, and lying
�Sor.therly of a line beginning at a point on the west
line of said Northwest Quarter of the Northwest Quarter,
distant 304. 84 feet Southerly of the northwest corner
thereof; thence South 42 degrees 28 minutes East, 589.45
feet; thence South 72 degrees 48 minutes East, 532.35
