WHEREAS, the City of St. Paul (Division of Parks and Recreation) and
Burns Avenue Baptist Church of St. Paul, a Minnesota non-profit corporation,
(legally known as the East Baptist Church of St. Paul) have mutually agreed
to a foot path easement for the purposes of ingress and egress from McLean
Avenue to the Burns Avenue Park; ar�c7
WHEREAS, the Burns Avenue Baptist Church has agreed to convey to the
City of St. Paul for a period of 25 years (from June 3, 1984 to June 2,
2009) an ingress and egress foot path easement over the following described
property:
Beginning at the center point of Barclay Street, vacated, which
intersects with McLean Avenue and extending easterly along McLean
Avenue for 80 feet, then Southerly along a line parallel to Barclay
Street vacated for 80 feet; then Westerly along a line parallel with
McLean Avenue for 80 feet; then Northerly along the center line of
Barclay Avenue, vacated, to the point of beginning, an area of approxi-
mately 6400 feet arx3 further as shown in yellaw in Exhibit B of the
Easement Agreement attached hereto and incorporated herein;
WHEREAS, the Burns Avenue Baptist Church has agreed to convey a
temporary construction easement as shown oaz �chibit B, attached to the above
referenced agreement, said easement c�olored in red, and said easement shall
terminate on December 31, 1984 or upon the completion of the project
whichever c�anes first; r�aw be it
RESOLVED, that the Council of the City of St. Paul hereby authorizes
ar�d directs the proper City officials to execute and accept on behalf of the
City of St. Paul a 25-year easement agreement and temporary construction
easement between the City of St. Paul and Burns Avenue Baptist Church
(legally known as East Baptist Church of St. Paul) for land owned by the
East Baptist Church of St. Paul as herein described. Consideration to be
paid in the s�un of $1.00.

EASEMENT AGREEMENT
This agreement is effective as of the 3rd day of June,
1984 , is made and executed by and between the Burns Avenue Baptist
Church of St. Paul, legally known as the East Baptist Church of
St . Paul, a Minnesota non-profit corporation (hereinafter referred
to as "Burns Avenue Baptist") and the City of St. Paul, Division
of Pazks and Recreation (hereinafter referred to as the "City") .
Witnesseth:
WHEREAS, Burns Avenue Baptist is fee owner of certain
real property situated in the County of Ramsey, State of Minnesota,
more particularly described as:

Lot 2, Block 33, Auditors Subdivision No. 62, St. Paul,
Minnesota except the Easterly 230 feet of the Southerly
150 feet thereof, and except the Easterly 180 feet of
said Lot 2 lying South of the Southerly line of Lot 1,
Block 33, Auditors Subdivision No. 62, St. Paul, �
Minnesota, extended, except the Southerly 150 feet there-
. of, and including the Easterly 30 feet of Barclay Street
vacated between Burns Avenue and McLean Avenue.
WHEREAS, City is the owner of certain property which lies
Westerly of and adjoins the above described property. The City' s
property includes the Westerly 30 feet of vacated Barclay Street
between Burns Avenue and McLean Avenue. This property is present-
ly being used for park and playground purposes and is more ful�ly
described in Exhibit A attached hereto.
WHEREAS, the City desires to create a foot path ingress
and egress easement from McLean Avenue .to the above described City

NOW THEREFORE, in consideration of the mutual covenants
herein contained, the parties hereby agree as follows:
l . LIMITED EASEMENT. Burns Avenue Baptist, as owner of
the land described herein, hereby grants to the City a foot path
ingress and egress easement on, over and across the premises
shown in Exhibit B colored in yellow and further described as
. follows :
The Northwest corner of said property, beginning
at the center point of Barclay Street, vacated,
which intersects with McLean Avenue and extending
- � easterly along McLean Avenue for 80 feet, then
Southerly alony a line parallel to Barclay Street
vacated for 80 feet; then westerly along a line
parallel with McLean Avenue for 80 feet; then
Northerly along the center line of Barclay Avenue,
vacated, to the point of beginning, an area of
approximately 6400 feet.
The sole purpose of this grant of easement is to provide
ingress and egress to the City's adjoining property. The term of
said grant of easement is to run 25 years unless terminated earlier
by Burns Avenue Baptist because of the City' s abandonment or
failure to maintai.n its property as a park and playground or its
failure to maintain or its abandonment of the pathway easement
area. Burns Avenue Baptist assumes no liability for injury to any
person using said pathway of ingress and egress over the property
covered by this easement.

2 . TEMPORARY CONSTRUCTION EASEMENT. Burns Avenue Baptist,
as owner of the land described herein, hereby grants the City a
temporary construction easement on, over and across the premises
as shown on Exhibit B colored in red. Said temporary construction
easement shall terminate on December 31, 1984 or upon completion
of the footpath installation project, whichever comes first.
3. Burns Avenue Baptist has legally approved granting
said easements to the City by giving official notice to its member-
ship for four (4) successive Sundays, with a subsequent vote of
approval by said membership given on Sunday, June 3, 1984 .
...,�.. The City is authorized, without the necessity of pay-
ing any damages, to remove any trees or other impediment which
hinders the proper use of the easement, and must build, .maintai.n;.
and keep free from refuse a foot path of ingress and egress from
� McLean Avenue into the park and playground area.

presents to be executed as of the day and year first above written.

Dear Mr. Nelson:
This letter will serve as authority to accept a 25 year easement from
Burns Avenue Baptist Church for the areas as described below.
The Northwest corner of said property, beginning at the center
point of Barclay Street, vacated, which intersects with Mclean Avenue
and extending easterly along McLean Avenue for 80 feet, then
Southerly along a line parallel to Barclay Street vacated for 80 feet;
then Westerly along a line parallel with Mclean Avenue for 80 feet;
then Northerly along the center line of Barclay Avenue, vacated,
�o the point of beginning, an area of approximately 6400 feet.
This easement will allow neighborhood access into Burns Avenue Park and
will be used exclusively for park purposes.
I have enclosed a copy of an easement agreement prepared by the Church, and
I understand tha�t you a�ill prepare the necessary City Council Resolution.

Dear Mr. Bruns:
This letter is with regard to our telephone conversation on July 17, 1984
concerning the City's need for a temporary grading easement along a portion of
the�Burns Avenue Church property, as illustrated on the enclosed map.
As discussed, this 15' x 140' easement is necessary in order to blend the new
pedestrian path into the slope that is along our comnon property line.
All vegetation, including voluntary trees and shrubs will be removed within
! the easement area if deemed necessary to f acilitate the blending of the slope
to the path. This same disturbed area will then be sodded to provide a smooth
transition to the adjacent areas. .
It is understood that this easement is temporary and will terminate at the end of
the construction period, projected to be late fall of 1984.
I have enclosed two copies of this letter.. As representative of the Burns Avenue
I Baptist Church please indicate your approval of the temporary easement by placing
your signature and date of acceptance on the line below. Please return one of the
' signed copies for our files and retain the other for your church files.
