An Ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes � 462.357 and � 64.210
of the Legislative Code, Gary and Sharon Welker duly petitioned to
rezone Lots 5 and 6, Block 3, Belvidere Park Subd. of Lot 2 , located
at 877 Oakdale, from R-4 to B-1 to permit expansion of mixed com-
mercial residential structure, the petition having been certified
by the Planning Division on July 12, 1984 as having been consented
to by at least 67% of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any such contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Current Zoning Committee on August 2, 1984 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 10 , 1984 and recommended
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council
on the said rezoning petition was duly published in the official
newspaper of the City on August 25 , 1984 and notices were duly
mailed to each owner of affected property and property situated

Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 38,
as incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows :
That property located at 877 Oakdale, being
more particularly described as Lots 5 and 6 ,

Section 2.
This ordinance shall take effect and be in force thirty (30)

Dear Sir:
On August 2, 1984, the Zoning Corrmittee of the Planning Commission held
a public hearing on this rezoning. The petitioner was present and
testified. There was no other testimony at the hearing. At the close
of the public hearing, the Committee voted 5 to 0 to recommend approval
of the rezoning.
On August 10, 1984, the Planning Corrmission upheld the Zoning
Corrrnnnittee's recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on September
6, 1984. Please notify me by September 5, if any member of the City
Council wishes to have slides of the site presented at the public
hearing.

The meeting was chaired by Joseph Pangal, ChairMan.
GARY AND SHAROTJ 4�ELKER (,�g601) : Re?one property at 877 Oakdale fron R-4
to &-1 to allow expansion of mixed coremercial/residential structure.
The applicant was present. There was no opposition present at the
hearing.
P1s. James showed slides of the site and reviewed the staff report with a
recommendation for approval. Pdo correspondence was received, but staff
did get a phone call in support.
The applicant, Sharon i��elker, 7516 E. Zinnia 4�ay, Tiaple Grove, stated
that they own the property at 377 Oakdale. She stated that they have
done much work on the property and that they have received many
favorable comJnents from the neighbors.
Hearing no further comments, I�1r. Pangal closed the public hearirig
portion of the meeting.
Mr. Lanegran moved approval of the rezcning based on findings 1 through
� 5, 7 through 10 and the staff analysis. i1s. Mortor_ seconded the
motion, which passed on a roll call vote of 5-0.

Parce s eligible: 12; parcels needed: 8; Parcels signed: 9.
C. PARCEL SIZE: 79.6 ' (Oakdale) x 120' (Annapolis) = 9,552 square feet.
D. EXISTING LAND USE: Two-story mixed correnercial/residential structure with a newer,
one-story building addition on three sides. The original commercial space is
vacant; the addition is used for motorcycle parts sales.
E. SURROUNDING LAND USE:
North: Singl�-family residential (R-4)
East: Single-f amily residential (R-4)
South: West St. Paul (corr�nercial use and multi-family use)
West: Single-family residential (R-4)
F. ZONING HISTORY: Prior to 1975 this corner and the one across Oakdale were zoned
comnercia . In 1975 both corners were zoned R-4.
G. FINDINGS:
1. The property currently has a certificate of occupancy for office, storage, and
apartment.
2. Petitioners propose rehabilitating the older structure. They will convert the
upstairs to two residential units and will use the downstairs for an
unspecified commercial use. The one-story addition will continue in its
present use.
3. Petitioners cannot get a Change of Nonconforming Use Permit because they
would be expanding the mixed use nature of the building.
4. The Land Use �lan recom�nends continued review of uses permitted in zoning
classifications as well as the zoning for each commercial area (Policy 4.2-5) .

10. The site has two garages, one off Annapolis and one off Oakdale. There will
be some additional off-street parking off Oakdale. Retitioners state that the
garages will be available for tenants' use.
H. STAFF ANALYSIS: The petitioners need to rezone the property in order to add the
additional residential unit. Rather than rezoning to a classification that would
continue the legal nonconforming status of the motorcycle parts store, they wish
- to make the entire structure conforming. The mixed commercial/residential use was
. conforming until 1975, when the property was rezoned to conform with the major use
(single-family residential ) in the area. The existing use does not appear to
create problems in its relationship to its neighbors, and the proposed use is not
significantly different from what exists now. In recent years there has been a
•� number of rezonings in this general area to permit slightly higher residential
densities. When the property was reclassified in 1975 these changes were not
anticipated. It is likely that the continued viability of this commercial
structure was also not anticipated. Approval of the rezoning to B-1 would
recognize that the previous classification was appropriate at this location.
Other B-1 uses that would be permitted by the rezoning appear to be as appropriate
as the existing uses.
I. STAFF RECOMMENDATTON: Sased on findings 1 through 5, 7 thraugh 10, and the staff
ana ysis, staff recommends approval of the rezoning to B-l.

An Ordinance amending Chapter 60 of the ;
Saint Paul Legislative Code pertaining
� to zoning for the City of Saint Paul and
� the zoning maps thereof.

� WHEREAS, Pursuant to Minnesota Statutes § 462.357 and § 64.210
of the Legislative Code, Gary and Sharon Welker duly petitioned to
� rezone Lots 5 and 6 , Block 3, Belvidere Park Subd. of Lot 2, located
at 877 Oakdale, from R-4 to B-1 to permit expansion of mixed com-
mercial residential structure, the petition having been certified
by the Planning Division on July 12, 1984 as having been consented
to by at least 67$ of the owners of the area of the property to be
rezoned, and further having been consented to by at least two-thirds
of the owners of the property situated within 100 feet of the total
contiguous descriptions of real estate held by the same owner or
any party purchasing any . such contiguous property within one year
preceding the date of the petition; and �
WHEREAS, The current Zoning Committee on August 2, 1984 con-
ducted a public hearing fdr the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on August 10, 1984 and recommended '
that the City Council approve the petition; and
WHEREAS, Notice of a public hearing before the City Council �
on the said rezoning petition was duly published in the official �
newspaper of the City on August 25, 1984 and notices were duly i
mailed to each owner of affected property and property situated (
