WHEREAS, Pursuant to Minnesota Statutes �4. 62.357 and �64.210
of the Legislative Code, William J. I�ernal duly petitioned to re-
zone Lot 3, except the NE ' ly 10 ft. , Block 18 and that part of the •
NW 90 ft. of Blocks B and D, which lies SW' ly of the SE 'ly exten-
sion of the SW'ly line of the NE 'ly 10 ft. of said Lot 3 and NE 'ly
of the SE 'ly extension of the NE 'l:y line of Lot 1, Block 18, all
in Beaver Lake Heights, lc�cated at 1906 Stillwater Avenue, from
B-2 and RM-2 to B-3 to allow for expansion of an existing parking
facility for an auto body shop, the petition having been certified
by the Zoning staff as having been consented to by at least 67� of
the owners of the area of the property to be rezoned, and further
having been consented to by at least two-thirds of the owners of
the property situated within 100 feet of the total contiguous
descriptions of real estate held by the same owner or any party
purchasing any such contiguous property within one year preceding
the date of the petition; and
WHEREAS, The current Zoning Committee on June 21, 1984 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to Section 107.03 of the Administrative Code,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Plannir�g Commission considered the rezoning
petition at its meeting held on June 22, 1984 and recommended
that the City Council approve the petition; and

Dear Sir:
On June 21 , 1984, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the
close of the public hearing, the Committee voted 5 to 0 to approve the
rezoning based on staff findings.
On June 22, 1984, the Planning Commission upheld the Zoning Committee' s
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on Au�ust 16,

The m�eting was chaired by Joseph Pangal , Chairman.

Mr. McGuire showed slides ot the site and reviewed the staff report.
Applicant was present. There was no opposition present at the hearing.
P�r. Pangal stated in 1982 �rhen part of the property was rezoned to S-3 that
the petitioner implied that parking area would be blacktoppzd, and asked if
applicant �rould be required to do so. h1r. t�lcGuire said he would be required
to blacktop the parking area.

William Kernal , 2102 E. Larpenteur, stated he vras aware of blacktopping the
lot. htr. Pangal stated that if approved he would need to bring the site
plan showing the area blacktopped. hir. Kernal stated he wants to rezone the
. property and then sell it to h1r. Flackey, Hrho intends to use the site as a
parking facility for the existing bodyshop. fr1r. Pangal asked if h1r. Flackey
��as aware that he would have to submit the site p1an, and that any place
that vrould be used to oark will have to be blacktopaed and landscap�d, and
that the site plan will have to be approved by the City. P,1r. Flackey stated
that he understood those conditions.
With no further testimony, Mr. Pangal closed the public hearing portion of
the meeting.
Based on findings 1, 2, 4, and 6, Ms. Zieman moved approval stressing the
importance of the site plan and blacktopping the parking area. Ms.
Summers seconded the motion, which passed on a roll call vote of 5 to 0.

A. PURPOSE: To consider rezoning from B-2 and RM-Z to B-3 to allow for expansion of �
an existing parking facility for an auto body shop
B. SUFFICIENCY: The petition was determined sufficient by the Zoning Staff on May
5, 984 with 14 of 18 elligible parcels having signed consents. Twelve
signatures are required
C. PARCEL SIZE: Irregularly shaped parcel having approximately 50 feet of frontage
on Sti lwater Ave. and a depth of 190 feet. The area of the flag shaped parcel
is approximately 14,090 square feet.
D. EXISTING LAND USE: The proposed expansion area is currently vacant.
E. SURROUNDING LAND USE:
North: A small B-2 corr�nercially zoned area, vacant and low density residential
East: Vacant commercial and low density residential uses
South: Multi-family housing area and low marshy open spa�e
West: B-3 & B-2 commercial , low density residential accross Hazel
F. ZONING HISTORY: The site was zoned commercial and residential in 1922, and �
rezone to 6- and RM-2 in 1975. The adjacent property was rezoned to B-3 in
November of 1982 to allow for the expansion of the existing body shop. Staff
recommended denial of the rezoning.
G. FINDINGS: '
1. The existing body shop on the adjacent property was legally nonconforming
until that parcel was rezoned to expand the current use in 1982.
2. The petitioner's business is growing and now requires more parking space for
effecient operation.
3. The Comprehensive Plan indicates thet B-3 Commercial areas should be
adjacent to major traTfic arteries; the access routes to this site are
collector streets.
4. The northerly portion of the rezoning site would be surrounded by 6-2 zoned
land and land uses.
5. The southerly portion of the rezoning site would be surrounded by RM-2 zoned
land and higher density iand use which will have a mitigating effect on the
intensity of the proposed use.
6. The site does not appear to be a±tractive or mark�table for other tyQes of
B-3 land uses and would probably revert to less intense land use in the
event the existing body shop were eventually closed.
H. STAFF RECOP�P�ENDATION: Based on findings 1,2, and 4 through 6 above, the St�ft
recorrmends approva of the rezoning to B-3, noting that expansion of the parkir�g
. facilities for this use will require approval of site plans under thc terms and
conditions of the Zoning Ordinance.
