An ordinance amending Chapter 60 of the
Saint Paul Legislative Code pertaining
to zoning for the City of Saint Paul and
the zoning maps thereof.
WHEREAS, Pursuant to Mi.nnesota Statutes � 462.357 and § 64.210
of the Legislative Code, Richard C. and Cynthia L. Adams duly
petitioned to rezane Lat 21, Block 2, Summit View Addition, located
at 1539 Grand Avenue, from 1RM-2 to OS-1 to permit use of existing
structure for professional offices, the petition having been certi-
fied by the Planning Division on July 2, 1984 as having been con-
sented to by at least 67� o� the owners of the area of the property
to be rezoned, and further having been consented to by at least two-
thirds of the owners of the property situated within l00 feet of
the total contiguous descriptions of real estate held by the same
owner or any party purchasing any such contiguous property within
one year preceding the date of the petition; and
WHEREAS, The current Zoning Committee on July 19, 1984 con-
ducted a public hearing for the purpose of considering the rezoning
petition, and pursuant to S�ction 107.03 of the Administrative Gode,
submitted its recommendation to the Planning Commission that the
petition be granted; and
WHEREAS, The Planning Commission considered the rezoning
petition at its meeting held on July 27, 1984 and recommended that
the City Council ap�rove th� petition;' and
WHEREAS, Notice of a public hearing before the City Cauncil
on the said rezoning petition was duly published in the official
newspaper of the City on August 4, 1984 and notices were duly
mailed to each owner of aff�cted property and property situated
wholly or partly within 350 feet of the property sought to be
rezoned; and

mendations concerning the petition; now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul, Sheet No. 18,
as incorporated by referenc� in Section 60. 301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows :
That property located at 1539 Grand Avenue, being
more particularly described as Lot 21, Block 2,
Summit View Addition, be and is hereby rezoned
from RM-2 to OS-1.
Section 2.
This ordinance shall take effect and be in force thirty (30)
days from and after its passage, approval and publication.

Dear Sir:
On July 19, 1984, the Zoning Comnittee of the Planning Comnission held a
public hearing on this rezoning. The petitioner was represented. One
person spoke in support. At the close of the public hearing the
Cornrnittee voted 7-0 to recommend approval of the rezoning to OS-1.
On July 27, 1984, the Planning Comnission upheld the Zoning Comnittee's
recommendation on a unanimous vote.
This rezoning is scheduled to be heard by the City Council on August 16,
1984. Please notify me by August 15, 1984, if any member of the City
Council wishes to have slides of the site presented at the public
hearing.

�r. Lanegran asked P�1s. Tarrant how long she intended to rent the huilding
for residential use. She stated that is a problem; she will continue to
rent as v,�ell as have her o�,�n office located in the bui7ding.
P�s. h'orton questioned the "kid space" rrentioned in her letter �o District
14. P1s. Tarrant stated she has no model to go by. Ner babysitter ti�,�ill be
located in the building, so there ��rill be a person in charge full t�me.
Kathy Tarnowski , Corr►�nunity Organizer for District 14 Corr��unity Council , was
�present in support. She state'd that the Housing Committee of the Community
Counci 1 held a meeti ng i n ►��hic�h they i nvi ted ad j acent property ovmers to
attend. They had received one, phone call �-�hich expressed a concern on the
facade of the building. She s'tated that the Nousing Committee unanimously
felt good about the proposed use.

G. FINDINGS:
1. Petitioner proposes converting the residential portion of the structure to
office use. A part of the first floor will be available for children of the
office tenants.
2. The Land Use Plan recommends "modifying current land use regulatory provisions
to permit appropriate flexibility in the reuse of land and structures" along
commercial strips (Policy 4.2-2) .
3. The Grand Avenue West Plan reco►rmends that additional parking be required when
� the use of a building changes to one that would require additional parking.
4. The Grand West Plan also recommends expansion of cor�snercial uses at cluster
areas. This, site is near the Macalester commercial area.
5. The intent of the OS-1 district is to serve as a transitional use between more
intensive and less intensive land uses. Uses to the west of the site are in
general more intense (corr�nercial and parking lot) than uses to the east;
although there is a single-family house to the irr�nediate west of the site.
H. ST�?FF ANALYSIS: The land uses to the north and k�est of the site are predominately
instituiiona�and commercial . Given Grand Avenue's mixed use character and this
site's location on the Avenue, an OS-1 designation seems appropriate. Petitioners
will provide four parkir�g spaces. The usable floor area of the building is not
known at this time, so no determination of parking required for a new use has been
made. The proposed Zoning Code amendment that would require additional parking
has not 'yet been adopted by the City Council .

Dear Kathy:
Pursuant to our telephone conversation of June 5, 1984, I have docketed
attending a meeting for the neighbors of 1539 Grand Avenue on July 9, 1984. I
would appreciate �it if you would inform me of the place and tiene of this meet-
ing. I will inform you immediately in the event that I do not get the formal
petition filed for the July 19, 1984 hearing.
In the event that I am able to complete the purchase of ��39 Grand Avenue;
my proposal is to make no exterior changes, except possibly sor�e landscaping.
The basement of the buildin� is presently being used by Household Helpers as an
office. I would have no intention of changing that use. The ground floor would
contain a reception area and conference room. What has previausly been the dining
room, kitchen and small bedroom toward the rear of the house would be converted
into what I call "kid space". It would be outfitted and equipped as if a day care
center were being maintained in that space. I will not be running a day care
center per se, but do anticipate that the tenants in the building may enter into
a cooperative effort to hire help to watch their children while they are in the
kid space. I also intend to voluntarily comply with day care regulations. Because
the parents will be on the premises, it is not technically necessary for me to com-
piy with such regulations: No firm decision has been reached an the number or
ages of children that would be in the space, but because of the room configuration,
� I could not conceive of having more than ten children there at the absolute maxi-
mum. Hopefully the number would be smaller than that at any given time. We do
not anticipate taking childrPn who are not associated with the tenants.
The second and third f loors contain seven "bedrooms". I a.nticipate convert-
ing all such rooms to offices. The carriage house-garage will be made weatherproof
and left intact: I anticipate using the ground floor for parking. There is a parking
pad next to the garage which could accommodate two small ca�s. I do plan to
fence the yard and perhaps install some playground equipment.

The building is presently occupied by the owner. As stated above, the base-
ment is being used as offices by a housecleaning services. At least three rooms
in the upstairs of the house are being rented to Macalester students and one room
on the second floor has been converted into a kitchen.
It is conceivable that during the first year of use, I may continue to rent
the upstairs rooms as bedrooms, and only convert the ground' floor to office use.
