WHEREAS, the City of Saint Paul has duly adopted and there is now lawfully in effect a Comprehensive Plan, and a
Phalen Village Small Area Plan and 40-Acre Study, providing far the redevelopment of Phalen Village in District 2, of
which Ames Lake and the surrounding wetlands is a part; and
WIIEREAS, the property, Lot 2, Block 2, Phalen Village, less the westerly 19 feet, is located in District 2 and is a lake
and surrounding wetlands intended for open space in Phalen Village; and
WHEREAS, the Housing and Redevelopment Authority (HItA), pursuant to the provisions of Minnesota Statues, has
agreed to convey said properiy to the City of Saint Paul for use as open space in accordance with the Phalen Village
Plan, a component of the Comprehensive Plan, of which Phalen Village District 2 Area is part; and

WHEREAS, the HRA condu ed a public hearing, pursuant to due notice thereof, on the proposed conveyance; the
public hearing was held on berz�996, at 2:00 p.m., Central Standard time, in the Council Chambers, Third
Floor, at 15 West Kellog Boulevard, in the City of Saint Paul, Minnesota; and
NOW THEREFORE, BE IT RESOLVED by the the City Council of the City of Saint Paul, Minnesota as follows:
1. That the proposa] to accept the conveyance of said property, Lot 2, Block 2, Phalen V illage, less the westerly 19
feet, in the District 2 Area, to the CiTy of Saint Paul conforms to the objectives of the Phalen Village Plan and 40-
Acre Study, a component of the City's Comprehensive Plan, which includes said District, and is hereby approved.
2. That the cost to the City of Saint Paul to acquire the property is One Dollar.
3. That the method of disposition of said property by the HRA is the appropriate method of making said property
available to the City of Saint Paul.
4. That, upon approval of this resolution, the City of Saint Paul Parks and Recreation Department will assume the
mamtenance of and liability for Ames Lake and the surrounding wetlands.
5. That the acceptance of a Deed of Conveyance of said property by the City of Saint Paul is hereby authorized by
the City Council, upon approval by the Director of the Office of Financial Services of the City of Saint Paul no
later than December 27. 2001.
6. That the City of Saint Paul will lease said properiy from HRA at a cost of One Dollar until such time as it is
conveyed to the CiTy of Saint Paul.
7. That the transfer of said property to the City of Saint Paul is considered an addition to the "no net loss" policy for
parkland; the land may be used for future IIRA projects if desired and approved.

� A purchase aa eement and payment for such a sale will be submitted to the Housing and

Subject: Council File #00-1205 - Accepting the Conveyance of Ames Lake
At its December 27, 2000, meeting, the CiTy Council approved a resolution accepting conveyance of
Ames Lake wetland in Phalen Village from the Housing and Redevelopment Authority (HRA). The
resolution will be on the City Council's January 10 agenda to be affirmed.
The December 27 public hearing before the IIRA board on the issue of conveying the Ames Lake
wetland to the City was not properly noticed; the Pioneer Press forgot to publish the public hearing
notice. The City Attorney's o�ce informs us that the December 27 I�tA board action is not valid and
must be re-done; the issue will be before the HRA again on January 10, 2001. Because the HRA board
action is not valid, the City Council action on December 27 is also not valid. Thus, tha City Council
action, accepting the conveyance of Ames Lake, must be affirmed.

Subject: Council File #00-1205 - Accepting the Conveyance of Ames Lake
At its December 27, 2000, meeting, the CiTy Council approved a resolution accepting conveyance of
Ames Lake wetland in Phalen Village from the Housing and Redevelopment Authority (HRA). The
resolution will be on the City Council's January 10 agenda to be affirmed.
The December 27 public hearing before the IIRA board on the issue of conveying the Ames Lake
wetland to the City was not properly noticed; the Pioneer Press forgot to publish the public hearing
notice. The City Attorney's o�ce informs us that the December 27 I�tA board action is not valid and
must be re-done; the issue will be before the HRA again on January 10, 2001. Because the HRA board
action is not valid, the City Council action on December 27 is also not valid. Thus, tha City Council
action, accepting the conveyance of Ames Lake, must be affirmed.
