FtESOLVED, that upon the petition of Bernard and Sara Koenke per File 12-
1984 those sections of public street and alley hereinafter described be and
the same are hereby vacated and discontinued as public street and alley:
All that part of Brawn Avenue as originally platted, lying south of a
line drawn from the northeast corner of Lot l, Block 51 to the
riorthw�est corner of Lot 4, Block 52 and north of a line drawn fran the
southeast corner of Lot l, Block 51 to the southwest oorner of Lot 4,
Block 52, a11 in Brown and Jackson's Additiori to West St. Paul; and
also all of the alley, as originally platted, in Block 17, The West
St. Paul Real Estate arxl Improvement Syndicate Addition No. 2.
Subject expressly to the follawing Qonditions and reservations:
1. That the vacation be subject to all the terms and conditions of Chapter
130, codified March 1, 1981, of the St. Paul Legislative Code as amended.
2. That a permanent sewer easement be retained in the westerly fifty-one
feet (51') of vacated Brown Avenue being subject to the following
restrictions:
a. No buildings, structures, or trees are permitted within the
easement area, or any tenrporary structure, material storage,
fixture or other objects that will prohibit riorn�al access to
water facilities for maintenance purposes.

c. No change in surfacing within the easement area is permitted
without written permission fran the Director of the Department of

3. That a specific easement be retained within vacated Brown Avenue to
protect the interest of Northern States Faver Co�npany.
4. That the petitioners pay to the city the sum of $5,980.00 as
ao�rpensation for the vacated area.
5. That the petitioners, their successors or assigns, by acceptance of
the terms and conditions of this vacation, agree to indemnify, defend and
save harmless the city of St. Paul, its officers and employees from all
suits, actions or claims of any character, including but not limited to, a
claim brought because of any injuries, or damages received or sustained by
any person, persons or property, on account of this vacation; or because of
any act or omission, neglect or misconduct of said petitioners; or because
of any claims or liability arising from or based on any violation of any law
or regulation m�3e in accordance with the law whether t� the petitioners or
any of their agents or employees.
