00-11950�?�������'�4� � Presented By Referred To RESOLUTION CITY OF SA1NT PAUL, MINNESOTA Councff File # Ot1 _ ��q� Green Sheet # __�� (��� Cortuitittee: Date WHEREAS, Saint Paul Legislative Code §409.06(n) prohibits the issuance of an off-sale liquor license within 300 feet of public or parichal school, church or synagogue; and WHEREAS, the councii may disregard this prohibition upon receipt of a written petition signed on behalf of the school, church or synagogue so located, by five-sevenths vote; and WAEREAS, Solo Vino, LLC, d/b/a Solo Vino has applied for off-sale liquor license for the premises located at 517 Selby Avenue, which is within 300 feet of Dayton Avenue Presbyterian Church; and WHEREAS, the governing board of the Dayton Avenue Presbyterian Church has granted a waiver of the distance limitation; now therefore, be it any an RESOLVED, that the City Council hereby waives the prohibition contained in Saint Paul Legislative Code §409.06{n} and authorizes the issuance of the off-sale liquor license, subject to any other legal requirements of the code. The members of Session received and reviewed your communication at our stated meeting of December (12/14/60). We were unawaze of the ordinance that would require a varianca for you to locate within 300' of our church. In response to that situation, the Session took official action on behalf of Yhe congregafion szating that Dayton Avenue Presbyterian Church, does not oppose the licensing of your business for the sales of fine and specialYy wines. A copy of the official action of Session can be made available to you or to the city licensing office if requested. Tf you need any further clarification, please let me know.
